Opracowanie opisuje genezę powstania prawa użytkowania wieczystego, oraz jego celowy charakter. Przedstawiono aktualne problemy prawno – inwestycyjne związane z określeniem celu użytkowania wieczystego w decyzjach uwłaszczeniowych przy badaniu zgodności z realizowanymi przez użytkowników wieczystych zamierzeniami we współczesnych realiach. W artykule tym wskazano w jakim trybie może nastąpić zmiana treści prawa użytkowania wieczystego. Opisano roszczenia właściciela nieruchomości w przypadku stwierdzenia oczywistej sprzeczności korzystania przez użytkownika wieczystego z przeznaczeniem określonym w umowie. Przedstawiono trudności związane z rozwiązaniem prawa użytkowania wieczystego.

The paper describes the origin, the purpose and the character of the law of perpetual usufruct. It presents current legal and investment problems pertaining to defining the purpose of perpetual usufruct in enfranchisement decisions when studying compliance with investment plans realized by perpetual leaseholders in present realities. The article indicates the procedure according to which the wording of the law of perpetual usufruct may be amended. It describes claim of the land owner in case of manifest contradiction between the perpetual leaseholder’s usage of property and the purposes specified in the contract. The paper also talks about difficulties relating to the dissolution of the law of perpetual usufruct.
