The article contains a description of the relationship between the consent of the owner of uninhabited real estate and the public law obligations resulting from the submitted declaration concerning the amount of the fee for municipal waste management. The author negatively assesses the legal solutions that give owners of uninhabited real estates the freedom to choose whether they want to be included in the municipal waste management system. Given the massive scale of performance of the service of waste collection and management, the tightness of the system is important, which is not guaranteed by the regulations adopted by the legislator.
This paper is another in a series of articles on waste management and the third one relating to municipal waste management fees covered by the inhabitants of Warsaw. These fees have changed for the third time since 2020. Each change means de facto their increase and discriminates a large group of our society. The unsuccessful attempt by the Council of the Capital City of Warsaw to make fees dependent on the usable floor area of residential premises prompted the authors of this paper to take a closer look at this method. It should be emphasized that determining the municipal waste management fees dependent on the usable floor area is sanctioned by the Act on Maintaining Cleanliness and Order in Municipalities. The analysis of the definition of the usable floor area has shown how extremely controversial this method is. The authors of this article confirmed their belief that they had proposed a rational method of calculating fees for municipal waste management in their two publications entitled Changes in the municipal waste management system – legal and economic aspects as exemplified by the Capital City of Warsaw and Fees for municipal waste management in Warsaw. The authors of the article suggest that a single fixed and set by law fee should be introduced for each person who declares their place of residence in Poland. The fee would not depend on the amount of water used, the usable floor area of the dwelling or whether a person lives in a single-family or multi-family building.

Artykuł jest kolejnym z cyklu artykułów dotyczących gospodarki odpadami i trzecim odnoszącym się do opłat za gospodarowanie odpadami komunalnymi, które ponoszą mieszkańcy Warszawy. Od 2020 r. te opłaty zmieniły się po raz trzeci. Każda zmiana jest de facto ich podwyżką oraz dyskryminuje jakąś dużą grupę naszego społeczeństwa. Nieudana próba Rady Miasta Stołecznego Warszawy uzależnienia opłat od powierzchni użytkowej lokali mieszkalnych skłoniła autorów artykułu do przyjrzenia się tej metodzie. Należy podkreślić, że ustalanie opłat za gospodarowanie odpadami komunalnymi zależne od powierzchni użytkowej sankcjonuje ustawa o utrzymaniu czystości i porządku w gminach. Analiza definicji pojęcia powierzchnia użytkowa wykazała, jak wyjątkowo kontrowersyjna jest to metoda. Autorzy artykułu utwierdzili się w przekonaniu, że zaproponowali racjonalny sposób naliczania opłat za gospodarowanie odpadami komunalnymi, w swoich dwóch publikacjach pt. Zmiany w systemie gospodarki odpadami komunalnymi – aspekty prawne i ekonomiczne na przykładzie m.st. Warszawy oraz Opłaty za gospodarowanie odpadami komunalnymi w Warszawie. Autorzy artykułu sugerują, że należy wprowadzić jedną, ustalaną ustawą, stałą opłatę od każdego człowieka deklarującego miejsce zamieszkania na terenie Polski. Opłata nie byłaby zależna od ilości zużytej wody, powierzchni użytkowej lokalu mieszkalnego ani od tego, czy dana osoba mieszka w budynku jednorodzinnym, czy wielolokalowym.
Waste management is currently one of the most important problems of the functioning of densely populated areas, important in the case of cities. The main problem of waste management is to break a simple correlation between economic growth and the increase in the amount of waste. Forecasting of amount of municipal waste generation on the basis of previously applied methods in the situation of large changes in socio-economic environment turns out to be inaccurate approach. In the literature a wide variety of geographically diverse factors are proposed for this purpose. This paper presents the results of modeling and forecasting of municipal waste generation changes in cities. In this study, the impact of the various socio-economic factors for the municipal waste production was tested.
The audit of providing appropriate management of municipal waste by public administration bodies was carried out on NIK’s own initiative, in relation to the introduction of a new system for municipal waste treatment. The system is based on selective collection of waste from property owners, and then on their management in regional systems for municipal waste processing. The audit was additionally justified with press information according to which, for instance, not all regions of municipal waste management had been equipped with appropriate systems. Also, in some regional waste management plans, the status of a regional system was often granted to systems that did not meet the legal requirements or had too low capacity, and in many municipalities irregularities existed as for delivering waste to the regional municipal waste systems which, consequently, hampered their functioning. What is more, municipalities did not provide sufficient supervision of the companies that collected, processed and neutralised municipal waste, as a result of which the amount of municipal waste transported to garbage dumps has increased.
This article provides a quantification of the territorially varied relation between socio-economic factors and the amount of municipal waste in Polish districts. For this purpose, eight causes were identified: revenue budgets, the number and area of uncontrolled dumping sites, population density, the share of working-age population, average gross monthly wages, registrations for permanent residence, and the number of tourists accommodated. The preliminary data analysis indicated that to understand waste generation in Poland at the local level it is necessary to consider regional specificity and spatial interactions. To increase the explained variability of phenomena, and emphasise local differences in the amount of waste, geographically weighted regression was applied.
This paper addresses the issue of the functioning of regional facilities for the processing of municipal waste in the light of the provisions of the Competition and Consumer Protection Act of 16 February 2007. The authors seek answers to the question of whether in certain specific situations it is possible to conclude that a given facility holds a dominant position on the market in which it operates. Two situations will be subjected to close analysis, namely those in which only one or two facilities with RMWPF status operate in a given region of municipal waste management.
W artykule przedstawiono zagadnienie niekontrolowanego powstawania wielkiej masy odpadów komunalnych w środowisku wiejskim. Opisano strukturę wiejskich odpadów bytowo-gospodarczych, w których przewaŜają odpady nieorganiczne (metale, szkło, ceramika, guma). Wskazano zagroŜenia, jakie stwarzają nielegalne wysypiska odpadów powstających w wyniku działalności bytowej ludności wiejskiej.

