Prawna ochrona praw i interesów skarbu państwa w Austrii swoimi korzeniami sięga XI wieku. Wykształcone wówczas instytucje odpowiedzialne za tę ochronę stały się podwaliną do współcześnie funkcjonujących w Europie, w tym i w Polsce, rozwiązań prawnych i instytucjonalnych prawnej ochrony interesów państwa. Obecnie istniejący urząd Finanzprokuratur funkcjonuje na podstawie ustawy z 2008 r. Na czele tego organu stoi prezes, wspierany w swojej działalności przez prezydium. Podstawowymi jednostkami organizacyjnymi Prokuratorii Skarbu są wyspecjalizowane departamenty. Zakres kompetencyjny tego organu obejmuje doradztwo prawne i zastępstwo procesowe organów państwa. Na wniosek jednak może wpierać również instytucje wykonujące funkcje publiczne lub dysponujące funduszami budżetowymi, jak np. fundacje.

Roots of legal protection of the rights and interests of the state treasury in Austria are dated back in the eleventh century. Institutions established then and responsible for this protection became a framework for modern, operating nowadays in Europe, including Poland, legal and institutional instruments of protection of legal interests of the state. The existing currently Finanzprokuratur`s office operates under the act from 2008. At the head of this body stands the president, assisted in its operations by the bureau. The basic organizational units of the State Treasury Solicitor`s Office are specialized departments. The main competence of this office include legal counsel and representation of state bodies. At the request it may also support the institutions performing public functions or possessing budgetary funds, for example foundations.

Austria przyjęła scentralizowany model pomocy prawnej udzielanej organom federalnym oraz instytucjom wskazanym w ustawie o Prokuratorii z 2008 r. Zakres kompetencji tego organu jest dość szeroki. Podstawową zasadą jest, że Prokuratoria występuje zawsze tam, gdzie jest interes publiczny, a zatem nie tylko podejmuje się prawno-cywilnej obrony organów federalnych, ale również stowarzyszeń i funduszy publicznych, a nawet landów czy gmin. Prokuratoria zajmuje się zastępstwem procesowym, przygotowuje opinie prawne i legislacyjne, a także uczestniczy w zawieraniu ugód czy prowadzeniu mediacji. Podstawę prawną do podjęcia działania przez Prokuratorię stanowi umowa zlecenia. Adwokaci Prokuratorii stanowią najważniejszą grupę pracowników tego urzędu. Ze względu na wysokie kwalifikacje, cieszą się oni dużym szacunkiem wśród zawodów prawniczych. Aplikacja adwokacka trwa osiem lat, a aplikant musi zdać egzamin adwokaci i wewnętrzny prokuratoryjny oraz odbyć trzyletnią praktykę.

Austria has adopted a centralized model of the legal assistance provided to the federal authorities and institutions specified in the Act on Office of State General Solicitors of 2008. The scope of competence of this body is quite broad. The basic principle is that the Office of State General Solicitors is present in any case where there is a public interest, and therefore the Office does not only take the legal and civil defence of federal agencies, but also of the associations and the public funds, and even the federal states or municipalities. The Office of State General Solicitors deals with legal representation, prepares legal and legislative opinions and participates in settlements or mediation. The legal basis to take action by the Office of State General Solicitors is a the service contract. Attorneys of the Office of State General Solicitors are the most important group of employees of this office. Due to their high qualifications, they enjoy great respect among the legal profession. The attorney application lasts eight years and the applicant must pass the attorney exam and the internal office exam and take a three-year practice.
