Prałatura personalna to instytucja utworzona przez Sobór Watykański II. Rewizja Kodeksu Prawa Kanonicznego zainicjowana przez Jana Pawła II, dała możliwość, aby problematyką tą zajęły się komisje kodyfikacyjne. Kodeks Pio-Benedyktyński nie przewidywał erygowania tego rodzaju bytów prawnych. Efektem ich prac są kan. 294-297 Kodeksu Prawa Kanonicznego z 1983 r. szczegółowo traktujące o tej kwestii. Analizie poddano cel erygowania prałatury personalnej, przepisy dotyczące zarządu i przynależności do prałatury, a także relacji z Kościołem powszechnym i Kościołami partykularnymi. Fundamentem rozważań były schematy Kodeksu Prawa Kanonicznego z 1977 r., 1980 r. oraz 1982 r. Prałatury personalne są to jednostki kościelne służące realizacji szczególnych zadań duszpasterskich, tworzone przez Stolicę Apostolską. Erygowanie prałatur personalnych stanowi wyraz troski Kościoła o zaradzenie potrzebom duchowym wiernych.

Personal prelature is an institution conceived during the sessions of the Second Vatican Council. It was basically created to allow for greater flexibility in meeting specific pastoral needs, later reaffirmed in the 1983 Code of Canon Law. Personal prelatures are set out in can. 294-297 of the 1983 Code of Canon Law although statutes define their purpose, relations with the local ordinaries etc. The purpose of this article is to analyze objectives of personal prelature, prelature’s statutes and government, lay involvement in a personal prelature and prelature’s relationships with Catholic Church and local ordinary. Personal prelatures are jurisdictional entities established by the Holy See within the hierarchical pastoral activity of the Church as an instrument for the performance of particular pastoral and missionary endeavors.