The article presents the problem of uncontrolled creation of the great mass of municipal waste in rural areas. The structure of rural economic waste existentially with predominantly inorganic wastes (metals, glass, ceramics, rubber) was described. Pointed out the risk posed by illegal dumping of waste resulting from activities of living conditions of rural population.
The information disseminated by the media on planned and implemented changes in the waste management system recently gave rise to a widespread thesis that municipalities would take over ownership of municipal waste. This statement, repeated many times, has become imprinted in the public consciousness. It has even entered the language used in law, serving as a kind of mental shortcut. Therefore, it may be worthwhile to analyse on its meaning to determine whether it really reflects current state of affairs. The purpose of this article is to present the conclusions of the legal analysis of the title to waste due to individual legal entities involved in the process of waste management. At first glance, a reflection on the ownership of municipal waste appears to be void of any significance to the legal or economic extent. However, the conclusions derived from it are not completely free from practical implications, be it, for example, in the event of a theft of waste. At the background of such reflections lies waste management being a real challenge to the modern world, and, at the same time, a profitable sector of the economy. There is big money that may be generated from waste removal, management and subsequent recycling. The report prepared by the Bank of America Merrill Lynch in April 2013 ‘No time to waste – global waste primer’ estimates the global market for municipal waste amounting to about 410-430 miliard US dollars, and the broadly understood waste management sector (including radioactive waste, medical waste or garbage incinerators) to one billion US dollars.

