The main aim of the article is to contribute to the bourgeoning debate on semipresidentialism, its definition, and its characteristic features, with analysis of the empirical example of the Czech Republic, a country which, according to Elgie´s standard definition, shifted to semi-presidentialism in 2012. The author investigates whether and how Miloš Zeman, the first directly elected president of the Czech Republic, influences relations among the key political institutions in the direction of the model of a semi-presidential democracy. The paper sets out the working concept of semi-presidentialism first and, through the lenses of process tracing, analyses the goals and acts of Zeman after he entered office in January 2013. The case study of the Czech Republic sheds light not only on the recent development(s) in the Czech political system, but it can be seen as an interesting example of how strong political personalities are attempting to expand their influence on politics in a parliamentary democracy and what the possible limits of this effort are.
The Christian Socialists played an important role in Austria’s interwar party system. Their ambivalent attitude to parliamentary democracy was a reflection of a disaffected political culture. The party demanded the implementation of corporate elements in the political system. Repeated failures to create a government coalition with a stable majority in the National Council, fear of a loss of power to ever-more popular Nazis and the consequences of the Great Depression strengthened ideas within Christian Socialists for extra-parliamentary rule. In spring 1933, authoritative party representatives took advantage of unprecedented events in the National Council to begin the gradual elimination of parliamentary democracy. The passive attitude of the opposition and the essential indifference of the Austrian public helped the implementation of the authoritative changes.
W 1921 r. zwieńczona została budowa Rzeczypospolitej. Traktat ryski kończył zwycięską wojnę z Sowietami, sytuację wewnętrzną stabilizowała uchwalona konstytucja. Jednak do czasu nowych wyborów parlamentarnych Sejm „ustawą przechodnią” zadecydował, że będzie sprawował władzę w „dotychczasowym zakresie”, a Naczelnik Państwa zgodnie z Małą Konstytucją 1919 r. Tymczasem w warunkach pokojowych 1922 r. funkcjonowanie demokracji parlamentarnej pokazało ułomność systemu. Cała władza znajdowała się w rękach Sejmu, rozbitego politycznie, w którym ugrupowania centrolewicy i centroprawicy dysponowały identycznym zespołem złożonym z 216 posłów, podzielonych na liczne kluby rywalizujące ze sobą o wpływy. Nie istniała możliwość powołania rządu koalicyjnego, krajem sterowały więc gabinety pozaparlamentarne. Rola Naczelnika Państwa ograniczona została do wymiaru czysto reprezentacyjnego. System uniemożliwiał kreatywną działalność Józefa Piłsudskiego, musiał prowadzić do konfliktów, zakończonych w grudniu 1922 r. zabójstwem pierwszego prezydenta Gabriela Narutowicza. Rozwaga Piłsudskiego i innych polityków uchroniła kraj od kataklizmu. Demokracja polska wychodziła z przesilenia nadwerężona, chwilowo jednak zwycięska.
It is said that parliamentary democracy is in crisis. As a manifestation of the crisis is the dilemma concerning parliamentarian’s responsibility to the voters. The imperative mandate idea is a potential response to the problem. The author analyzes the pros and cons of this form of mandate and speculates how its regulation could look. Last but not least, an answer to the question: is the imperative mandate a proper solution in the contemporary constitutional system, especially if it is a better alternative than the regular one.

Spotyka się pogląd, że demokracja parlamentarna jest w kryzysie. Za jeden z tego kryzysu przejawów można uznać problem z odpowiedzialnością parlamentarzystów przed ich wyborcami. Odpowiedzią na to może być koncepcja mandatu imperatywnego. Autor rozważa w artykule zalety i wady takiego rozwiązania, spekulując również na temat tego, jak regulacja tegoż mandatu mogłaby wyglądać, a także podsumowując odpowiada z uzasadnieniem na pytanie, czy we współczesnych realiach jest to lepsza alternatywa wobec dominującej koncepcji mandatu wolnego.
The strength of the parliament in the political system is largely dependent on its profes- sionalism defined by the activity of its deputies. Polish MPs’ level of education is high, of- ten higher than the West European average. The aim of this paper is to find out whether candidates’ education is an electoral criterion, whether voters base their decisions on the prospective deputies’ qualifications and skills confirmed by university diplomas. The study the results of which I present below was carried out between December 2018 and February 2019 as part of the nationwide research project Political preferences. Attitudes – Identifica- tions – Behaviors. It was conducted with the application of the survey questionnaire method.

