This paper aims at explaining the concepts of collective memory, institutions, politics, law, as well as relations between them. By means of a short explanation of a network of mutual relations between these notions, we want to show how law and collective memories interact and how the relation between them is formed. At the same time, we see three modes of relations between collective memories and law: 1) past before the law, 2) memory laws and 3) law as collective memory. The first view consists in evaluating the past under a court trial. The second one in creating legal rules which promote or demand commemoration of a specific vision of the past. The third approach perceives law itself as institutionalized collective memory.

Artykuł ma na celu wyjaśnienie wzajemnych powiązań między koncepcjami pamięci zbiorowej, instytucji, polityki oraz prawa. Poprzez ukazanie sieci wzajemnych powiązań między tymi pojęciami chcemy pokazać, jak prawo i pamięć zbiorowa oddziałują na siebie. Jednocześnie widzimy trzy ujęcia relacji między pamięcią zbiorową a prawem, które możemy odpowiednio określić jako: 1) przeszłość przed prawem, 2) prawa pamięci 3) prawo jako pamięć zbiorowa. Pierwsze ujęcie polega na ocenie przeszłości w ramach procesu sądowego. Drugie polega na tworzeniu przepisów prawnych, które promują lub wymagają upamiętnienia określonego wydarzenia z przeszłości. Trzecie ujęcia polega na postrzeganiu samego prawa jako zinstytucjonalizowanej pamięci zbiorowej.
Celem niniejszego artykułu jest przedstawienie mechanizmów ochrony praw pamięci na gruncie strasburskiego systemu ochrony praw jednostki, opartego na literalnym brzmieniu europejskiej konwencji praw człowieka (EKPC), jak również praktyce orzeczniczej Europejskiego Trybunału Praw Człowieka (ETPC). Powyższa problematyka zostanie poddana analizie w oparciu o metodę dogmatyczno-prawną, sprowadzającą się do wykładni poszczególnych postanowień konwencji, jak również linii orzeczniczej ETPC. Podstawową hipotezą stawianą przez autorkę jest istnienie dwupoziomowego standardu ochrony przed negacjonizmem praw pamięci, w zależności od rodzaju zanegowanego prawa pamięci.

The objective of the article hereto is to present the mechanisms of the memory rights’ protection within the Strasbourg system, based upon the literal resonance of the European Convention of Human Rights and judicial practice of the European Court of Human Rights. Such topic will be subjected to analysis through the legal-dogmatic method which relies upon the construction of the concrete provisions of the Convention as well as jurisprudence of ECHR. The basic hypothesis of the author is the existence of the double standards of memory rights’ protection against negationism, depending from the type of denied memory right.