Informując o planowanych, a następnie wprowadzonych, zmianach w systemie gospodarowania odpadami, media spopularyzowały stwierdzenie, że gminy przejmą własność odpadów komunalnych. Hasło to, powtarzane wielokrotnie, utrwaliło się w świadomości społecznej. Trafiło nawet do języka prawniczego, jako swoisty skrót myślowy. Warto zatem podjąć refleksję nad jego sensem i prawdziwością. Celem niniejszego artykułu jest przedstawienie wniosków z analizy tytułu prawnego do śmieci, jaki przysługuje poszczególnym podmiotom prawnym zaangażowanym w proces gospodarowania odpadami od ich powstania do utylizacji. Rozważania na ten temat z pozoru wydają się pobawione jakiejkolwiek doniosłości w sferze prawnej czy ekonomicznej. W istocie wnioski z nich płynące mają praktyczne znaczenie, choćby w kontekście kradzieży odpadów. Warto pamiętać, że w tle owych rozważań znajduje się proces gospodarowania odpadami będący wyzwaniem dla współczesnego świata i jednocześnie dochodową gałęzią gospodarki. O wielkich pieniądzach, jakie wchodzą w grę, można mówić zarówno w kontekście rynku usług wywozu i zagospodarowywania odpadów komunalnych, jak i zysków z odzysku surowców wtórnych. Dość powiedzieć, że przygotowany przez Bank of America Merrill Lynch w kwietniu 2013 r. raport „No time to waste – global waste primer” szacuje wartość światowego rynku odpadów komunalnych na kwotę ok. 410-430 mld USD, w rozumianej zaś szeroko branży śmieciowej (w tym odpady radioaktywne, medyczne czy spalarnie śmieci) – na bilion dolarów.
This article attempts to evaluate the effects of the amendment to the Act on maintaining the cleanliness and order in Polish municipalities based on the reports of local governments of the following three voivodeships: the Lesser Poland (Malopolska), Opole and Silesia, in terms of the implementation of provincial waste management plans for the period 2011-2013. The chosen period of analysis includes the breakthrough between the rules of the Act on maintaining the cleanliness and order in municipalities prior to the amendment and after amending it to a large extent. This allows to assess the influence of the amendment on the attitudes of local governments concerning the problem of waste management and the effects of changing those attitudes according to the letter of the amended law.

W artykule podjęto próbę oceny efektów nowelizacji ustawy o utrzymaniu czystości i porządku w polskich gminach na podstawie sprawo-zdania samorządów trzech województw: małopolskiego, opolskiego i śląskiego z realizacji wojewódzkich planów gospodarki odpadami za lata 2011-2013. Wybrany okres analizy obejmuje przełom pomiędzy rządami ustawy o utrzymaniu czystości i porządku w gminach w brzmieniu sprzed nowelizacji i tejże ustawy w dużym zakresie zmienionej. Daje to możliwość oceny wpływu nowelizacji na postawy samorządów w stosunku do problemu zarządzania gospodarką odpadami oraz efektów zmiany tych postaw, zgodnie z literą ustawy znowelizowanej.
The article discusses the transformation of the municipal waste management sector in Poland, taking place during 2011- 2013, upon the case study of the Świętokrzyskie Region. The pivotal assumptions of the new model of municipal waste management in Poland are: the change of the owner of municipal waste that became communities, the improvement of the municipal waste collection, transportation and processing, and finally regionalization that means the division of the territory of Poland into municipal waste management regions. The research conducted among local authorities of the Świętokrzyskie Region has revealed that the system solutions applied in the field of municipal waste management, being currently implemented in Poland, though they are not free from socio-economic threats, lead to the fulfilment of the waste hierarchy, including the increasing levels of recycling and the reduction of bio-waste disposal.

Life cycle sustainability assessment of municipal waste management systems The core element of all waste management systems that determines further treatment is the collection, transportation and sorting of waste. There is a spectrum of options that ranges from the complete source separation of waste with little or no consecutive sorting to the minimum separation at source and the consecutive central sorting of fully commingle waste. As each of the collection - transportation - sorting methods has particular characteristics, in assessing the most sustainable solution, a number of factors have to be taken into consideration. To assist decision makers (ad exemplum local authorities), the authors of this article has specified environmental, economic and social criteria that need to be considered while designing the integrated waste management systems. They can be grouped into environmental effectiveness (conservation of resources and reduction of environmental pollution), economic affordability and social acceptability. The article refers to the authors’ research on “The application of life cycle assessment in the integrated municipal waste management” founded by DAAD (Deutscher Akademischer Austauschdienst).

