Celem naukowym pracy była ocena ryzyka związanego z przestępczością cudzoziemców w Szwajcarii w latach 2009–2015 jako zagrożenia bezpieczeństwa publicznego, w tym sformułowanie prognoz dotyczących rozwoju analizowanego zjawiska w przyszłości. Utylitarnym celem badań było zarekomendowanie strategii zarządzania analizowanymi zagadnieniami. W procesie badawczym autor zastosował jakościowe metody badawcze, w tym kwerendę źródeł i analizę danych statystycznych oraz analizę ryzyka z wykorzystaniem metodyki FEMA opartej na danych z lat 2009–2015. Przedstawione treści wypełniają lukę w badaniach nad przestępczością cudzoziemców w Szwajcarii. Artykuł stanowi nie tylko diagnozę aktualnego charakteru i skali przestępczości cudzoziemców, ale zawiera również predykcję arytmetyczną dotyczącą ewolucji zjawiska w przyszłości, w kontekście potencjalnego zagrożenia bezpieczeństwa publicznego w Szwajcarii.

The scientific objective of the study was to assess the risk associated with crime of foreign nationals in Switzerland in the years 2009–2015 as a threat to public security, including predictions concerning the development of the analysed phenomenon in the future. The practical purpose of the study was to recommend a strategy for the management of the analysed issues. In the research process, the author applied qualitative research methods, including query of the sources and analysis of statistical data, as well as analysis of risk using the FEMA methodology based on data from the years 2009–2015. The research fills a gap in studies on crime of foreign nationals in Switzerland. Article not only constitutes a diagnosis of the current nature and scale of crime of foreign nationals, but it also includes an arithmetic prediction concerning the evolution of the phenomenon in the future, in the context of it being a potential threat to public security in Switzerland.

Anomie is associated with transitional periods, and in particular with rapid change processes. The aftermath of a disaster or a calamity, including epidemics, can serve as one example of such changes.The spread of the disease not only puts to test financial security, but also brings about the axionormative redevelopment of the society. And eventually it also raises questions about the feasibility of axiological orders and axiological superiority in such situations. The contemporary context where anomie is emergent is the COVID pandemic. A full evaluation of this phenomenon requires a longterm approach. Ex ante analyses should focus on developing accurate evaluation tools, which is the research objective of this article.

Zjawisko anomii należy wiązać z okresami przejścia, zwłaszcza ze zmianami o charakterze gwałtownym. Szczególnym rodzajem tego typu zmian są następstwa klęsk czy kataklizmów, w tym epidemii. Szerząca się choroba wystawia na próbę nie tylko system zabezpieczeń materialnych, lecz także skutkuje aksjonormatywną przebudową społeczeństwa. Ostatecznie też prowokuje pytanie o możliwość wypracowania właściwej dla tej sytuacji „nadrzędności aksjologicznej”. Scenerią urzeczywistnienia się współczesnej anomii jest pandemia COVID-19. Pełna diagnoza tego fenomenu wymaga dłuższego dystansu czasowego. Analizy ex ante powinny koncentrować się na skonstruowaniu odpowiedniego narzędzia diagnozy. Taki też jest cel niniejszego artkułu.

Identification of railway transport as a key element of sustainable and effective transport showcases the necessity of strengthening the role it plays, both on the EU policy level as well as in the EU Member States. The consequence of such a policy is strong financial support allocated to the railway sector, e.g. in the form of infrastructural investments. This leads to questions on the efficiency of such support and its influence on the railway sector. In this respect, the analysis of the public support impact on railway transport in relation to variables describing the condition of this sector has been conducted. The analysis was focused on the evaluation of the impact of railway infrastructure investments. The results indicate significant differences in the effects among particular countries, illustrating the heterogeneous impact of an independent variable on measures concerning transport performance in passenger and freight services (passenger-kilometre and tonne-kilometre). Countries with higher support for infrastructure investments, in general, achieve better results in respect to the above-mentioned measures. Nevertheless, the strength of this impact is highly differential, which indicates the necessity of increasing the efficiency of infrastructural investments in the railway sector in particular countries.

Identyfikacja transportu kolejowego, jako kluczowego dla funkcjonowania zrównoważonego i efektywnego systemu transportowego, skutkuje wskazaniem na poziomie polityki zarówno Unii Europejskiej (UE), jak i poszczególnych państw członkowskich konieczności zwiększania roli tego środka transportu. Polityka ta przekłada się na silne wsparcie finansowe alokowane w sektorze transportu, m.in. w formie finansowania inwestycji infrastrukturalnych. Podejmowanie takich działań rodzi pytanie o efektywność wsparcia i jego wpływ na stan sektora transportu. W przeprowadzonym badaniu przeanalizowano wpływ wsparcia publicznego na transport kolejowy w odniesieniu do szeregu wskaźników, opisujących stan tego sektora. Analiza objęła ocenę wpływu wsparcia inwestycji infrastrukturalnych. Wyniki wskazują na znaczne zróżnicowanie efektów pomiędzy poszczególnymi państwami, wykazując niejednorodny wpływ zmiennej na wskaźniki odnoszące się do pracy przewozowej (pasażero-kilometry i tono-kilometry). Kraje silniej wspierające inwestycje infrastrukturalne co do zasady charakteryzują się lepszymi wynikami w zakresie opisywanych wskaźników. Niemniej siła wpływu inwestycji na pracę przewozową jest mocno zróżnicowana, co wskazuje na konieczność zwiększania efektywności tej formy wsparcia sektora kolejowego w poszczególnych krajach.

