The present study is dedicated to Rev. Prof. Henryk Misztal, who passed away on November 28, 2020. It aims to commemorate this distinguished scholar, engaged academic, tireless educator, and – moreover – a zealous priest and a good man. Prof. Misztal spent his entire academic career at John Paul II Catholic University of Lublin. For many years, he chaired the Department of Law on Religion and the Department of Canonization Law. He also carried a number of other important academic responsibilities, serving as vice-dean (1983–1987) and dean (1987–1989) of the Faculty of Canon Law at the Catholic University of Lublin. His research interests were in the areas of law on religion and canonization law. In both fields, he gained national and international recognition. His publications on law on religion especially highlighted the importance of religious freedom that is every person’s right, whereas as a canonization law expert, he became best known as the author of comprehensive monographs devoted to substantive and procedural law. Over the course of his research, he contributed over 500 different kinds of publications. Prof. Misztal was repeatedly awarded for his research achievements. He received the Knight’s Cross of the Order of Polonia Restituta (2000) and the Medal of the Commission of National Education (2006). In 2018, he was also honoured with the doctorate renewal ceremony at his University. On the Church forum, he was granted the title of Honorary Chaplain of His Holiness (1996). Prof. Misztal’s research activity was constantly inspired by his faith and was inextricably connected with living his priesthood. Only when we are aware of that can we properly understand not only his life choices, but also the deepest sources of the authority that he enjoyed.

Niniejsze opracowanie jest wspomnieniem o ks. prof. dr. hab. Henryku Misztalu, który zmarł w dniu 28 października 2020 r., a jego celem jest upamiętnienie tego wybitnego naukowca, zaangażowanego nauczyciela, niestrudzonego wychowawcy pracowników nauki, a nadto gorliwego kapłana i dobrego człowieka. Swą naukową aktywność Ksiądz Profesor ściśle związał z Katolickim Uniwersytetem Lubelskim Jana Pawła II. Przez lata kierował pracami Katedry Prawa Wyznaniowego (której był kierownikiem) oraz Katedry Prawa Kanonizacyjnego (której był kuratorem). Pełnił też szereg innych ważnych funkcji uniwersyteckich. Był m.in. prodziekanem (1983–1987) i dziekanem Wydziału Prawa Kanonicznego KUL (1987–1989). Badania prowadzone przez ks. prof. dr. hab. Henryka Misztala dotyczyły zagadnień z zakresu prawa wyznaniowego i prawa kanonizacyjnego. W obu tych zakresach wypracował sobie pozycję autorytetu uznawanego nie tylko w Polsce, ale i za jej granicami. W pracach dotyczących prawa wyznaniowego szczególnie akcentował znaczenie należnej każdemu wolności religijnej. Natomiast w zakresie prawa kanonizacyjnego zasłynął przede wszystkim jako Autor całościowych opracowań prawa materialnego i procedury. Owocem pracy badawczej Księdza Profesora jest ponad 500 różnego rodzaju publikacji. Znakiem docenienia Jego naukowych osiągnięć są przyznane Mu ordery i odznaczenia. Otrzymał m.in. Krzyż Kawalerski Orderu Odrodzenia Polski (2000) i Medal Komisji Edukacji Narodowej (2006). W 2018 r. został uhonorowany odnowieniem doktoratu przez macierzysty Uniwersytet. Na forum kościelnym obdarzono Go godnością kapelana honorowego Ojca Świętego Jana Pawła II (1996). Naukowa aktywność ks. prof. dr. hab. Henryka Misztala była stale inspirowana wiarą, pozostając nierozerwalnie związana z przeżywaniem kapłaństwa. Dopiero świadomość tego faktu pozwala właściwie zrozumieć nie tylko Jego życiowe wybory, ale i najgłębsze źródła autorytetu, którym się cieszył.

This article commemorates the life and writings of Rev. Prof. Henryk Misztal (1936–2020), a long-termemployee of the Faculty of Law, Canon Law and Administration, an eminent scholar of law on religion and canon law, a teacher and tutor of several generations of young people. The paper discusses his career path associated with The John Paul II Catholic University of Lublin, the formation and development of his research interests and finally his involvement in the various fields of research, teachings, and personal activities. Henryk Misztal was awarded his doctorate (degree of doktor nauk prawnych) in 1968, and his habilitation(the degree of doktor habilitowany nauk prawnych) in 1986 and the professor title in 1992. In the years of 1983–1987 he was the vice-dean of the Faculty of Canon Law and Legal Sciences and in 1987–1989 performed theduties of the dean of the Faculty. In 1996–1997 he was appointed the Head of the Section of Canon Law ofthe Faculty of Canon and Secular Law. Furthermore, Rev. Misztal was assigned as the head of the Departmentof Law on Religion for years 1980-2007 and as the Head of the Department of Canonization Law for 1984–2004.These two areas of interest dominated his research and organizational activity.The article presents the main Henryk Misztal’s fields of research, starting from the prior censorship of churchdocuments, through the canonization law, to the law on religion. It draws attention to the number and qualityof the impressive scale of his scientific achievements that consist of over 500 publications, out of which 42 constitutemonographs. The article also presents the involvement of the Rev. Professor in the activities of the RomanCatholic Church in Lublin. It has not been forgotten that he was a hardworking, dutiful, and modest man