Ocena cyklu życia w gospodarce odpadami komunalnymi Kluczowym elementem wszystkich systemów gospodarki odpadami, który warunkuje dalsze zagospodarowanie odpadów jest etap zbiórki, transportu i segregacji tychże odpadów. Istnieje szerokie spektrum możliwości realizacji tego zadania - począwszy od selektywnej zbiórki u źródła i bardzo ograniczonego dalszego sortowania (uzdatniania) a skończywszy na zbiórce odpadów w formie zmieszanej, które następnie poddawane są kompleksowemu sortowaniu i doczyszczaniu. Mając na uwadze fakt, iż każde z alternatywnych rozwiązań systemu zbiórki - transportu - sortowania odpadów komunalnych wymaga odmiennego podejścia, przy ocenie najbardziej zrównoważonego rozwiązania wiele czynników musi być brane pod uwagę. By pomóc praktykom (na przykład władzom lokalnym) w tym trudnym zadaniu, autorzy niniejszego artykułu określili środowiskowe, ekonomiczne i społeczne kryteria, które powinny być brane pod uwagę podczas projektowania zintegrowanych systemów gospodarki odpadami. Należy wśród nich wymienić efektywność środowiskową (w tym ochronę zasobów naturalnych i zapobieganie zanieczyszczeniom), przystępność ekonomiczną oraz akceptowalność społeczną. Artykuł prezentuje wybrane wyniki badań autorów poświęcone „Zastosowaniu oceny cyklu życia w zintegrowanej gospodarce odpadami komunalnymi” finansowane przez DAAD (Niemiecka Centrala Wymiany Akademickiej).
Proper waste management is one of the fundamental elements of the economy that has lead to ensure the economic security of the country. Without a ratinal and effective waste management there is a risk of many problems in such areas as energy, agriculture, food, health status of society. According to principle of subsidiarity, promoted by the European Union decision-making system in waste management and other segments of economy should be designed so that decisions are taken as close to citizens. The European Union should intervene only when action on local, regional or national level is not the optimal solution. The community is positioned closest to the people in Poland. It has been equipped with the number of operational tasks in the field of the municipal waste management. On the other hand, the European Union is to set strategic objectives and the creation of standards that must be observed in the management of municipal waste. This has lead to the creation of the effective waste management in Europe. The main target of the paper was to present the current system of decision-making in the waste management and judge its performance. It is based on the analysis of inner and international documents as well as secondary empirical data desribing the results achieved in the economy of waste in selected large cities operating on district rights.

