Podstawowe źródła informacji o nieruchomościach

Informacja w języku polskim ma wiele znaczeń np. powiadomienie o czymś, zakomunikowanie czegoś, pouczenie. W gospodarce nieruchomościami jest jednym z podstawowych elementów podejmowania skutecznych decyzji. Brak informacji lub ich niska jakoś może doprowadzić do podejmowania nieodpowiednich decyzji uczestników rynku nieruchomości. Dlatego też przy podejmowaniu wszelkich decyzji dotyczących szeroko pojętej gospodarki nieruchomościami należy uwzględnić podstawowe źródła informacji o nieruchomościach takie jak: księgi wieczyste, kataster nieruchomości, inwentaryzacja i ewidencja sieci uzbrojenia terenu , miejscowy plan zagospodarowania przestrzennego czy też studium uwarunkowań i kierunków zagospodarowania przestrzennego gminy.

Information has a diversity of meanings in the Polish language, and to name but a few, represents an act of informing, communication or instruction. As far as real property management is concerned, information is one of the most crucial elements of an efficient decision making process. Lack of information or its poor quality may lead to improper decision making. Therefore, prior to making any decision concerning real property management, it is essential to take into account the sources of information about property, which include Land and Property Register, Cadastre, Local Spatial Management Plan, Local Spatial Development Plan and Study of Pre-Conditions and Direction Policies for Spatial Management of Community. Land and Property Register and Cadastre constitute the main referential systems of factual and legal data about land and property. Local Spatial Development Plan and Study of Pre-Conditions and Direction Policies for Spatial Management of Community are very important sources of information for future development and exploitation of a given area. Whereas, Local Spatial Management Plan plays a part of a thematic subsystem which is a crucial source of information for activities connected with investment and designing, and which provides control over how land and property can be developed and improved.

At present in Poland there exist many registers of business activities on the food market (their number varying depending on the adopted criterion of classification). Therefore, it is obvious that many problems of both practical and theoretical nature may be encountered in this regulatory area. For the purposes of the article an analysis of regulations of the registers was carried out. Selected key legal problems of these regulations were discussed, including the following aspects: classification of registers of food market business activities; conceptual problems related to the functioning of registers of operators, business activities, and establishments; the way of formulating registration obligations and exemptions from them; sanctions related to registration obligations and the scope and availability of information collected in the registers. Finally, de lege ferenda comments were offered as to developing of a single, central, electronic register of (agro)food market business activities (Agro-Food Register).

In the article, the needs for changes in regulations aimed at improving the safety and efficiency of legal transactions are discussed. The author points out the necessity of promptly abandoning the currently enforced bureaucratic procedure. The method of performing notarial acts, mainly relying on paper document gathering, constitutes an excessive burden on citizens. Simultaneously, the author emphasizes the necessity for notaries to access selected public registers and the creation of appropriate software and teleinformatics systems to support notarial offices. Additionally, the author calls for the expansion of the Central Repository of Electronic Copies of Notarial Deeds CERWAN. Implementing these proposals will constitute a significant facilitation for citizens and enhance the efficiency of legal transactions, without compromising the level of legal transaction security.

Publikacja zawiera analizę ważniejszych instytucji z u.d.c.s.a.m.p.p., która wdraża dyrektywę Parlamentu Europejskiego i Rady (UE) 2016/2102 z dnia 26 października 2016 roku w sprawie dostępności stron internetowych i mobilnych aplikacji organów sektora publicznego. Generalnym celem ustawy jest opracowanie standardów w zakresie przekazywania informacji przez wskazane w niej organy publiczne w sposób najbardziej czytelny i uczciwy. W opisach poddano badaniom szczególnie kwestie normatywne w zakresie ujednolicania i zwiększania dostępności stron internetowych. W ramach analizy autor najpierw wykazuje nową siatkę pojęciową, następnie zaś najważniejsze instytucje prawne odnoszące się do cyfrowego informowania. W wielu miejscach dostrzega usterki legislacyjne, szczególnie w aspekcie rozmijania się tekstu ustawy z treściami dyrektywy. W wnioskach zaś przedstawiono kilka propozycji w zakresie dalszego doskonalenia przepływu informacji i komunikacji sfery publicznej z społeczeństwem.

This publication includes the analysis of more important institutions from the Digital Access Act. The above-mentioned Act implements Directive (EU) 2016/2102 of the European Parliament and of the Council of 26th October 2016 on accessibility of websites and mobile applications of public sector bodies. The main purpose of the Act is to instruct how to inform in a clear and simple manner in order to achieve the highest level in standardization and improving web site accessibility. In his analysis, the author describes a set of new definitions and absolutely radical and new conceptions for digital access regulations. In some places the author indicates problems with new regulations mainly when the text of the Act differs from the directive’s intentions and goals. At the end of the analysis there are some proposals to improve the flow of information and communication between all kinds of public organs.
