Na gruncie nowych dyrektyw Unii Europejskiej, regulujących zamówienia publiczne, wprowadzono dodatkowy, nieznany wcześniej tryb udzielania zamówienia – partnerstwo innowacyjne. Jest to procedura konkurencyjna, umożliwiająca – w ramach jednego postępowania – opracowanie oraz zakup dostaw, usług lub robót budowlanych o charakterze innowacyjnym. Partnerstwo innowacyjne stanowi przejaw stale wzrastającego nacisku, jaki instytucje Unii Europejskiej kładą na wspieranie innowacji w ramach unijnych polityk oraz przewidywanej roli, jaką mają w tym względzie odegrać zamówienia publiczne. Procedura udzielania zamówienia w trybie partnerstwa innowacyjnego niesie jednak ze sobą pewne trudności wynikające z konstrukcji tego trybu, przejawiające się w sferze zarówno praktycznej, jak i prawnej. Analiza tych zagadnień stanowi przedmiot niniejszego opracowania.

Under the new European Union directives regulating public procurement, an additional, previously unknown mode of awarding the contract called innovation partnership was introduced. It is a competitive procedure which allows, in a single proceeding, both the development and purchase of innovative supplies, services or works. The innovative partnership is a manifestation of the ever-increasing emphasis placed by the European Union institutions on supporting innovation in various EU policies and the anticipated role that innovation should play in public procurement. However, the innovative partnership procedure of awarding the public procurement contracts leads to certain difficulties resulting from the construction of this procedure, that are manifested both in the spheres of law and practice. A detailed analysis of these problems is the subject of this paper.

Narzędzia polityki przestrzennej jako narzędzia zarządzania dziedzictwem i wytyczania rozwoju opartego o dziedzictwo

Celem artykułu jest określenie, w jaki sposób narzędzia polityki przestrzennej (przy stwierdzonej niesprawności w ich zastosowaniu) są i mogą być wykorzystywane w zarządzaniu dziedzictwem. Dokonano analizy roli, jaką teoretycznie powinny odgrywać i jaką realnie odgrywają studium uwarunkowań i kierunków zagospodarowania przestrzennego, miejscowy plan zagospodarowania przestrzennego oraz decyzja o warunkach zabudowy i zagospodarowania terenu. Następnie przeanalizo¬wano możliwość zastosowania tych narzędzi na polu zarządzania dziedzictwem oraz wskazano związane z tym bariery.

The aim of this article is to determine how spatial policy tools (in the case of an identified inefficiency in their application) are and can be used in heritage management. An analysis was made of the role which should theoretically be played and which is actually played by the study of the conditions and directions of spatial development, the local spatial development plan and the decision on land development and land management conditions. The possibility of using these tools in the field of heritage management was then analysed and the related barriers identified.
