Spółdzielnia socjalna jest podmiotem ekonomii społecznej, a jej działalność skupia się bardziej na celach społecznych niż ekonomicznych. Przeważającym celem działalności spółdzielni socjalnej jest integracja społeczna i zawodowa osób zagrożonych wykluczeniem społecznym. Spółdzielnie socjalne posiadając potencjał ekonomiczny w różnym stopniu wykorzystują to w działalności gospodarczej. Zarządzający spółdzielnią socjalną często napotykają trudności w funkcjonowaniu na otwartym i konkurencyjnym rynku. Ze względu na przeważnie słabą kondycję finansową borykają się z wieloma ograniczeniami w obrocie gospodarczym. Rezultaty działalności spółdzielni socjalnej w większej mierze mają charakter jakościowy i trudno jest ocenić ich efektywność w wymiarze finansowym, stąd też często pojawiają się problemy we współpracy z instytucjami finansowymi. Poza problemami natury ekonomicznej istnieje również wiele negatywnych postaw społecznych, które czasami hamują rozwój spółdzielni socjalnej. Jednakże wymienione bariery w prowadzeniu działalności spółdzielni socjalnej nie wstrzymują ich w powstawaniu i rozwoju z uwagi na niewątpliwie ważny udział w rozwiązywaniu problemów społecznych w Polsce.

The social cooperative is an entity of the social economy, which means that its main activities focus more on reaching social rather than economic goals. The main goal of the social cooperative is the social and professional development and integration of people who are at risk of being excluded from them main stream of the society. Social cooperatives use their economic potential in varying degree in business. Managers of the social coops often find it difficult to operate in the open and competitive market economy because the coops’ fragile financial condition. Coops weak financial conditions create numerous limitations and obstacles that are difficult to overcome. In most cases, the effectiveness of the coops are measured in the quality of the social services they provide rather than their financial bottom line. Therefore, they do have problems when working with the financial institutions. In addition to financial and economic issues, the coops have to manage numerous negative stereotypes that slow down their development. However, the obstacles that have been mentioned have not stopped the creation of the new social coops and the development of the existing one. They do play very important and unquestionable role in solving difficult social problems in Poland.

In this article the scope of regulations of the Act of 5 August 2022 on social economy ( Journal of Laws of 2022, item 1812) will be brought closer, including an in-depth discussion of the statutory concept of a social enterprise, which is a point of reference for all statutory provisions. The article presents also a subjective assessment of particular provisions, based on the author’s experience in the field of social economy activities and his participation as a representative of the National Federation of Non-Governmental Organizations in the process of developing the final shape of the regulations. In addition, the text attempts to formulate recommendations for a possible amendment to the Act.

W niniejszym artykule przybliżono zakres regulacji Ustawy z dnia 5 sierpnia 2022 roku o ekonomii społecznej (Dz.U. z 2022 r. poz. 1812), szczegółowo omówiono także ustawowe pojęcie przedsiębiorstwa społecznego, stanowiącego punkt odniesienia dla całości ustawowych zapisów, oraz subiektywnie oceniono część przepisów, bazując na posiadanym przez autora doświadczeniu w zakresie działań w sferze ekonomii społecznej i jego udziale w procesie wypracowywania ostatecznego kształtu regulacji jako reprezentanta Ogólnopolskiej Federacji Organizacji Pozarządowych. Na zakończenie podjęto również próbę wskazania rekomendacji do ewentualnej nowelizacji ustawy.

The article presents the role of cooperatives in market economy and good practices of selected social cooperatives as entities that meet the characteristics of modern enterprises.

The article presents activities undertaken by the social economy sector for social and professional integration of people at risk of social exclusion in Western Pomerania. It presents the reintegration potential of ES entities in the region and indicates their activity in relation to the problem of social exclusion. Next, key issues defining the role of ES in West Pomerania are presented from the perspective of functioning centers and clubs for social integration, occupational therapy workshops and vocational activity workshops. The last part outlines the scope of cooperation between the ES sector and local government for social and professional reintegration. This text is an invitation to further discussions aimed at building public awareness of the role and importance of the idea of social solidarity economics at the dawn of the 21st century.

W artykule zaprezentowano działania podejmowane przez sektor ekonomii społecznej na rzecz integracji społecznej i zawodowej osób zagrożonych wykluczeniem społecznym na Pomorzu Zachodnim. Przedstawiono potencjał reintegracyjnych podmiotów ES w regionie oraz wskazano ich aktywność w odniesieniu do problemu wykluczenia społecznego. Następnie przybliżono kluczowe zagadnienia określające rolę ES w województwie zachodniopomorskim z perspektywy funkcjonujących centr i klubów integracji społecznej oraz warsztatów terapii zajęciowej i zakładów aktywności zawodowej. W ostatniej części nakreślono zakres współpracy sektora ES z samorządem lokalnym na rzecz reintegracji społecznej i zawodowej. Niniejszy tekst jest zaproszeniem do dalszych dyskusji, których celem jest budowanie świadomości społecznej na temat roli i znaczenia idei ekonomii solidarności społecznej u progu XXI wieku.
