Celem niniejszego opracowania jest wyjaśnienie, czy osoby zatrudnione u komornika sądowego mogą zostać uznane przez organ rentowy za osoby współpracujące w rozumieniu art. 8 ust. 11 ustawy z 13 października 1998 r. o systemie ubezpieczeń społecznych. W opracowaniu autorka omawia status prawny komornika sądowego oraz status prawny osób zatrudnianych u komornika. Kolejno wyjaśnia zagadnienie osoby współpracującej w rozumieniu ustawy o systemie ubezpieczeń społecznych. W końcowej części opracowania autorka odnosi się do kwestii osób współpracujących z komornikiem w kontekście przepisów ustawy o systemie ubezpieczeń społecznych oraz ustawy o komornikach sądowych. We wnioskach końcowych ustosunkowuje się do wątpliwości, której wyjaśnienie stanowiło cel opracowania.

The purpose of this study is to clarify whether persons employed by a court bailiff can be recognized by the Polish social security organ as cooperating persons within the meaning of art. 8 section 11 of the Act of October 13, 1998 on the social insurance system. In order to clarify the above issue, the author discusses the legal status of a court bailiff and the legal status of those employed by the bailiff . Subsequently, he explains the issue of a person cooperating within the letter of the Act on the social insurance system. In the final part of the study, the author refers to the issue of collaborating person under the provisions of the Act on the Social Insurance System and the Act on court bailiffs. In the final applications, there is indicated whether those employed may be considered by the national insurance organ to be cooperating persons within the meaning of art. 8 section 11 of the Act of October 13, 1998 on the social insurance system.

Employed family members do not constitute a category of persons assisting as employees. They constitute a separate category of insured persons as assisting persons. In order to qualify for this category of insured persons, they must meet several prerequisites. First of all, basic qualifying criteria for a group of employees must be met. Such persons must also remain in the same household as a person conducting non-agricultural business. This prerequisite is not very well specified and raises a lot of controversy, it will be individually considered in each case. It does not apply to minors signing an employment contract for vocational training as in such a situation, the minor has the status of an employee and not an assisting person. Therefore, the employment of family members is not of a uniform nature and is subject to separate regulations.

Zatrudnieni członkowie rodziny nie stanowią kategorii osób współpracujących jako pracownicy, tylko odrębną kategorię ubezpieczonych jako osoby współpracujące. Aby zostać zaliczonym do tej kategorii ubezpieczonych, trzeba spełniać kilka przesłanek. Po pierwsze, należy spełniać podstawowe kryteria kwalifikujące do grupy pracowników. Po drugie, pozostawać we wspólnym gospodarstwie domowym z osobą prowadzącą pozarolniczą działalność gospodarczą. Przesłanka ta jest niedookreślona i budzi wiele kontrowersji, w każdym przypadku będzie indywidualnie rozpatrywana. Nie ma ona zastosowania w sytuacji zawarcia z małoletnim umowy o pracę w celu przygotowania zawodowego, ponieważ w takiej sytuacji małoletni ma status pracownika, a nie osoby współpracującej. W związku z powyższym zatrudnienie członków rodziny nie ma charakteru jednolitego i podlega osobnym regulacjom.
