Ustawodawca ustawą nowelizującą z dnia 11 stycznia 2018 roku o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych ustanowił w dodanym art. 28aa ustawy o samorządzie gminnym nowy tryb inicjowania przez radę gminy referendum w sprawie odwołania wójta z powodu nieudzielenia mu w dwóch kolejnych latach wotum zaufania. W niniejszym opracowaniu autorka poddaje analizie skutki tak przeprowadzonego (ważnego) referendum w kontekście art. 67 ustawy o referendum lokalnym. Legislator bowiem, wprowadzając nowe rozwiązania na gruncie ustawy o samorządzie gminnym, nie dokonał żadnych zmian w ustawie o referendum lokalnym, co budzi pewne wątpliwości w zakresie skutków, jakie referendum takie wywołuje.

The legislator amended the act of January 11, 2018 on the amendment of certain acts to increase the participation of citizens in the process of selecting, functioning and controlling certain public bodies in the added art. 28aa of the Local Government act, a new procedure for the commune council to initiate a referendum on the appeal of the commune head due to failure to grant him confidence in two subsequent years. In this study the author analyzes the effects of the (valid) referendum carried out in the context of art. 67 of the act on the local referendum. Legislator, by introducing new solutions under the Local Government act, did not make any changes to the act on the local referendum, which raises some doubts as to the effects of such a referendum.

Odwołanie wójta w drodze referendum stanowi w myśl art. 492 § 1 pkt 8 Kodeksu wyborczego przesłankę wygaśnięcia mandatu wójta. W odniesieniu do tej przesłanki (w przeciwieństwie do wielu innych) prawodawca nie wymaga już podjęcia odpowiedniego aktu potwierdzającego zaistniały już skutek prawny. W związku z tym wydaje się, że mandat wójta powinien wygasnąć z mocy prawa z chwilą samego odwołania, z możliwością natychmiastowego powoływania się na tę okoliczność. Tymczasem w art. 67 ust. 2 ustawy o referendum lokalnym prawodawca wskazuje, że dopiero ogłoszenie, w trybie art. 63 ust. 2, wyników referendum przeprowadzonego na wniosek mieszkańców, rozstrzygających o odwołaniu organów gminy (czyli m.in. wójta) przed upływem kadencji, oznacza zakończenie działalności tych organów. Autorka w niniejszym opracowaniu poddaje wnikliwej analizie kwestie związane z ustaleniem tego, w którym rzeczywiście momencie dochodzi do tego wygaśnięcia. Niestety, nieprecyzyjne i zawierające luki prawne przepisy powodują, iż w tej sprawie prezentowane są w literaturze skrajnie odmienne stanowiska.

Dismissing a borough leader by means of referendum is a prerequisite for the expiry of a borough leader’s mandate in accordance with article 492 § 1 point 8 of the Elections Code. As regards this prerequisite (contrary to many others) the legislator does not require any appropriate act to be adopted confirming legal consequences that has already arisen. This being the case it seems that a borough leader’s mandate should expire by force of law upon the dismissal itself with the possibility to cite the circumstances immediately. Meanwhile, in article 67 paragraph 2 of the act on local referendum the legislator points out it is only the announcement of the results of the referendum held upon the request of inhabitants, under article 63 paragraph 2, decisive on the dismissal of administrative district bodies (that is, among others a borough leader) before the end of the term of office, which means the termination of the activity of these bodies. In this study the author thoroughly analyses the issues connected with establishing at which moment in actual fact the expiry takes place. Unfortunately, imprecise and containing loopholes in the law provisions cause the situation in which extremely different opinions are presented in literature.
