Prawidłowe zarządzanie mieniem komunalnym wymaga m.in. przestrzegania zasady gospodarności związanej z ochroną przed nieuzasadnionym uszczupleniem majątku gminy. Jedną z metod umożliwiających odtworzenie mienia jest ubezpieczenie. W artykule rozważana jest możliwość ubezpieczenia majątku komunalnego w towarzystwach ubezpieczeń wzajemnych oraz wskazano korzyści i zagrożenia dla JST związane z umową ubezpieczenia zawartą z TUW.

Proper management of municipal property is related to protection against unjustified loss of municipal property. Insurance is one of the methods enabling its reproduction. The article considers the possibility of insuring municipal assets in mutual insurers and indicates benefits and threats to LGU related to the insurance contract concluded with a mutual insurer.

W artykule omówiono gospodarowanie nieruchomościami gruntowymi na obszarze trzech miast metropolitalnych (Kraków, Poznań, Szczecin) w latach 2001-2008, wykorzystanie powierzchni miast oraz zmiany w strukturze funkcjonalno-przestrzennej użytkowania gruntów. Celem publikacji było omówienie stanu i kierunków zmian w komunalnych nieruchomościach gruntowych, struktury ich rozdysponowania oraz gospodarowania zasobem gruntów gminnych w celu zabezpieczenia go do realizacji inwestycji publicznych, infrastruktury społecznej, komunikacyjnej i technicznej oraz możliwości przygotowania gruntów pod inwestycje o znaczeniu metropolitalnym i oferty terenowe dla inwestorów, których gmina zamierza pozyskać. Wskazano również główne problemy utrudniające realizację polityki przestrzennej gmin.

The paper discusses land property management within the areas of three metropolitan cities of Poland (Kraków, Poznań, Szczecin) in 2001-2008, utilization of urban space and changes in functional and spatial structure of land use. The goal of the paper was to discuss the condition and directions of changes in municipal land properties, the structure of their distribution, and management of municipal land stock in order to secure it for public investment projects and for social, transport and technical infrastructure projects, as well as possibilities of preparing land for metropolitan projects, and land offers for those investors, whom the municipality wants to attract. Also main problems, which impede the implementation of spatial policies in communes were shown.

The act on the management of the state property adopted in 2016 significantly transformed the entire system of management of state property, including its functional and structural-organisational aspects. As part of this reform, some provisions of the municipal economy act were also amended, which is understandable given affiliation of both types of property (state and municipal) to one category of public property. This article answers the question — what are the consequences for the self-government sector and economic agents operating within it (entrepreneurs acting on the basis of municipal property) of the changes made relating to the status, composition, appointment and operation of the supervisory board and board of directors of municipal company.

Dwudziestopięciolecie samorządu terytorialnego w Polsce jest dobrą okazją do poddania przebytej drogi pogłębionej refleksji. Dobrze jeszcze pamiętamy intencje skupionych w Senacie I kadencji twórców tworzonego wówczas systemu ‒ możemy zatem porównać pierwotne założenia ze stanem obecnym. Chodziło, z jednej strony, o wpisanie projektowanych rozwiązań w tradycję polskiego samorządu, ale z drugiej strony i przede wszystkim – o nawiązanie do tych wszystkich osiągnięć myśli prawnoustrojowej, które znalazły swój najpełniejszy wyraz w postanowieniach Europejskiej karty samorządu lokalnego, stanowiącej kwintesencję zachodnioeuropejskiego modelu władzy lokalnej. Samorząd jest instytucją charakterystyczną dla cywilizacji zachodnioeuropejskiej (w zasadzie poza nią nie jest znany), która odnosi treść zasady reprezentacji także do lokalnej przestrzeni życia obywateli (cives). W artykule starano się ukazać na konkretnych przykładach, w jaki sposób projektowany kształt władzy lokalnej w Polsce, wyrosły z paradygmatu ojców miasta, tracił poprzez kolejne nowelizacje swoją pierwotną zachodnią wyrazistość na rzecz charakterystycznego dla poprzedniego systemu rad narodowych modelu gospodarza.

The twenty-fifth anniversary of self-government in Poland is a good occasion to reflect on the road we have travelled so far. While we still remember well the intentions of the creators of the system (members of the First Senate) we can now compare them with the current state of affairsand the status quo of government in Poland today. Two concepts have always been there since the beginning. Whereas the original solutions were to be inscribed in the tradition of Polish self-government, everything was done from the very start to draw as much as possible from the achievements of legal political thinking, later manifested in the provisions of the European Charter on Local Self-Government – a document which is the quintessence of the Western model of a local authority. Self-government is an institution characteristic of Western civilisation, practically unknown elsewhere, and it extends the principles of representation onto the local space inhabited by its citizens. Examples offered in the article illustrate how the initially planned model of government in Poland, rooted in the city fathers model has, in the course of subsequent reforms, been losing its original Western clarity in favour of the previous host model of local authority that characterised the past system.
