17 października 2017 r. w Warszawie została podpisana umowa o zabezpieczeniu społecznym między Rzeczpospolitą Polską a Republiką Turcji oraz porozumienie administracyjne do tej umowy. Umowa i porozumienie nie weszły dotychczas w życie, jednak ich postanowienia są już znane. Tekst umowy i porozumienia administracyjnego został zamieszczony w Bazie Traktatowej Ministerstwa Spraw Zagranicznych 1. Niniejsza publikacja ma na celu przybliżenie problematyki koordynacji świadczeń emerytalno-rentowych w stosunkach polsko-tureckich, w tym uregulowań zawartych w nowo podpisanej umowie. W publikacji kompleksowo omówiono zakres podmiotowy i przedmiotowy koordynacji emerytur i rent oraz postanowienia merytoryczne w instrumentach prawa unijnego i międzynarodowego wiążących Polskę w stosunkach z Turcją. Porównano postanowienia umowy polsko-tureckiej z umowami Polski z innymi państwami w tym obszarze. Przeanalizowano także status obywateli Turcji na gruncie obowiązujących w Polsce unijnych i międzynarodowych aktów prawnych w zakresie koordynacji emerytur i rent, których stroną nie jest Turcja. Problematyka koordynacji systemów zabezpieczenia społecznego jest szczególnie ważna w aspekcie świadczeń długoterminowych takich jak emerytury i renty. Normy merytoryczne, kolizyjne i proceduralne prawa unijnego i międzynarodowego w tym obszarze zapewniają kompleksową ochronę osobom migrującym i członkom ich rodzin.

On 17 October 2017 in Warsaw, the Republic of Poland and the Republic of Turkey signed an agreement on social security together with the administrative arrangement to that agreement. The agreement and the arrangement have not yet entered into force, however, their provisions are already known. The text of the agreement and the administrative arrangement have been entered into the Treaty Database of the Ministry of Foreign Affairs. This paper aims to present the issue of the coordination of pensions in Poland–Turkey relations, including their regulation in the recently signed agreement. This publication describes in detail the scope and coverage of pension coordination and substantive provisions within the EU and international instruments of law binding for Poland in its relations with Turkey. The provisions of the Poland–Turkey agreement have been compared with agreements between Poland and other states concerning similar matters. Also, the status of Turkish citizens has been analysed based on the EU and international legal instruments applicable in Poland regarding the coordination of pensions to which Turkey is not a party. The problem of social security coordination is particularly important in the aspect of long-term benefits such as social security and retirement pensions. Substantive EU and international conflict-of-laws and legal procedural rules in this sphere ensure for a comprehensive protection of migrants and their family members.