Właściwe gospodarowanie odpadami stanowi jeden z istotnych elementów gospodarki, który ma prowadzić do zapewnienia bezpieczeństwa ekonomicznego kraju. Bez racjonalnej i skutecznej gospodarki odpadowej istnieje ryzyko pojawienia się wielu problemów w takich obszarach, jak: energetyka, gospodarka żywnościowa, stan zdrowia społeczeństwa. W myśl zasady subsydiarności, propagowanej przez Unię Europejską, system decyzyjny w gospodarowaniu odpadami i innych segmentach gospodarki powinien być tak skonstruowany, aby decyzje były podejmowane jak najbliżej obywateli. Unia Europejska powinna ingerować jedynie wtedy, kiedy działanie na szczeblu lokalnym, regionalnym czy krajowym nie stanowi optymalnego rozwiązania. Jednostką terytorialną, usytuowaną najbliżej obywateli, w Polsce jest gmina, która zgodnie z zasadą subsydiarności została wyposażona w szereg zadań operacyjnych w zakresie gospodarowania odpadami komunalnymi. Natomiast zadaniem Unii Europejskiej jest wyznaczenie celów strategicznych i tworzenie wzorców, których trzeba przestrzegać w gospodarowaniu odpadami komunalnymi. Ma to prowadzić do powstania skutecznej gospodarki odpadami w skali Europy. Celem badawczym artykułu było przedstawienie istniejącego systemu decyzyjnego w gospodarce odpadami i ocena jego funkcjonowania. Prezentowane treści są oparte na analizie istniejących dokumentów krajowych i unijnych oraz danych empirycznych wtórnych, przedstawiających osiągnięte rezultaty w gospodarce odpadowej w wybranych dużych miastach funkcjonujących na prawach powiatu.
Rational waste management requires proper activities by economic units according to hierarchy of waste management as elaborated by EU. It includes the plan of action that aims at separating economic growth, that makes an increase of economic welfare, from the amount of waste, that make a burden for environment due to decreasing the quality of components of environment as well as life conditions and public health. Poland as EU member implemented the rules of waste management. Th ere are, however, the obstacles to successful management due to the heritage dating from centrally planned economy (eg. Constructing pesticide waste cemeteries) as well as still low ecological consciousness of the society in Poland. Th e main target of the paper is to point out the current problems of the waste management in Poland. Racjonalna gospodarka odpadami wymaga podejmowania konkretnych działań przez podmioty gospodarcze, w myśl opracowanej przez Unię Europejską hierarchii gospodarowania odpadami. Zawarte w niej działania mają na celu oddzielenie wzrostu gospodarczego, który przyczynia się do zwiększania siły nabywczej i dobrobytu społeczeństwa, od ilości wytworzonych odpadów, które z kolei stanowią obciążenie dla systemu środowiskowego, obniżając jakość poszczególnych komponentów środowiska naturalnego, a tym samym pogarszając warunki życia i zdrowia społeczeństwa. Polska jako członek UE stara się prowadzić gospodarkę odpadową według unijnych zasad. Na przeszkodzie skutecznego działania stoją jednak błędy popełnione jeszcze za czasów gospodarki centralnie planowanej, co do postępowania z odpadami (np. tworzenie mogilników) oraz ciągle jeszcze zbyt niska świadomość ekologiczna Polaków w tym zakresie. Celem badawczym artykułu jest wskazanie aktualnych problemów w gospodarowaniu odpadami w Polsce. Przedstawione treści będą oparte na analizie treści istniejących dokumentów o zasięgu krajowym i międzynarodowym oraz na analizie danych empirycznych wtórnych, obrazujących aktualny stan polskiego środowiska.
Artykuł omawia aktualny stan gospodarowania odpadami komunalnymi w Polsce w porównaniu do innych państw Unii Europejskiej. Wskazuje ilości wytwarzanych odpadów komunalnych na przestrzeni ostatnich kilku lat w Polsce i w pozostałych krajach unijnych. W pracy porównano sposoby zagospodarowania odpadów w Polsce i Europie, takie jak: recykling, kompostowanie, termiczne przetwarzanie i składowanie odpadów. Przedstawiono analizę instalacji do przetwarzania odpadów komunalnych w Polsce. Opisano też tendencje w systemie gospodarowania odpadami komunalnymi w ostatnich latach. W zakresie gospodarowania odpadami komunalnymi w Polsce nastąpiły znaczące zmiany w tym zakresie. Spadła ilość odpadów kierowanych na składowiska, a wzrosła ilość odpadów poddawanych odzyskowi i recyklingowi. Zmiany te są pozytywne i odzwierciedlają rozwój systemów gospodarowania odpadami komunalnymi w innych państwach UE. Artykuł wskazuje problemy i kierunki zmian w zakresie gospodarowania odpadami komunalnymi w Polsce w najbliższych latach, zwłaszcza w kontekście realizacji założeń gospodarki o obiegu zamkniętym i celów wyznaczonych przez Unię Europejską w zakresie wzrostu poziomu recyklingu odpadów i ograniczenia ich składowania.

