The authors contemplate the practice and effectiveness of the rule by which the legislator set the amount of remuneration of a registered mediator at a court order at CZK 400 for each commenced hour. The authors of the paper have done a quantitative method where all enrolled mediators have been approached by an electronic questionnaire in order to obtain the data to find answers to questions: Is the rule of the mediator’s remuneration effective? Does it benefit the parties concerned? Is it motivating for the mediators themselves? What possible de lege ferenda proposals could increase the effectiveness of the Mediator Remuneration Rule? The authors are looking for answers to these questions and other questions by using the Law of Economic Analysis method.

Autoři se zamýšlejí nad praxí a efektivností pravidla, kterým zákonodárce stanovil výši odměny zapsaného mediátora při setkání nařízeném soudem na 400 Kč za každou započatou hodinu. Autoři příspěvku provedli sondáž kvantitativní metodou, kdy byli osloveni všichni zapsaní mediátoři elektronickým dotazníkem s cílem získat data pro hledání odpovědi na otázky: Je pravidlo o výši odměny mediátora efektivní? Přináší užitek sporným stranám? Je motivační pro samotné mediátory? Jaké případné návrhy de lege ferenda by mohly zvýšit efektivnost pravidla o výši odměny mediátora? Na tyto a další otázky se pokouší v příspěvku odpovědět za použití metody ekonomické analýzy práva.
