Ustawą z 16 lutego 2007 r. o zmianie ustawy Kodeks cywilny wprowadzono nowe zasady przedawnienia roszczeń o naprawienie szkody wyrządzonej czynem niedozwolonym. Przedmiotem niniejszego artykułu jest analiza unormowania z art. 4421 § 1 k.c., określającego zasady przedawnienia roszczeń o naprawienie szkody deliktowej na mieniu, pod kątem ustalenia, czy wskazana regulacja zapewnia należytą ochronę osób poszkodowanych na skutek tego rodzaju szkód.

The Act of 16 February 2007 on amendment of the Civil Code introduced new rules for statute of limitation for claims related to repair of a loss caused by tort. The article is devoted to analysis of Article 4421 § 1 of the Civil Code, which lays down the rules for statute of limitation for claims related to repair of a tort property loss regarding as to whether the above-mentioned regulation ensures sufficient protection of injured parties in the case of such losses.
