Need for closure is a construct that describes a motivational tendency to quickly select and prioritize information in the environment. Such tendencies can affect the process of negotiations, and so the quality of their outcome. The rigidity that accompanies high need for closure can lead to less openness to proposals that benefit one’s partner, and to solutions that are less optimal. We conducted a study in which 34 pairs of individuals negotiated. Pairs were matched in terms of need for closure (high vs. low) and gender. We found that need for closure affected subjective evaluations of certain aspects of the negotiation process. Participants with low need for closure were more likely to indicate that they and their partners sought win-win solutions during the negotiation. This led to a greater sense of process fairness for the negotiation. These results can be taken into consideration when teaching negotiations, and when planning real-life negotiations.

The European Union and Japan have clearly been the heavyweights of international trade for decades. They are the first and the fourth largest economies in the world, respectively. Together they account for nearly one third of the global GDP and almost a quarter of all international trade. And yet their bilateral trade has been underperforming in recent years. Trade in goods actually declined since 2000 – both in relative and absolute terms – and trade in services, as well as foreign direct investment, clearly do not reflect the clout of these two advanced economies. However, since 2010 there have been serious attempts from the Japanese government and the European Commission at finding a way to revive and foster the EU‑Japan bilateral trade and economic relationship. In March 2013 they decided to launch negotiations in order to establish a comprehensive free trade area, or FTA. This article describes developments leading up to that point and presents an analysis of problems affecting the EU‑Japan trade. It does so in the context of a recent surge of international activity as regards trade liberalization through FTA negotiations following the effective failure of global trade talks in the World Trade Organization forum.

The road to statutory regulation of legal personality of the Catholic Church in Poland "of the people" was extremely tortuous and had its turbulent history. In my analysis, I present how it came to pass the so-called "May's laws" and type this process in the whole relation between state – church, in the decade of eighties of the twentieth century. As I prove in my analysis, the way of conducting the work on the statutory regulation of the legal personality of the Catholic Church depended directly on the condition of the mutual relations and especially of the current, in a given period of time, concept of the religious policy of authorities, which in the last decade of the existance of the PRL had variable and dual character.

The aim of the article is to analyze the proceedings of negotiations concerning compensations to be paid by Germany to the Polish victims of Nazi crimes. These negotiations ultimately led to the adoption of the agreement of 16 October 1991, which opened the way for providing help to those victims who live in Poland. This is a relatively scantily studied area of the entire packet of regulations (Treaty on the Confirmation of the Frontier, the so-called “Big” Treaty, the Two-Plus-Four Agreement) which opened a new chapter in Polish-German relations. The article for the most part refers to documents published for the first time. The negotiations that led to the agreement of 16 October 1991 took more than two years to conclude and were extremely complex. Their outcome was the so-called pragmatic solution and within its scope - regardless of discrepancies in legal attitudes (which formerly blocked the payment of compensations by the FRG) – the way was opened for providing concrete help to those victims of Nazi crimes who live in Poland.

The focus of the paper is the selected, most significant theoretical aspects of negotiations conducted within the European Union. They include the following: the large number and diversity of negotiators; the specific subject of EU negotiations, making them multi-level and multi-dimensional; the multistage character of EU negotiations and, thus, the involvement of various actors at different levels, calling for different kinds of negotiating activities; and, last but not least, the top-down and bottom-up processes that are the determiners of negotiations in the EU.

Celem artykułu jest przedstawienie interpretacji i wybranych typologii stylów negocjacyjnych na podstawie analizy porównawczej literatury na temat negocjacji. Najpierw wyjaśniono samo pojęcie stylu negocjacyjnego, wskazując na jego relatywizm. Następnie zaproponowano koncepcję uporządkowania typologii rozważanych stylów, wyróżniając ich dwie zasadnicze grupy, tj. normatywne i deskryptywne, a w ich ramach jedno- i wielowymiarowe. W kolejnych częściach artykułu przedstawiono cztery przykładowe koncepcje typologii stylów negocjacyjnych, reprezentatywne dla wyróżnionych grup tych typologii.

The objective of the paper is to present the idea and selected typologies of negotiating styles on the basis on the comparative analysis of the literature on negotiations. In the first part of the article there is a definition of the negotiation style notion in terms of its relativism. Then, there is an ordering proposal of the considered styles typology, by distinguishing the two substantial groups, i.e. normative and descriptive ones and within them one- and multidimensional ones. In the subsequent parts of the paper, there is a presentation of four exemplary typology concepts of negotiating styles, representative for the distinguished groups of the typologies.

