Niniejszy artykuł przybliża problematykę związaną z uprawnieniami procesowymi Agencji Bezpieczeństwa Wewnętrznego. W pierwszej części artykułu dokonano rozważań prawnych nad uprawnieniami procesowymi wynikającymi bezpośrednio z ustawy o ABW oraz AW. Potrzeba wprowadzenia zmian ustawowych w tym zakresie wynikała z orzeczeń Trybunału Konstytucyjnego. W drugiej części zwrócono uwagę na dyskusję o modelu funkcjonowania służb specjalnych, trwającą od lat w przestrzeni publicznej. Na podstawie literatury przedmiotu, materiałów sejmowych, materiałów prasowych i danych przytaczanych w mediach zaprezentowano poglądy i argumenty będące podstawą wniosków dotyczących zasadności i słuszności odebrania lub pozostawienia Urzędowi Ochrony Państwa (a później Agencji Bezpieczeństwa Wewnętrznego) uprawnień procesowych.

This article introduces the readers to the issues related to the procedural rights of the Internal Security Agency. In the first part of the article, there were legal considerations made regarding procedural rights directly resulting from the Act on the Internal Security Agency and the Intelligence Agency. The need for statutory changes stemmed from the decisions of the Constitutional Tribunal. The second part draws attention to the discussion on the secret services shaping model that has lasted in the public space for years. On the basis of the subject literature, parliamentary materials, press materials and data cited in the media, in the article there are views and arguments presented which are the basis for conclusions regarding the justification and legitimacy of taking away or leaving the State Protection Office (and later – the Internal Security Agency) with procedural rights.
