Liliana Indan-Pykno aim in this paper is to present the issues concerning application of the institution of mediation in juvenile delinquency proceedings, and to examine the reasonability of actions taken by the legislator in this regard as well as accompanying doubts. Since the inclusion of the mediation institution in the Act on Juvenile Delinquency Proceedings, this regulation has had many supporters and opponents. Thus, the following question arose, Does mediation in juvenile delinquency proceedings really make sense? The literature emphasizes the positive impact of mediation upon shaping the behaviour of juveniles by making them aware of the harmfulness of their actions and the need to redress the damage through contact with the victim. On the other hand, critics emphasize a certain artificial character of mediation in such cases. Mediation may not correct educational mistakes made over many years; however, the fact that it raises doubts should not lead to a complete elimination of the institution of mediation in juvenile delinquency cases. Mediation should continue to apply to juvenile offenders who do not show a high level of demoralization or those whose cases are heard for the first time by family courts.

Celem artykułu jest przedstawienie zagadnień dotyczących stosowania instytucji mediacji w postępowaniach o wykroczenia nieletnich, omówienie zasadności działań podejmowanych przez ustawodawcę w tym zakresie i towarzyszących im wątpliwości. Od momentu wprowadzenia instytucji mediacji do ustawy Prawo o postępowaniu w sprawach nieletnich regulacja ta ma zarówno wielu zwolenników, jak i przeciwników. Rodzi się więc pytanie – czy mediacja w sprawach nieletnich sprawców przestępstw ma rzeczywiście sens? W literaturze podkreśla się pozytywny wpływ mediacji na kształtowanie zachowań nieletnich poprzez uświadomienie im w drodze kontaktu z ofiarą zakresu szkodliwości ich czynu i konieczności jego zadośćuczynienia. Krytyczne głosy akcentują natomiast pewną sztuczność mediacji w tego rodzaju sprawach. Nie jest możliwe naprawienie w wyniku mediacji błędów wychowawczych popełnionych na przestrzeni lat. Podnoszone wątpliwości nie wykluczają jednak całkowicie instytucji mediacji w sprawach nieletnich. Mediacja w dalszym ciągu powinna mieć zastosowanie do nieletnich sprawców, którzy nie wykazują się wysokim poziomem zdemoralizowania, lub do tych, którzy przed sądem rodzinnym stają po raz pierwszy.

The aim of the article is to present the results of the researches, the mainly the answer on the question how do juvenile courts realize in practice the assumptions of the Act on Proceeding in Juvenile Cases. Researches, in the application of law, have been considered particularly important because the law obliges the juvenile judges to collect information about juvenile and his/her environment – directly or indirectly (by supporting institutions).

Artykuł stanowi podsumowanie projektu badawczego zrealizowanego w Instytucie Nauk Prawnych Polskiej Akademii Nauk. W ramach projektu zostały przeprowadzone dwa rodzaje badań: 1) ogólnopolskie badania sondażowe skierowane do trzech grup respondentów – sędziów dla nieletnich, zawodowych kuratorów rodzinnych oraz specjalistów zatrudnionych w opiniodawczych zespołach sądowych specjalistów, 2) indywidualne półustrukturyzowane wywiady jakościowe z przedstawicielami tych trzech grup zawodowych. W artykule zostały zamieszczone tylko niektóre wyniki. Szczególna uwaga została poświęcona realizacji założeń Ustawy o postępowaniu w sprawach nieletnich w praktyce orzeczniczej sądu. Potrzebę badań w tym zakresie uzasadnia fakt ustawowego zobowiązania sędziego dla nieletnich do gromadzenia informacji o nieletnim i jego środowisku - bezpośrednio lub pośrednio przy wykorzystaniu instytucji pomocniczych.
The article relates to the analysis of responses to violence in the everyday life of a democratic society. The evolution of the juvenile criminal justice system serves here as a litmus paper of the today's neo-liberal European countries. The article critically evaluates the arguments of F. Bailleau and Y. Cartuyvels who present the development of contemporary juvenile justice in terms of neo-liberalism. They claim it is the main reason to answer the question of how long the child should be treated as a child? However, we are still left with the question of what to do with those young people who act like offenders who demand more severe punishment. In her paper, the author presents the possible model of social control that responds to violence using the F.H. McClintoc's model adopted and modified in the model presented by D. Black in Behaviour of Law. The author argues that selecting a criminal model from among different possible models of social control might be an influence of the neo-liberal policy, yet it is not necessary. The examination of different models currently present in the society should help to answer the question of whether the present policy results from the neo-liberal policy as F. Bailleau and Y. Cartuyvels suggest? Or is it rather due to what Zygmunt Bauman named as the penal effect of globalisation? The author examines how much of the present practice within the juvenile justice fits Jean Baudrillard's era of simulacra where we offlcially tend to fight crime and do good, but in practice, as Michel Foucault pointed long time ago, the goal is somewhat different and detached from both the perpetrator and the victim? The paper also looks at how accurate in this case the analysis of Pierre Bourdieu would be that we tend to accept the perceived reality as natural, for we do not have the proper procedure to see that other solutions are also possible? At the end the paper, the author suggests what elements should be included within juvenile justice system to free it of the simulacra syndrome.
