Celem artykułu jest ukazanie istoty kontroli podatkowej przeprowadzanej przez organy podatkowe w oparciu o ogólne zasady postępowania podatkowego uregulowane w przepi-sach ustawy z dnia 29 sierpnia 1997 r. Ordynacja podatkowa (tekst jednolity Dz.U. z 2015 r. poz. 613 ze zm.). W artykule zwrócono szczególną uwagę na znaczenie zasad ogólnych postępowania podatkowego w kontroli podatkowej przeprowadzanej przez organy podatkowe.
The goal of the article is to characterize the estimation of the tax base in polish tax law and to present actual problems relating to its application by the tax authorities. The author indicates shortcomings of the legal regulations and the direction of the proposed changes.

W artykule scharakteryzowano instytucje szacowania podstawy opodatkowania, określono przesłanki jej zastosowania, metody szacunkowego określania podstawy opodatkowania, którymi posługują się organy podatkowe oraz ich obowiązki w procesie szacowania. Autorka wskazuje na niedostateczną regulację prawną w omawianym zakresie oraz opisuje praktyczne problemy związane z funkcjonowaniem instytucji.
In Poland, for many years, administrative courts have adjudicated, among others, in tax cases using the in dubio pro tributario principle (the principle of the benefit of the doubt). This principle was not expressis verbis stated in the Polish legal norms. As of 1 January 2016, the legislator introduced in Article 2a of the Tax Ordinance a regulation that "doubts about the content of the tax law that cannot be removed shall be resolved in favour of the taxpayer". Since this rule became binding, questions have appeared as to how such a rule, formulated in this way, should be applied by tax and fiscal control authorities. The aim of this article is to discuss the application of this rule in practice, referring to the decisions of courts. The Author formulates conclusions resulting from the caselaw of courts and indicates at the same time the need to make changes to the provision of Article 2a of the Tax Ordinance. Therefore, de lege ferenda, he suggests changing the provision of Art. 2a of the Tax Ordinance as soon as possible and proposes a broader phrase that "all persons in any way obliged to bear tax burden shall have the right to resolve doubts in their favour".

W Polsce sądy administracyjne od wielu lat orzekają m.in. w sprawach podatkowych, stosując zasadę in dubio pro tributario (w razie wątpliwości na korzyść obywatela). Zasada ta nie była jednak expressis verbis zapisana w polskich unormowaniach prawnych. Ustawodawca od 1.01.2016 r., w art. 2a Ordynacji podatkowej wprowadził przepis, który stwierdza „Niedające się usunąć wątpliwości co do treści przepisów prawa podatkowego rozstrzyga się na korzyść podatnika”. Od początku obowiązywania tej reguły pojawiły się pytania, w jaki sposób tak sformułowaną zasadę mają stosować organy podatkowe oraz organy kontroli skarbowej. Celem niniejszego artykułu jest omówienie stosowania tej reguły w praktyce, z przywołaniem orzecznictwa sądów. Autor, formułując wnioski wypływające z orzecznictwa sądowego, jednocześnie wskazuje na potrzebę dokonania zmiany przepisu art. 2a Ordynacji podatkowej. Dlatego też de lege ferenda postuluje jak najszybszą zmianę przepisu art. 2a o.p. ze wskazaniem na szeroką formułę, że „wszyscy w jakikolwiek sposób zobowiązani do ponoszenia ciężarów podatkowych mają prawo do rozstrzygania wątpliwości na ich korzyść”.
Artykuł podejmuje problematykę opodatkowania kryptowalut. W niniejszym opracowaniu zaprezentowano rozwój kryptowalut i prawodawstwa polskiego w tej materii. Przede wszystkim przedstawiono tematykę ujęcia kryptowalut z punktu widzenia przedmiotu opodatkowania w ustawach podatkowych. Ponadto przywołane zostały interpretacje podatkowe, w których można zaobserwować różne sposoby ujęcia problematyki opodatkowania kryptowalut przez urzędy skarbowe. W dalszej części opracowania zaprezentowano najnowsze zmiany ustawy o PIT, wchodzące w życie od 1 stycznia 2019 roku oraz ich potencjalne konsekwencje dla podatników.

The article delves into the issue of cryptocurrencies taxation. This work explains the development of cryptocurrencies as well as the Polish law concerning that problem. What is also presented is the perception of cryptocurrencies in view of the subject of taxation in Polish tax regulations. Furthermore, the article refers to the tax rulings in which several different ways of perceiving cryptocurrencies taxation by tax authorities are included. The work also examines the changes in Personal Income Tax in Poland from 1 January 2019 and their potential consequences for taxpayers.
Taxation is not only associated with complex legal problems but also with ethical ones which become apparent in the process of applying legal regulations. When the rigorous application of the letter of the law ignores the social context taxation law degenerates into its opposite. In such situations, owing to malicious legal explanations (Cicero), a vital role is played by the judges of the administrative courts. Protection against the unlawful actions of tax institutions derives from the great interpretative knowledge of the judges, their inquisitiveness and insight, their moral sensitivity to legal issues as well as the soundness of the control processes of the courts. The problem arises here of the relationship between ethical norms which derive from axiological values and legal norms. This relationship can be defined as follows: legal norms ought to have axiological legitimacy but ethical norms do not require judicial legitimacy. This means that undisputedaxiological values (such as good, dignity, justice, equality, freedom) are valid independently of the legal conventions of law making applying at a given time. They are always incorporated into the legal system of a state. Positive law is a consequence of a compromise between the political and social forces which play an important and vital role in public life. This is why positive law cannot be a full reflection of universal axiological values. This explains why there are differences of scope between the legal system in force and the system of ethical norms which derive from universal axiological values.

Z opodatkowaniem wiążą się nie tylko złożone problemy prawne, lecz także etyczne. Uwidaczniają się one w procesie stosowania przepisów prawa. Zdarza się, że prawo podatkowe przeradza się w swoje przeciwieństwo, gdy rygoryzm w wykonywaniu litery prawa przestaje się liczyć z kontekstem społecznym. Właśnie wtedy, z uwagi na złośliwe tłumaczenie prawa (Cyceron), szczególna rola przypada sędziom sądu administracyjnego. Ochrona przed bezprawnym działaniem organów podatkowych wynika z wysokiej wiedzy interpretacyjnej sędziów, sędziowskiej dociekliwości i wnikliwości, moralnej wrażliwości sędziów na prawo, solidności kontroli instancyjnej. Pojawia się też problem relacji norm etycznych wywodzących się z wartości aksjologicznych do norm prawnych. Te relacje są następujące: normy prawne powinny posiadać legitymację aksjologiczną, natomiast normy etyczne legitymacji jurydycznej nie potrzebują. A to oznacza, że niesporne wartości aksjologiczne (dobro, godność, sprawiedliwość, równość, wolność) obowiązują niezależnie od umownie przyjętych w danym czasie konwencji stanowienia prawa. Zawsze więc stają się częścią systemu prawa w państwie. Prawo pozytywne jest wynikiem kompromisu sił politycznych i sił społecznych, które w życiu publicznym odgrywają istotną, ważną rolę. Dlatego też prawo pozytywne nie może być pełnym odbiciem uniwersalnych wartości aksjologicznych. I stąd właśnie pochodzą różnice zakresów pomiędzy obowiązującym systemem prawa a systemem norm etycznych wynikających z uniwersalnych wartości aksjologicznych.