The article deals with the organisational aspects of the Congress of the Czech, Hungarian and Polish Kings in Visegrad in 1335. The introduction focuses on the sources of this research. The first substantive chapter deals with the political and logistical aspects for the choice of the location for the Congress and then with the main points of the negotiations. Significant part of the article is dedicated to the previous history of the Congress and to the organizational details. The readers can obtain a lot of information about the number of participants and about their social-cultural life during the Congress. Very interesting part of the article deals with the kind of official gifts and with the question of how much did the participants eat and drink. The article is a very important introduction to the every days life of the medieval Congresses and political summits of high ranks.

Serbia began the process of integration with the European Union in 2003. After eleven years on a difficult road to the transformation of political and constitutional contexts, Serbia gained the chance to become a member of the Community. On the path to accession to the European Union, Serbia had to resolve some strategic challenges, of which the main one is the problem of regulating the political status of Kosovo. The aim of this article is to indicate the position of Serbia and Kosovo’s Albanians regarding the dispute over the political status of Kosovo, as well as examine the process of normalisation of relations between Serbia and Kosovo as a key mechanism for resolving the dispute. The challenges emerging for Serbia as a result of the negotiation process will be covered. The new dimension of Serbia’s cooperation with Russia will also be analysed as one of the factors which may have a significant impact on the further dynamics of the process of Serbia’s integration with the European Union.

Recently the virtual organization of work has become of crucial significance. The changes in the work environment induced by the Industry 4.0 revolution are also reflected in the emergence of virtual negotiations. New settings impose new challenges not only for negotiators, but also for higher education struggling to provide students with the best opportunities for comprehensive development. Given the applicability of virtual exchange (VE) in business higher education, the main objective of this paper is to present the usefulness of virtual exchange as a tool to boost students’ skills that are necessary for virtual negotiations. Firstly, the concept of the 4th space was applied to compare the context of virtual negotiations and VE projects. Secondly, the learning outcomes of the VE projects were studied from the perspective of the requirements of virtual negotiations.

The article reflects on the negotiations on the EU’s 2021–2027 Multiannual Financial Framework and the European Union Recovery Instrument. It gives an overview of exceptional circumstances surrounding the negotiations, broad scope of the legislative package negotiated, and complex decision-making process. The paper also examines the final agreement, in particular as regards the size of the new long-term budget, the shift in spending priorities, and changes in the way the EU actions are financed. The author concludes that despite many difficulties on the road to the agreement, some elements of the outcome can be characterised as groundbreaking. She gives some arguments that a departure from path dependency in financing of the EU is possible. However, whether or not the change is permanent, depends on the successful implementation of the decisions made. The Conference on the Future of Europe gives an opportunity to continue the debate on further reform of the EU finances.

R ola Kościoła katolickiego w trzech ostatnich latach istnienia PRL była znacząca. Po trzeciej pielgrzymce Jana Pawła II wspomniana instytucja wystąpiła jako pośrednik i moderator dialogu między władzami a opozycją. Episkopat konsekwentnie odrzucał kolejne propozycje strony rządowej zmierzające do reformy systemu bez udziału dzia- łaczy zdelegalizowanej „Solidarności”. Zaangażowanie hierarchii kościelnej było nie- zwykle ważne dla doprowadzenia do rozmów „okrągłego stołu” oraz w czasie wyborów parlamentarnych w czerwcu 1989 r., gdy jej wsparcie okazało się kluczowe dla zwycięstwa Komitetu Obywatelskiego i klęski listy rządowej. W tym okresie Episkopat odniósł także bezprecedensowe sukcesy w zakresie relacji państwo–Kościół: uregulowanie swojego statusu prawnego i nawiązanie stosunków dyplomatycznych między Stolicą Apostolską i PRL. Oba osiągnął na własnych warunkach, wykorzystując swoją silniejszą pozycję negocjacyjną. Artykuł przedstawia podejście struktur centralnych Kościoła w Polsce do sytuacji politycznej w ostatnich trzech latach PRL, gdy Episkopat był swego rodzaju akuszerem porozumienia między władzą a opozycją.