The paper discusses the current state of municipal waste management in Poland compared to other European Union countries. It indicates the amounts of municipal waste generated over the last few years in Poland and other EU countries. The paper compares waste treatment methods in Poland and Europe, such as recycling, composting, thermal treatment and waste disposal. An analysis of municipal waste processing installations in Poland is presented. The trends in the municipal waste management system in recent years have also been described. In the field of municipal waste management in Poland, there have been significant changes. The amount of waste sent to landfills has decreased, and the amount of waste recovered and recycled has increased. These changes are positive and reflect the development of municipal waste management systems in other EU countries. The article indicates the problems and directions of changes in the field of municipal waste management in Poland in the coming years, especially in the context of the implementation of circular economy assumptions and the goals set by the European Union in terms of increase the level of waste recycling and reducing their disposal.
Przedmiotem artykułu jest wykazanie zależności między hierarchią sposobów postępowania z odpadami a aktami prawa miejscowego. Wyjaśnione zostaną definicje terminów tworzących przywoływaną hierarchię. Dokonana zostanie charakterystyka aktów prawa miejscowego w gospodarce odpadami komunalnymi.

The aim of the article is to demonstrate the relationship between the waste management hierarchy and acts of local law. The definitions of terms related to invoked hierarchy will be clarified. Characteristics of local law in municipal waste management will be also presented.
Mechanical biological treatment (MBT) of municipal waste comprises mechanic pro cessing (sorting) and biological processing of mixed waste, combined in one integrated technological process, in order to prepare waste for recycling, thermal transforma tion (energy recovery) and, eventually, for storing at landfills. NIK has conducted an audit of treating waste produced as a result of municipal waste processing in MBT plants after the Statistics Poland (Polish: Główny Urząd Statystyczny, GUS) publi shed the data for 2017, which show that there is a risk to meeting the objectives set for Poland by 2020, i.e. 50 percent of recycling, preparing for reusing of four waste fractions (paper, glass, plastic and metal), and reduction of stored waste volume. In order to evaluate waste processing in a reliable manner, the audit was conducted at six regional authorities offices (Polish: urzędy marszałkowskie), six regional environ mental protection inspectorates, twelve entities operating MBT plants, as well as at six entities that manage landfills, since still the majority of municipal waste, having been processed, is sent to landfills. The article presents the most important findings of this comprehensive audit.

Instalacje służące mechaniczno-biologicznemu przetwarzaniu odpadów komunalnych (dalej instalacje MBP) stanowią w Polsce dominującą technologię. Szacuje się, że funkcjonuje ich ok. 200. Do września 2019 r. miały status instalacji regionalnych, tj. takich, do których podmioty odbierające odpady w gminach przekazywały odpady zmieszane. Często dostarczano tam również te pochodzące ze zbiórki selektywnej. Z ustaleń Najwyższej Izby Kontroli wynika, że działania organów administracji publicznej oraz zarządzających instalacjami MBP nie służą skutecznemu zagospodarowaniu i unieszkodliwianiu odpadów. Wbrew wymogom prawnym większość z nich nie jest przygotowywana do ponownego użycia.
Gospodarowanie odpadami komunalnymi stanowi pewien wycinek zadań z zakresu utrzymania czystości i porządku w gminach i wchodzi w skład tzw. gospodarki komunalnej, obejmującej w szczególności zadania o charakterze użyteczności publicznej. Co do zasady jednostki samorządu terytorialnego, w tym gminy, mają swobodę wyboru sposobu prowadzenia i formy gospodarki komunalnej. Do zadań, w przypadku których przepisy szczególne przewidują ograniczenie samodzielności gminy przy wyborze sposobu prowadzenia i formy gospodarki komunalnej, należą zadania z zakresu gospodarowania odpadami komunalnymi. Wykonanie tych zadań może być zlecane tylko po przeprowadzeniu przetargu, do którego w zakresie nieuregulowanym przepisami ustawy o utrzymaniu czystości i porządku w gminach stosuje się ustawę „Prawo zamówień publicznych”. Taki stan prawny pociąga za sobą konieczność stawania do przetargu nawet spółek ze 100% udziałem gminy oraz wyklucza możliwość wykonywania tych zadań przez własny samorządowy zakład budżetowy.