Artykuł stanowi wspomnienie oraz prezentację życia i dorobku śp. Ks. Prof. Henryka Misztala (1936–2020), wieloletniego pracownika Wydziału Prawa, Prawa Kanonicznego i Administracji KUL, wybitnegoznawcy prawa wyznaniowego i kanonizacyjnego, nauczyciela i wychowawcy młodzieży. Ukazuje jego drogęzawodową, związaną z Katolickim Uniwersytetem Lubelskim Jana Pawła II, rozwój zainteresowań badawczychoraz zaangażowanie na rozmaitych polach aktywności naukowej, dydaktycznej i osobistej.Henryk Misztal uzyskał stopień doktora w 1968 r., doktora habilitowanego w 1979 r., tytuł profesora nadzwyczajnegow 1986 r., a profesora zwyczajnego w 1992 r. W latach 1983–1987 był prodziekanem Wydziału PrawaKanonicznego i Nauk Prawnych, zaś w latach 1987–1989 dziekanem tego Wydziału. W latach 1996–1997 pełniłfunkcję Kierownika Sekcji Prawa Kanonicznego na Wydziale Prawa Kanonicznego i Świeckiego. Z największym zaangażowaniem kierował Katedrą Prawa Wyznaniowego w latach 1980–2007, zaś Katedrą Prawa Kanonizacyjnegow latach 1984–2004. Te dwa kierunki zainteresowań zdominowały jego aktywność badawczą i organizacyjną.Artykuł przedstawia główne pola badawczych dociekań Henryka Misztala, poczynając od cenzury uprzedniejdruków kościelnych, przez prawo kanonizacyjne, po prawo wyznaniowe. Zwraca uwagę tak na ilościowo, jaki jakościowo imponującą skalę dorobku naukowego, na który składa się ponad 500 pozycji, z czego 42 są opracowaniami książkowymi. W artykule przedstawiono również zaangażowanie Księdza Profesora na niwie kościołalubelskiego. Nie zapomniano o tym, że był człowiekiem pracowitym, obowiązkowym i skromnym.

The purpose of this article is to show the prospects of initiating the beatification proceedings of Fr Theodor Christoph under the canonization law in force. The work is based on: Apostolic Constitution Divinus perfectionis Magister of John Paul II, Normae servandae in inquisitionibus ab Episcopis faciendis in causis sanctorum of the Congregation for the Causes of Saints and Sanctorum Mater. Instruction for conducting diocesan or eparchial inquiries in the causes of saints. The article includes the opinion of holiness which is one of the most important affairs in the canonization process, the private cult and opinion of special grace as prerequisites enabling to initiate the beatification proceedings. The historical and current status of Fr Christoph’s case is taken into account in prospect of preparation for initiating of the beatification proceedings. Fr Christoph’s case has not yet been completed. The legal action to initiate beatification proceedings in Diocese of Gliwice has been not taken. This case is still in the phase of preparation. The documents gathered in the case are insufficient. The decision regarding the initiating of beatification proceedings for Fr Christoph’s belongs to the competent authority in the Church.

Po raz pierwszy od reformy prawa kanonicznego w 1983 r., w oficjalnym dokumencie Stolicy Apostolskiej została uporządkowana terminologia dotycząca relikwii. Instrukcja wyróżnia relikwie znaczne i nieznaczne. Nawiązując do dekretów Kongregacji Obrzędów ukazano racje, dla których ten podział słusznie został wprowadzony. Kompetentny do przeprowadzenia wszystkich czynności na doczesnych szczątkach sługi Bożego jest biskup diecezji lub eparchii, gdzie one spoczywają, po uzyskaniu zgody spadkobierców i zgody Kongregacji Spraw Kanonizacyjnych (możliwe są różne warianty). Oprócz trybunału, biskup mianuje biegłych patomorfologów, osoby do wykonania czynności technicznych oraz dwóch świadków przeprowadzonych czynności. Omówiono przebieg kanonicznej identyfikacji zwłok, pobranie fragmentów na wypadek spodziewanej beatyfikacji oraz czynności końcowe.

For the first time since the reform of canon law in 1983 the terminology regarding relics was put in the official document of the Holy See. The Instruction distinguishes between significant and non-significant relics. Referring to the decrees of the Sacred Congregation of Rites, it shows the reasons why this particular division was rightly introduced. The Bishop of the diocese or of the eparchy where mortal remains are preserved is competent to perform all the possible procedures on them, provided he has obtained beforehand the consent of the heirs and the consent of the Congregation for the Causes of Saints (different variants are possible). Apart from a Tribunal the Bishop nominates expert pathologists, people charged with performing the technical aspects of the works and two witnesses. The procedures of canonical recognition of the remains, the extraction of some fragments in case of imminent beatification and some final operations are discussed.
