W artykule scharakteryzowano genezę i znaczenie pojęcia neutralności sieciowej w odniesieniu do infrastruktury teleinformatycznej, w tym szczególnie sieci Internet. Na przykładzie praktyk rynkowych operatorów sieci oraz regulacji prawnych stosowanych w różnych krajach przedstawiono ewolucję zasady otwartej i neutralnej sieci oraz jej przyczyny i potencjalne skutki dla dalszego rozwoju sieci i świadczonych za jej pośrednictwem usług. W końcowej część artykułu przed-stawione zostały propozycje dotyczące prawnego usankcjonowania zasad dotyczących neutralności sieciowej na poziomie międzynarodowym i krajowym.

The article describes the origins and meaning of the concept of net neutrality in relation to ICT infrastructure, especially the Internet. The evolution of open and neutral network and its foundations and consequences for the development of the network and the services provided are presented on the example of market practices of network operators and regulations applicable in the various countries. The final part of the article presents proposals relating to the determination of the rules on net neutrality at the international and national levels.

Network neutrality has accelerated the wide spreading and adaptation of the Internet as a mass medium giving rise to the diversity which characterizes the Internet today. The expansion of existing networks in the course of development of next-generation broadband technologies has initiated a discussion beginning in 2005 and originating in the U.S., which challenges network neutrality as a universal interconnectivity paradigm for IP-based networks. This, in turn, challenges the existing provision strategies of data-intensive multimedia services thus raising interrelated and pertinent regulatory questions. This article focuses on four areas of interest: the interplay of telecommunications and media regulation, commodification and public value orientation, freedom of access and power of disposal over proprietary services and network neutrality and potential for diversification in the telecommunications sector. It provides an economic analysis of changing paradigms in network neutrality and illustrates how these developments might affect regulatory issues for the provision of online content in the public sector broadcasting with a particular focus on Germany's market.

L’article explore le concept des obligations positives et négatives de l’État en matière de défense des droits humains, reconnu dans la littérature sur les droits humains et dans les arrêts de la Cour européenne des droits de l’homme. Le concept est ensuite appliqué pour montrer l’importance de garantir la liberté d’expression dans la réglementation des services d’accès à Internet et dans l’application des réglementations pertinentes dans les États membres de l’UE. L’auteur est d’avis que les arguments économiques ne doivent pas occulter la nécessité de garantir la liberté d’expression des utilisateurs finals des services d’accès à Internet.

The article explores the concept of the positive and negative obligations of the state in securing human rights, recognized in human rights literature, and in the judgments of the European Court of Human Rights. The concept is then applied to show the importance of securing freedom of expression in regulating Internet access services and enforcing pertinent regulations in EU Member States. The author is of the opinion that economic arguments should not overshadow the need to secure the freedom of expression of the end-users of Internet access services.
