Artykuł przedstawia i omawia wybrane aspekty kosztorysowania napraw pojazdów w systemie AUDAT…X na przykładzie rzeczywistego przebiegu postępowania cywilnego w sprawie ustalenia wysokości kosztów naprawy pojazdu Infiniti FX35 (importowanego z rynku amerykańskiego), powstałych w wyniku kolizji z drzewem w styczniu 2011 r. W przedmiotowej sprawie do określenia kosztu naprawy i przywrócenia stanu pojazdu sprzed kolizji należało zastosować części zamienne i podzespoły oryginalne producenta pojazdu z uwzględnieniem postanowień łączących strony umowy dobrowolnego ubezpieczenia autocasco (AC). Celem artykułu jest przedstawienie poprawnej metodyki postępowania w przypadku kalkulacji kosztów naprawy pojazdu z uwzględnieniem szczególnych zasad kosztorysowania – kodów warunkowych. Przedstawiono opis wystąpienia okoliczności błędnego użycia kodów warunkowych w systemie, zidentyfikowano źródło błędu, pokazano skutki jego oddziaływania na wynik kalkulacji kosztów naprawy pojazdu oraz przedstawiono jedyną prawidłową metodę postępowania z użyciem kodu warunkowego 20, która nie skutkuje błędnym obliczeniem kosztu naprawy.

The article presents and discusses the selected aspects of preparing cost estimates of vehicle repairs in the AUDAT…X system on the example of the actual course of civil proceedings in a case involving the determination of the costs of repair of an Infinity FX35 (the vehicle imported from the US) that resulted from the car’s collision with a tree in January 2011. In the discussed case the cost estimate of the vehicle’s repair and restoration to its pre-collision condition had to be based on the costs of spare parts and original manufacturer’s components, taking into account the provisions of voluntary motor hull insurance binding on the parties. The article aims to present a correct procedure for calculating the costs of a vehicle’s repair; it focuses, in particular, on special rules governing cost estimates, i.e. conditional codes. The authors describe a case of an incorrect use of conditional codes in the system. They identify the source of the problem, present its effects on the outcome of the cost estimate and indicate the only accurate course of action that incorporates the use of conditional code 20, which does not lead to an erroneous cost estimate.

Przedmiotem opracowania są wybrane zagadnienia dotyczące odpowiedzialności dewelopera za wady lokalu mieszkalnego lub domu jednorodzinnego w ramach rękojmi oraz na podstawie przepisów ustawy o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego. Analizowany jest charakter odesłania zawartego w art. 27 ust. 6 ustawy deweloperskiej, stosunek przepisów kodeksu cywilnego o rękojmi za wady do postanowień art. 27 ust. 1–5 ustawy deweloperskiej oraz problematyka dopuszczalności stosowania art. 557 § 1 kodeksu cywilnego. Zaproponowany w artykule sposób rozumienia tych postanowień pozwala pogodzić ich brzmienie z zasadniczym celem ustawy deweloperskiej, którym jest ochrona praw nabywcy.

The subject of the article are the main issues regarding a developer’s liability for defects of a flat or a single-family house under the warranty for defects and under the provisions of the act on the protection of the rights of a flat or a single-family house purchaser. The analysis includes the legal nature of the reference in art. 27 al. 6 of “the development act”, the mutual relations of the provisions of the Civil code on warranty for defects and the provisions of art. 27 al. 1–5 of “the development act”, as well as the issue of applying art. 557 § 1 of the Civil code. The article proposes an interpretation of these provisions that reconciles their wording with the objective of “the development act” which is to protect the purchaser’s rights.
