Przytoczona jest treść instytucji wolności sumienia i wyznania oraz definicja funkcjonariusza publicznego, a następnie praktyka orzecznicza, która wydaje się niewystarczająca wobec obecnych wyzwań, w szczególności na tle innych krajów europejskich.

The article discusses the constitutional and statutory regulations on freedom of conscience and religion of public officials. Quoted is the meaning of freedom of conscience and religion and a definition of a public official, and practice of adjudication, which seems to be insufficient facing current challenges, particularly in comparison to other European countries.

The purpose of this paper is to answer the question whether the members of precinct electoral commissions should be public officials. In this article, the author presents arguments for both an affirmative and a negative answer to this question. In the conducted research, the legal and historical method was used in order to show the legal regulations adopted during the Second Polish Republic. In addition, a linguistic and doctrinal method was used, in an effort to determine the wording of contemporary legal norms. The author hopes that the result of his research will prove valuable and useful for the purposes of further scientific discourse.

W artykule przedstawiono przesłanki odpowiedzialności majątkowej funkcjonariuszy publicznych za rażące naruszenie prawa. Autorka koncentruje się w tym artykule na kwestiach przedmiotowych odpowiedzialności. W obowiązujących przepisach prawa mamy do czynienia z mechanizmem materialnoprawnej kumulatywności przesłanek odpowiedzialności, które zostały przedstawione w sposób całościowy, zgodnie z dyrektywą kompleksowości badań dogmatycznych. Przepisy wyznaczają szeroki krąg podmiotowy, nie ograniczając się tylko do naruszeń proceduralnych. Mankamentem przyjętej regulacji jest jej kazuistyczność, co rodzi niebezpieczeństwo, że w niektórych sytuacjach nie będzie można pociągnąć funkcjonariusza do odpowiedzialności, ponieważ przepisów tych jako norm szczególnych nie wolno interpretować rozszerzająco.

This paper presents conditions of property liability of public officers for gross violation of the law. Author focuses on subjective matters of the responsibility. The applicable legal regulations deals with a mechanism of cumulative substantive conditions of liability, which are presented in a comprehensive manner in accordance with the directive of complexity of dogmatic research. The provisions define a broad range of subjects, not limited to procedural violations. The drawback of the regulation is the casuistic approach what involves the danger of some situations in which it would not be possible to held public officers liable, because these provisions as special rules must not be interpreted broadly.

State bodies have a right to resort to state compulsion, i.e. to a group of compulsion means which are an attribute of the state only. One of the most severe forms of state compulsion is direct compulsion which is applied predominantly by public officials in order to protect the rights and liberty of an individual and to ensure public safety. These means are designed to force a person to subordination to the commands based on law, which may entail the use of physical force. The purpose of this paper is to present the procedure and rules of using direct compulsion means and to discuss the level of legal interference in the individual’s rights and liberty.