T he Roman Catholic Church played a significant role during the last three years of the People’s Republic of Poland. Following the third pilgrimage of John Paul II, the institution acted as a mediator and moderator of dialogue between the authorities and the opposition. The episcopacy kept rejecting subsequent proposals of the government party to reform the system without involving activists of the delegalized “Solidarity” Movement. The involvement of the Roman Catholic hierarchy was hugely important for initiating the “Round Table” talks and during the parliamentary elections of June 1989 when its support turned out to be of key significance for the victory of the Civic Committee and for the defeat of the government party. At that time, the episcopacy also recorded unprecedented successes in the relations between the state and the Church, the regulation of its legal status as well as the Holy See and the People’s Republic of Poland entering into diplomatic relations. It achieved both on its own terms by leveraging its superior negotiation power. The article discusses the approach of the highest hierarchy of the Roman Catholic Church in Poland toward the political situation during the last three years of the People’s Republic of Poland when the episcopacy served as a kind of “midwife” for the agreement between those in power and the opposition.

Po przedstawieniu definicji, przedmiotu i stron sporu zbiorowego, zostały omówione: istota i zasady rokowań, a następnie wszczęcie, przebieg i sposoby zakończenia rokowań w rozwiązywaniu sporów zbiorowych.

The paper is focused on migration as one of the major issues that determine relations, including accession negotiations, between the European Union and Turkey. In spite of the dominant anti-Turkish discourse across the EU, the Author points out several historical and current phenomena that have resulted in building a complex migration system between the two geographical areas. The migration flows within the migration system are shown to have occurred in both directions. Both advantages and disadvantages of the flows are selectively discussed. Finally, based on demographic forecasts, economic prognoses and current migration statistics in Europe, the paper hypothesizes that in the future the much feared inflows of the Turks to the EU might be balanced, if not surpassed, by outflows of both the former Turkish immigrants and “native” Europeans from Europe to Turkey.

The article presents the political situation in Poland after the 2005 Polish parliamen-tary elections and describes key points of the political program of Law and Justice, which was titled “Czwarta Rzeczpospolita”. The elections in 2005 were won by Law and Justice, a conservative party, who were led by Jarosław Kaczyński. Civic Platform occupied second place. Both parties wanted to cooperate in creating a majority coalition in the lower House of Parliament but the victory of Law and Justice and the troubled negotiations along with the triumph of Lech Kaczyński in the presidential election brought an end to the collaboration between these parties. The victorious party had to look for a partners to govern among the remaining parties. Eventually, the chiefs of Law and Justice decided to sign a stabilization pact with League of Polish Families and Self Defense Party. The agreement, signed in February 2006, did not bring about an end to the crisis of politics in Poland, therefore political leaders decided to announce an early election in 2007.

Konflikt bliskowschodni pozostaje jedną z najważniejszych kwestii w stosunkach międzynarodowych po II wojnie światowej. Jednąz najważniejszych wyzwańjest określenie czy bliskowschodni proces pokojowy jest związany z szeroko pojmowanym konfliktem bliskowschodnim czy też, ujmując rzecz precyzyjniej, z konfliktem arabsko-izraelskim. W kontekście kontroli nad terytorium można wyróżnić dwa możliwe scenariusze. Po pierwsze, Palestyńczycy żyjący pod zarządem izraelskim. Po drugie, rozwiązanie na bazie utworzenia dwóch niepodległych państw, czyli uznanie państwa Izrael przez wszystkie państwa arabskie w zamian za zgodę na utworzenie państwa palestyńskiego. Dotychczas przedstawiono wiele planów uregulowania tego problemu, na przykład, podczas negocjacji pokojowych w Oslo, spotkania w Tabie w 2001 roku czy też konferencji w Annapolis w 2007. Jednak żaden z nich nie doprowadził do przyjęcia całościowego rozwiązania konfliktu. Pojawia się pytanie czy społeczność międzynarodowa będzie musiała pogodzić się z kolejnym impasem w ramach bliskowschodniego procesu pokojowego. A może tak zwane arabskie przebudzenie, czyli trwające procesy zmian społeczno- politycznych w państwach arabskich, doprowadzą do zmiany sytuacji w regionie i umożliwią zawarcie porozumienia?

