Artykuł został poświęcony tematyce przestępstw podatkowych w zakresie podatku VAT. Przedstawienie wielkości problemu oszustw podatkowych w Polsce zostało poprzedzone wstępem teoretycznym opisującym charakter zobowiązania podatkowego oraz mechanizm funkcjonowania polskiego systemu podatkowego, który ze względu na specyficzną konstrukcję umożliwia podejmowanie ryzyka popełnienia przestępstw podatkowych przez przedsiębiorców. Autor charakteryzuje również zjawisko określane mianem luki VAT.

The article was devoted to tax offenses in respect of VAT. Presentation of the size of the problem of tax evasion in Poland was preceded by a theoretical introduction describing the nature of the tax liability and the mechanism of functioning of the Polish tax system, which allows risk-taking by entrepreneurs in order to commit the offense. The author is also characterized by a phenomenon called VAT gap.