Siła parlamentu w systemie politycznym w znaczącym stopniu zależy od jego profesjonalizmu definiowanego działaniami podejmowanymi przez deputowanych. Poziom wykształcenia posłów w polskim parlamencie jest wysoki, niejednokrotnie wyższy od średniej na zachodzie. Celem artykułu jest próba odpowiedzi na pytanie czy wykształcenie kandydatów na posłów stanowi kryterium wyborcze, czy wyborcy podejmując decyzje wyborcze zwracają uwagę na kwali- fikacje i umiejętności kandydujących do parlamentu potwierdzone dyplomami uczelni wyż- szych. Badania, których wyniki prezentuję poniżej, zostały przeprowadzone w okresie gru- dzień 2018 – luty 2019 w ramach ogólnopolskiego projektu badawczego Preferencje polityczne. Postawy – Identyfikacje – Zachowania. Przeprowadzono je metodą kwestionariusza ankiety.
The article is prepared on the occasion of the jubilee of the Constitution of the Republic of Poland of 1921 which combined tradition with modernity, introducing the reborn Polish State to the group of democratic and law-abiding states. The aim of the study is to demonstrate how the Constitution came about, including, above all, the role of the Constitutional Questionnaire developed under the supervision of Michał Bobrzyński. The article shows that while the authors of subsequent draft constitutions differed in matters of the political system, the president and the local council, there was no dispute as regards the guarantees of judicial independence.

Celem opracowania jest pokazanie jak doszło do powstania Konstytucji, w tym nade wszystko roli Ankiety Konstytucyjnej, jak i tego jak wielkie nadzieje w niej pokładano.
У статті комплексно розглянуто розвиток парламентаризму в Чеській Республіці в умовах політичного транзиту, вказано на неоднозначність та складність процесу функціонування парламентської демократії в даній країні. Виділено основні етапи становлення чеських парламентських установ; встановлено ключові тенденції та особливості модернізації сучасного чеського парламентаризму; окреслено конституційно-правовий статус Парламенту ЧР та визначено його місце в існуючій системі стримувань та противаг; з’ясовано специфіку партійної структуризації чеського Парламенту та виявлено найважливіші чинники формування коаліційного потенціалу парламентських фракцій; Підтверджено гіпотезу про те, що у тих посткомуністичних країнах, де перехід до демократії мав еволюційний (Польща, Угорщина) або змішаний характер (Чехія, Словаччина), процес інституційного дизайну та формування громадянського суспільства і правової держави має відносно послідовний характер і більш виразні тенденції до стабілізації демократичного політичного режиму. І навпаки – там, де транзитний процес мав революційний характер (Болгарія, Румунія), консолідація нової політичної системи характеризується високим ступенем невизначеності. Доведено, що формування в країнах Центрально-Східної Європи, і в Чехії зокрема, парламентських республік можна розглядати як одну з форм політичного транзиту, а парламентаризм – як певну сукупність політико-правових гарантій від «скочування» до недемократичних політичних режимів. Здійснено періодизацію чеських представницьких установ, яка корелюється з історичними етапами розвитку чеської держави. Відповідно виділено досоціалістичний, соціалістичний та постсоціалістичний період. Запропоновано посилити контрольну функцію Парламенту ЧР через визначення на законодавчому рівні індивідуальної політичної відповідальності членів уряду перед коаліційною більшістю. Визначено ключові чинники, що здійснюють вплив на партійну структуризацію чеського Парламенту і сприяють формуванню коаліційного потенціалу парламентських фракцій в Чеській Республіці. Встановлена тісна взаємообумовленість форми державного правління, типу виборчої системи та стану розвитку політичних партій. Доведено, що стабільне функціонування парламентської демократії в ЧР визначається відносною стійкістю партійно-політичної системи і насамперед високим коаліційним потенціалом політичних партій, позитивний ефект від яких найбільш чітко проявляється при виході з парламентських і урядових криз. Аргументовано, що ефективність парламентаризму та урядова стабільність в чеському соціумі зростає у випадках спаду показників індексів ефективного числа парламентських партій, фракціоналізації партійних систем, електоральної нестійкості та диспропорційності.

For the first time in the Ukrainian political science, considers the development of parliamentarism in the Czech Republic in a context of political transit in a comprehensive manner. It indicates the ambiguity and complexity of the process of parliamentary democracy’s functioning in the country. The main stages of the Czech parliamentary institutions’ establishment have been identified. The key tendencies and the peculiarities of the current Czech parliamentarism modernisation have been defined. The constitutional and legal status of the Parliament of the Czech Republic has been outlined and its place in the existing checks and balances system determined; the Czech Parliament party structuring characteristics have been determined and the most important factors of the coalition formation potential of parliamentary fractions have been revealed; based on the empirical indicators, the party system’s stability and efficiency in the Czech Republic have been investigated. The fundamental principles of the liberal parliamentarism concept (Ch.L.Montesquieu, John Locke, John Mill) have served as the theoretical and methodological basis for these article, which considers the power division to be the main principle of the state system, in which the executive power is accountable and subject to the legislative power. In order to achieve the tasks, the author used general scientific methods (analysis, synthesis, induction, deduction) as well as special politilogical methods. The methods of induction and deduction have been used in formulating the concept of “political transit” and its constituent elements. The comparativehistorical method gave the defender of the thesis the opportunity to understand the main directions of parliamentary institutions’ development at different historical stages of the Czech statehood and identify the factors that influenced the change in their status. The system method allowed to assess the constitutional and legal status of the Parliament of the Czech Republic, primarily its place and role in the political system of society and the relationship with other bodies of state power. On the whole, we can assume that the experience of the parliamentarism functioning in the Czech Republic is of great practical significance for Ukraine and other post-communist states, since it gives a stimulus to the society and ruling elites of these countries to further improve and develop their political institutions.
