Under the Constitution of Poland, everyone shall be equal before the law. It means that each citizen shall have the right to be treated equally by the public authorities and no one can be discriminated against for any reason whatsoever. Moreover, in accordance with the Constitution of Poland everyone shall comply with his responsibilities and public duties, including the payment of taxes, as specified by statute. The obligation of taxation of the revenue (income) from a real property transfer by natural persons results from the Personal Income Tax Act. Therefore, in this paper there has been discussed a constitutional principle of equality before the law and also there have been outlined the issues related to taxation of real property sales by natural persons over the last ten years against the background of sometimes contradictory judgements and thereby unequal and inconsistent approach of tax authorities and administrative courts to this issue.

The measure of compensation regulated by Article 440 of the Civil Code is a limitation of the principle of full compensation. This provision implies the possibility to limit the obligation to compensate for the damage if the principles of social co-existence require it. However, the application of Article 440 of the Civil Code is only possible in relations between natural persons. The provision therefore omits legal persons and “crippled” legal persons. This restriction raises questions from the point of view of the constitutional principle of equality before the law. The purpose of this article is to analyse the compatibility with the principle of equality before the law of the limitation of the mitigation of damages to relations between natural persons, to the exclusion of other private law subjects. The considerations in the article lead to the conclusion that the restriction of mitigation to relations between natural persons is unconstitutional.

Miarkowanie odszkodowania uregulowane w art. 440 k.c. stanowi limitację zasady pełnej kompensacji. Przepis ten zakłada możliwość ograniczenia obowiązku naprawienia szkody, jeżeli wymagają tego zasady współżycia społecznego. Stosowanie art. 440 k.c. jest jednak możliwe jedynie w stosunkach między osobami fizycznymi. Przepis ten pomija zatem osoby prawne i „ułomne” osoby prawne. Ograniczenie to wywołuje wątpliwości z punktu widzenia konstytucyjnej zasady równości wobec prawa. Celem przedmiotowego artykułu jest analiza zgodności z zasadą równości wobec prawa ograniczenia miarkowania odszkodowania do stosunków między osobami fizycznymi, z pominięciem pozostałych podmiotów prawa prywatnego. Rozważania zawarte w artykule prowadzą do wniosku o niekonstytucyjności ograniczenia miarkowania do stosunków między osobami fizycznymi.
