Zasady tworzenia i funkcjonowania rady szkoły reguluje ustawa o systemie oświaty i na podstawie jej zapisów powinien być opracowany regulamin tego organu. Prezentowana tu analiza regulaminów rad szkół miała na celu określenie m.in. stopnia ich zgodności z obowiązującym stanem prawnym oraz uchwycenie „ducha” w jakim były tworzone. Podczas badań okazało się jednak, że w dokumentach tych pojawia się wiele problematycznych kwestii, których nie przewidziano na etapie wstępnym. Analiza ujawniła, że wymienione w artykule rady szkół realizują ustawowe kompetencje wybiórczo, zaś reguły działania ustalają według własnego wyobrażenia o zasadach demokracji, nie zawsze zgodnie z prawem.

The rules for creation and work of the School Council are regulated by an Act of the Law of the Education System. A statute is developed based on this law. An analysis of School Council regulations was completed to define to what extent they were compliant with the law and in what spirit were they created. During the research many problematic issues were identified, which were not predicted at the initial stage. The analysis revealed that the School Councils in the sample make a selective decision on what statutory competencies to implement. Moreover, they set the rules of action in accordance to an individual idea of democracy, which is not always in accordance with the law.

Rada szkoły jest społecznym organem kolegialnym, który od dwudziestu lat stanowi element ustroju polskiej szkoły publicznej. Ma ona niewątpliwie cechy sprzyjające demokratyzacji życia szkolnego – jest reprezentacją nauczycieli, uczniów i rodziców, która posiada istotne dla funkcjonowania placówki kompetencje. Jej powoływanie nie jest obligatoryjne, liczba szkół posiadających rady szkoły terenie kraju nie jest zaś duża. O tych, które funkcjonują – niewiele wiadomo. Artykuł prezentuje ogólne wyniki badań, dotyczących funkcjonowania rad szkół na terenie województwa mazowieckiego, w którymi kierowała autorka w latach 2012-2013 w ramach grantu Akademii Pedagogiki Specjalnej

School council is a collective body and a part of the Polish public school for twenty years. Undoubtedly it has got some features that make school life more democratic – it is a representation of teachers, students and parents, possessing essential competences for the functioning of the institution. Establishment of the school council is not obligatory, the number of schools with school councils across the country is not large, and not much is known about those that exist. This paper presents the general results of studies on the functioning of school councils in the province of Mazovia led by the author in 2012-2013 through the grant of the Academy of Special Education