The law-making process in the reception of many entities participating in it or monitoring its course is not very transparent and unsatisfactory as far as the level of civic participation is concerned. The authorities should care about civilizing the law-making process. The more discussions and consultations are in the process of creating assumptions for legal acts, the greater the chance of avoiding mistakes and the chance that citizens will approve the existing legal system and abide by the law. In this publication, the author has attempted to make a subjective indication of these elements of the law-making process that require rapid change. At the same time, he pointed to solutions that could significantly contribute to improving its quality.

Proces stanowienia prawa w odbiorze wielu podmiotów w nim uczestniczących lub monitorujących jego przebieg jest mało przejrzysty oraz niesatysfakcjonujący, jeśli chodzi o poziom partycypacji obywatelskiej. a przecież władzom powinno zależeć na tym, aby uspołecznić proces stanowienia prawa. Im więcej dyskusji i konsultacji w trakcie tworzenia założeń do aktów prawnych, tym większa szansa uniknięcia pomyłek oraz szansa na to, że obywatele będą aprobowali istniejący system prawny i przestrzegali prawa. W opracowaniu tej autor podjął próbę subiektywnego wskazania tych elementów procesu stanowienia prawa, które wymagają szybkiej zmiany. Jednocześnie pokazał na rozwiązania, które mogłyby przyczynić się znacząco do poprawy jego jakości.

In the commented verdict Supreme Court confirmed possibility to modify lump sum outside of the scope of regulation of Civil Code art. 632 § 2 in case when there are essential changes in the contractor’s performance. However, the question of legal consequences of informal arrangements between the parties on modification of the obligation and the issue of duty to formally amend the contract in such situations was not addressed. Additionally, Supreme Court refused to classify “Design and Build” contract as a variation of the construction contract and considered it a mixed contract instead. This text comments on the issues referred to hereinabove. As for the first issue it is an affirmative commentary while the remaining two issues are being commented critically

W glosowanym orzeczeniu Sąd Najwyższy potwierdził możliwość modyfikacji wynagrodzenia ryczałtowego poza przypadkami opisanymi w art. 632 § 2 k.c. w sytuacji przedmiotowo istotnej zmiany zakresu świadczenia wykonawcy. Nie poddano natomiast szerszej analizie kwestii prawnej doniosłości nieformalnych uzgodnień między stronami co do zmiany treści zobowiązania oraz istnienia obowiązku formalnej zmiany umowy w takich okolicznościach. Ponadto Sąd Najwyższy odmówił zakwalifikowania umowy typu „zaprojektuj i wybuduj” jako umowy o roboty budowlane, uznając ją za umowę mieszaną. Niniejsza glosa stanowi komentarz do stanowiska Sądu Najwyższego w powyższych kwestiach, przy czym w zakresie pierwszego problemu jest to komentarz aprobujący, odnośnie zaś do dwóch pozostałych krytyczny.

Tajemnica poprzez swoją totalność, czy roszczenie do totalności, musi być ograniczana. Sfera publiczna powinna być w maksymalny sposób jawna, natomiast to, co wiąże się ze sferą prywatną człowieka, musi pozostać tajne (postulat prawa do tajemnicy). Tajemnica, oprócz tego, że jest ambiwalentna, mateż podwójną naturę - etyczną i estetyczną. Biorąc pod uwagę ten pierwszy aspekt, można powiedzieć, że chroni dobro, jednakże dla jej przeciwników - skrywa zło. Drugi jej wymiar powoduje, żema ona pewien urok, powab, stając się dla tego, kto ją posiad, swoistą ozdobą, dzięki czemu w stratyfikacji społecznej wywyższa jej posiadacza. Zdrada tajemnicy ma z kolei wydźwięk pejoratywny - niszczy jej piękno, czyniąc czymś pospolitym, a więc pozbawia ją statusu wartości dobra rzadkiego. W debacie publicznej pojawia się czasem pokusa wykorzystania tej natury (natur) tajemnicy w formie nielojalnego fortelu erystycznego, jakim jest argumentum ad secretum (argument z posiadania tajemnicy). Osoba, która posiada tajemnicę, traktowana jest jako ktoś, kto należy do elity, chroni dobro i nie musi się tłumaczyć. Taka sytuacja nie powinna byćdopuszczalna w życiu publicznym. Stąd konieczność demaskowania argumentum ad secretum jako manipulacji społecznej, zaciemniającej życie publiczne. Już samo wskazanie na możliwość jej zaistnienia, osłabia oddziaływanie takiej machinacji, a jedynym sposobem aby przestała działać, jest ujawnienie jej mechanizmu.

A secret due to its totality or the claim to totality must be limited. The public sphere should be public to the maximum, whereas, what is connected with the private sphere must remain secret (the postulate of the right to secrecy). A secret, apart from being ambivalent, is also of dual nature – ethical and aesthetic. Ethically, a secret protects good – but for its enemies, it conceals evil. Aesthetically, it has a certain charm and allure that constitutes a peculiar decoration for its holder, thanks to which it elevates its owner in the social stratification. The betrayal of a secret has, on the other hand, the pejorative undertone – it destroys its allure making it a common thing and so deprives it of the status of a rare thing value. In the public debate sometimes appears the temptation to use this nature (natures) of a secret as a disloyal eristic stratagem, i.e. the argumentum ad secretum (the argument of knowing a secret). Someone who knows a secret is treated as someone who belongs to the elite, he or she protects good and does not need to excuse oneself. Such a situation should not be acceptable in public life. Hence, it is necessary to expose argumentum ad secretum as social manipulation which obscures the public life. The mere indication of the possibility of such manipulation weakens its influence, and the only way to stop this manipulation is to disclose its mechanism.