Waste management is one of the tasks of maintaining cleanliness and order in municipalities. It’s a fragment of the municipal economy, which includes, in particular, tasks related to public services. As a rule, local governments, including municipalities, are free to choose how and in which form to conduct municipal management. One of the tasks, where the particular regulations provide for limiting municipality autonomy in choosing the methods and forms of conducting municipal management is related to municipal waste management. Tasks carried out in this area may be delegated only after public tender, which is mostly regulated by the Public Procurement Act. Such a legal status means that even municipal companies must stand for tender, and self-government financial institutions are prevented from performing these tasks.

Przeprowadzona analiza ma za zadanie wskazać mocne i słabe strony krakowskiego systemu odbioru odpadów oraz preferencje i oczekiwania mieszkańców wobec wdrożenia innowacyjnych rozwiązań w tym obszarze. W artykule poruszono problem segregacji odpadów, odpowiedniej infrastruktury oraz możliwości implementacji rozwiązań smart city w celu sprawnego zarządzania nią, a tym samym poprawy efektywności gospodarowania odpadami w badanym mieście. Metodyka badań: Aby osiągnąć założony cel, wykorzystano metodę analizy literatury przedmiotu i aktów prawnych oraz analizę wyników autorskich badań ankietowych i danych statystycznych. Wyniki badań: Analiza danych statystycznych wykazała, że połowa wytwarzanych na terenie Krakowa odpadów komunalnych nie jest segregowana. Na podstawie analizy badań ankietowych przeprowadzonych wśród mieszkańców stwierdzono natomiast, że w znacznej większości deklarują oni segregację. Jak wykazały badania, nie mają oni jednak wystarczającej wiedzy, by robić to poprawnie. Wyniki badań sugerują również, że system gospodarki odpadami funkcjonujący na terenie miasta wymaga wprowadzenia usprawnień w wielu obszarach. Wnioski: Na podstawie wyników badań ankietowych stwierdzono, że system gospodarki odpadami w Krakowie wymaga usprawnień, jeśli chodzi zarówno o działania mające na celu kształtowanie świadomości mieszkańców co do zasad poprawnej segregacji odpadów, jak i sprawny ich odbiór na terenie miasta. Wkład w rozwój dyscypliny: Przeprowadzone badania pozwalają na usystematyzowanie wiedzy na temat zasad gospodarki odpadami stosowanych w Krakowie. Stanowią one również uzupełnienie informacji dotyczącej opinii mieszkańców w zakresie identyfikacji ewentualnych wąskich gardeł w systemie gospodarowania odpadami oraz rozwiązań, które powinny zostać wdrożone, by spełnić ich oczekiwania.

Objective: The article evaluates waste management in Cracow, indicating the strengths and weaknesses of the city’s waste collection system as well as the preferences and expectations of residents vis-a-vis the implementation of innovative solutions in this area. The article discusses the problem of waste segregation, the relevant infrastructure and the possibility of implementing smart city solutions for efficient management, thus improving the efficiency of waste management in the city. Research Design & Methods: The subject literature, legal acts and the results of proprietary surveys and statistical data are analysed. Findings: The analysis of statistical data showed that still half of the municipal waste generated in Cracow is not segregated. At the same time, the vast majority of Cracow’s citizens maintain that they segregate their waste. As research has shown, however, they lack the appropriate knowledge to do it correctly. Research results also suggest that the city’s waste management system requires improvements in numerous areas. Implications / Recommendations: The survey results suggest that Cracow’s waste management system requires improvements, both in terms of citizen awareness about the principles of proper waste segregation, and efficient collection within the city. Contribution: The research helps systematise knowledge about the principles of waste management in Cracow. The article also supplements information on residents’ opinions on identifying possible bottlenecks in the waste management system and the solutions they would like implemented to meet their expectations.
The fee for municipal waste management in Poland may be differentiated due to such conditions as, inter alia, the area of the dwelling or the number of residents. The problem analyzed in the paper is whether it also applies to the fee when choosing the method of its determination per household.
