The paper analyses the way of regulating the principle of two-instance administrative proceedings in constitutional law and in administrative procedure law. The author explains what the instance control of correctness of the decision appealed against consists in, what the reconsideration of the matter in appellate proceedings consists in, what rulings may be issued in appellate proceedings, when the entities entitled to file an appeal against a decision may exercise this right, as well as if any exceptions from the principle of two-instance proceedings exist in the general administrative proceedings. Furthermore, the author considers whether and in what degree the Constitution of theRepublicofPolandguarantees the right to appeal against an administrative decision issued in the first instance to the administrative authority of higher level.

W artykule jest analizowany sposób unormowania zasady dwuinstancyjności ogólnego postępowania administracyjnego na gruncie prawa konstytucyjnego i proceduralnego prawa administracyjnego. Autor wyjaśnia, na czym polega kontrola prawidłowości zaskarżonej decyzji dokonywana w postępowaniu odwoławczym, na czym polega ponowne rozpatrzenie sprawy w postępowaniu odwoławczym, jakiego rodzaju rozstrzygnięcia mogą zapaść w postępowaniu odwoławczym, kiedy podmioty uprawnione do wniesienia odwołania mogą skorzystać z tego prawa, a także czy istnieją wyjątki od zasady dwuinstancyjności w ogólnym postępowaniu administracyjnym. Ponadto autor rozważa, czy i w jakim stopniu Konstytucja RP gwarantuje prawo do poddania sprawy administracyjnej rozpatrzeniu przez organ wyższego stopnia.
