The present article treats of the origin of the developer’s agreement form within the Polish legal transactions as well as the source of it’s occurence and the characteristics of the most common types of contracts present in practice within the field of developer’s investments. In the article the crux of the matter in view of the legal character is presented. Authoress focused her attention on the analysis of the developer’s agreements concerning the process of building, legal seperation and sale of the housing apartments in multiple dwelling, however the universal character of the discussed issues allows to acknowledge them with reference to the sales contracts of different subject matter. For the purposes of the preparation of this study, the authoress has used to a great degree the method of the analysis of the available documents, such as: normative acts and jurisprudence in the field of selected issues.

Niniejszy artykuł traktuje o genezie wykształcenia się umowy deweloperskiej w polskim obrocie prawnym, źródłach jej powstania, a także rodzajów umów występujących w powszechnej praktyce działalności deweloperskiej najczęściej. W artykule przedstawiono istotę urnowy deweloperskiej w kontekście jej charakteru prawnego. Autorka skoncentrowała się na analizie umów deweloperskich dotyczących-budowy, wyodrębniania i sprzedaży lokali mieszkalnych w budynkach wielorodzinnych, jednakże uniwersalny charakter omawianych postanowień umownych pozwala na ich uwzględnienie w treści umów, których przedmiotem jest sprzedaż nieruchomości o innym przeznaczeniu czy charakterze. Do opracowania materiału zawartego w pracy, autorka po-służyła się w znacznej mierze metodą analizy dostępnych dokumentów, takich jak: akty normatywne czy orzecznictwo w zakresie wybranych zagadnień. Niezwykle istotną rolę odegrały także źródła stanowiące tzw. literaturę fachową tego tematu, najczęściej pod postacią pod ręczników, jak również źródła internetowe. Ponadto, autorka korzystała z własnych spostrzeżeń oraz doświadczenia pozyskanego w toku działalności zawodowej dotyczącej w dużej mierze obszaru zagadnień niniejszego opracowania.
