The article describes the employers’ and non-employers’ obligations in occupational health and safety of non-employees. The author emphasizes that the health and safety at work is important not only towards people who are employed on the basis of the contract of employment but also on the basis of civil contracts. Regulations pertaining this matter are to fulfill the State’s obligations towards workers by the employer. The author’s conclusion is that the regulations of discussed matter regarding to people who are working on the basis of contract of employment and on the basis of civil contracts are unjust in some legal aspects.

Artykuł opisuje obowiązki pracodawców w sferze bezpieczeństwa i higieny pracy w stosunku do niepracowników. Autorka podkreśla, iż bezpieczeństwo i higiena pracy są ważne nie tylko w stosunku do osób zatrudnionych na podstawie stosunku pracy, ale także osób pracujących na podstawie zatrudnienia cywilnoprawnego. Opracowanie zamyka konkluzja, że regulacje dotyczące omawianej materii odnoszące się do osób zatrudnionych na podstawie stosunku pracy oraz umów cywilnoprawnych nie są w pewnych aspektach sprawiedliwe.
