Legal Determinants of Quality Policy for Agricultural Products and Foodstuffs

The paper attempts to assess some of the legal instruments for the implementation of quality policy in the field of agricultural products and foodstuffs, known as protected designation of origin (PDO), protected geographical indication (PGI) and traditional specialty guaranteed (TSG). It indicated legal regulations concerning financial assistance for the development of these quality systems under the first and second pillar of the common agricultural policy, and some of the new solutions adopted in the last Regulation (EU) No. 1151/2012. An important change is the obligation to ensure protection ex officio by the Member States of all PDO, PGI and TSG, placed on its territory, regardless of their country of origin, which should harmonize the level of protection throughout the EU and thereby ensure the rights of producers to fair competition and those of consumers to reliable information.

Celem artykułu jest próba oceny wybranych instrumentów prawnych pod kątem realizacji polityki jakości w zakresie produktów rolnych i środków spożywczych określanych jako chroniona nazwa pochodzenia (ChNP), chronione oznaczenie geograficzne (ChOG) i gwarantowana tradycyjna specjalność (GTS). Zostały wskazane prawne regulacje dotyczące pomocy finansowej na rozwój powyższych systemów jakości w ramach I i II filaru Wspólnej Polityki Rolnej oraz niektóre nowe rozwiązania przyjęte w ostatnim rozporządzeniu (UE) nr 1151/2012. Istotną zmianą jest obowiązek zapewnienia ochrony z urzędu przez państwo członkowskie wszystkich ChNP, ChOG i GTS wprowadzanych na jego terytorium, bez względu na ich kraj pochodzenia, co powinno ujednolicić poziom ochrony na całym terytorium UE i tym samym zapewnić prawa producentów do uczciwej konkurencji, a konsumentów – do wiarygodnej informacji.
