Artykuł ma na celu ukazać złożoność problemu, jakim jest prawne usankcjonowanie klauzuli sumienia dla farmaceutów. Żywa dyskusja na ten temat toczy się obecnie nie tylko w Polsce. Autor omawia wydaną przez Comitato Nazionale per la Bioetica opinię w sprawie sprzeciwu sumienia wobec sprzedaży środków antykoncepcji awaryjnej. Analiza dokumentu odsłania argumenty zwolenników i przeciwników przyznania aptekarzom prawa odmowy sprzedaży takich preparatów. Sam dokument zawiera również wskazania etyczne użyteczne dla odpowiednich władz i instytucji, których zadaniem jest zabezpieczenie dostępności leków dla pacjenta. Wskazania te zachowują swoją aktualność w przypadku ewentualnej legalizacji klauzuli sumienia dla farmaceutów w Polsce.

The aim of this article is to present the complexity of the problem connected with the legitimization of the conscience clause for pharmacists. At this point in time, a lively discussion concerning this issue is taking place not only in Poland but also in other countries. The author discusses an opinion published by the Comitato Nazionale per la Bioetica (The National Bioethics Committee) concerning conscientious objection to selling emergency contraceptives. The analysis of this document presents arguments of both supporters and opponents regarding the right to refrain from selling such pharmaceuticals. The document itself contains ethical recommendations useful for authorities and institutions whose aim is to protect the accessibility of medicines to patients. These recommendations remain valid even if the conscience clause should be legalized in Poland.