The Middle East conflict has remained one of the core issues of contemporary intemational relations sińce World War II. One of the most important matters is to define whether the Middle East peace process is related to the Middle East conflict or, more precisely, to the Arab-Israeli conflict. With respect to land, there are two possible scenarios. Firstly, Palestinians living under Israeli administration. Secondly, a two-state solution, namely an official recognition of the state of Israel by all Arab states and the foundation of a Palestinian state. So far, there have been dozens of peace plans, for example, the Oslo Peace Process, the Taba talks of 2001, the Road Map of 2003, and the Annapolis Conference of 2007. None of them resulted in a comprehensive solution. The ąuestion is, if the intemational community will face another stalemate in case of the Middle East peace process. Might the so-called Arab awakening, namely all the ongoing political and social processes in the Arab states, change the situation in the region?

The European Union is a key and active player in the WTO Doha Development Round. These negotiations on agriculture, access to markets for industrial goods and investments are particularly difficult and time-consuming. The aim of this paper is to analyze the European Union’s negotiating position in these selected areas. In order to achieve the goal of the paper, a thesis has been assumed regarding the defensive nature of the EU’s proposal in the field of agricultural negotiations, while taking an offensive negotiating position in the field of access to markets for industrial goods.

Unia Europejska jest bardzo aktywnym uczestnikiem negocjacji w ramach Rundy Rozwoju WTO. Negocjacje w sprawie rolnictwa, dostępu do rynków dla towarów przemysłowych, inwestycji są szczególnie trudne i czasochłonne. Celem pracy była analiza pozycji negocjacyjnej Unii Europejskiej w wybranych obszarach. W pracy przyjęto tezę o defensywnym charakterze propozycji UE w zakresie negocjacji rolnych i ofensywnej propozycji negocjacyjnej w zakresie dostępu do rynków dla towarów przemysłowych.

The presented article is aimed at reflecting usage of mediation as a form of international conflicts settlement and at revealing its factors, at the example of the case of conflict in Abkhazia, Georgia. The article is a hypothesis on to what extend international or regional organizations act as effective mediators during mediation process. Attempt of conflict regulation and work of the mediation platform created after Russian-Georgian war are discussed. The theory discussing main variables for evaluating international mediation represented in mediation literature have been used for evaluating mediation factors. The article shows the level of mediation effectiveness in international conflicts, when it is not clear which are the conflicting sides; it shows that when there is an influential country, considering its capabilities, it has enough power to act as effective mediator, only in case if it does not have direct interest in the conflict. We have concluded that mediation can be effective only when it is clear which the conflicting sides are. It is considered that international organizations cannot be effective in conflict resolution when a conflict is in cold phase.

Wiele problemów politycznych, społecznych i gospodarczych jest rozwiązywanych drogą negocjacji. Pojawiło się wiele publikacji opisujących zasady przygotowywania i skutecznego prowadzenia negocjacji. Celem niniejszego opracowania jest identyfikacja i strukturalizacja sytuacji negocjacyjnych związanych z zarządzaniem nieruchomościami komercyjnymi. Analiza procesu zarządzania nieruchomościami komercyjnymi w systemie zleceniowym pozwoliła wskazać trzy zasadnicze grupy problemów, rozwiązywane przy pomocy negocjacji. Należą do nich zawieranie umowy o zarządzanie nieruchomością pomiędzy właścicielem a firmą zarządzającą, zawieranie umowy najmu pomiędzy zarządzającym nieruchomością a najemcami oraz umów na dostawę materiałów i usług pomiędzy zarządzającym nieruchomością a firmami świadczącymi te usługi. W opracowaniu wskazano ogólne zasady właściwego rozwiązywania tych problemów oraz ich znaczenie w efektywnym zarządzaniu nieruchomościami komercyjnymi.

A lot of political, social and economic problems are solved by negotiations. There are numerous publications describing the principles of preparing and conducting negotiations effectively. The aim of this paper is identification and structuring of negotiation situations related to commercial real estate management. An analysis of the commercial real estate management process in the order-based system enabled to indicate three fundamental groups of problems solved by negotiations. They include the conclusion of real estate management contract between the owner and the property management firm, the conclusion of lease agreement between the real estate manager and tenants, and material and service delivery contracts between the real estate manager and firms providing such services. The study indicates general principles of proper solution of such problems and their significance in the effective commercial real estate management.
