Prawne i ekonomiczne uwarunkowania opóźnień płatniczych w transakcjach handlowych przedsiębiorstw w Polsce

Celem artykułu była analiza uwarunkowań ekonomiczno-prawnych w Polsce w zakresie zjawiska opóźnień w płatnościach w transakcjach handlowych. W aspekcie ekonomicznym przedmiotem analizy były takie czynniki jak zróżnicowanie struktury i cykli należności przedsiębiorstw, terminy płatności, skala strat z tytułu opóźnienia płatności oraz przyczyny opóźnienia płatności. W analizie uwarunkowań ekonomicznych wykorzystano dane z raportów międzynarodowych wywiadowni gospodarczych Intrum Justitia oraz Atradius. Dane te wskazują, że wiarygodność płatnicza podmiotów w Polsce, mierzona tzw. indeksem płatniczym, jest niska i nadal pogarsza się. W zakresie uwarunkowań prawnych dotyczących opóźnień w płatnościach skupiono się w szczególności na treści krajowej ustawy z 2013 roku o terminach zapłaty w transakcjach handlowych i przedstawiono analizę ewolucyjną proponowanych środków prawnych mających za zadanie ochronę wierzyciela przed negatywnymi skutkami zatorów płatniczych.

The principal aim of the article is to analyze both economic and legal conditionings of late payments in commercial transactions in Poland. Regarding economic conditionings, the research focuses mainly on such issues as diversification of the enterprises’ receivables’ structure and cycles, payment periods, levels of losses caused by late payments and reasons of analyzed phenomenon. The data coming from reports of two international credit management and insurer companies – Intrum Justitia and Atriadus – should be considered as the direct basis of presented economic. The data proves that the payment credibility of Polish enterprises, estimated with use of the so-called Payment Index, is low and deteriorating. The legal analysis of late payments in Poland focuses mainly on the Act on late payments in commercial transactions of 2013 and is based on evolutionary research of proposed regulations designed to protect creditors from adverse effects of payments lags.
