The article deals with the evolution of legal regulations regarding the reimbursement of proceeds from crime by a person other than the perpetrator. The author analyses the premises for applying the principle of forfeiture of proceeds and chances relating to them, paying particular attention to the nature of Article 52 of the Criminal Code. The analysis also takes into account the positive direction of the changes and contains critical remarks concerning some solutions. The conclusion indicates a need for eliminating regulatory shortcomings, thus making it possible for the principle of forfeiture of proceeds to be a rational instrument of penal policy.
Since health authorities and pharmaceutical companies are risk-averse in the reimbursement process, risk-sharing agreements (RSAs) can be seen as a happy medium for ensuring that the inherent financial and clinical risks of implementing a new innovative treatment are minimized. Although a properly applied RSA lies in the interest of patients, payers and manufacturers, the initial analysis shows that implementation of performance-based RSAs (PBRSAs), tied to measurable health outcomes, faces numerous obstacles in Poland. The article seeks to propose solutions, taking into account the characteristics of PBRSAs in Italy and the United Kingdom. The analysis is in line with the current trend of gradual remodelling of the Polish system towards value-based healthcare. The methods employed include a broad conceptual and exploratory analysis of Polish and foreign literature and legal acts, data acquired from national health data repositories, materials published by pharmaceutical consortia, financial institutions and public authorities engaged in managing the medicine market in Europe.
W dniu 1 stycznia 2012 roku weszła w życie nowa ustawa o refundacji leków, środków spożywczych specjalnego przeznaczenia żywieniowego oraz wyrobów medycznych. Celem jej wprowadzenia było m.in. przekształcenie systemu refundacji w Polsce tak, aby w ramach dostępnych publicznych środków finansowych odpowiadał w możliwie najwyższym stopniu aktualnemu zapotrzebowaniu społecznemu w zakresie zaopatrzenia w produkty refundowane. Konsekwencjami wejścia w życie nowej ustawy refundacyjnej – boleśnie odczuwanymi przez pacjentów – był jednak spadek udziału refundacji (a tym samym wzrost współpłacenia społeczeństwa) w wartości zakupionych leków wydawanych z przepisu lekarza (leków Rx).

The Act on the Reimbursement of Medicines, Foodstuffs Intended for Particular Nutritional Uses and Medical Devices came into force on 1 January 2012. Its purpose was to transform the Polish medicine reimbursement so that the available public funds corresponded as closely as possible to the current social needs in the supply of refunded products. The consequence of the new reimbursement act – experienced painfully by patients - was a decrease in the share of reimbursement (and thus increase in patients’ contribution) in the value of the purchased medicine on prescription (Rx).
The Supreme Administrative Court sustained the judgement of the Provincial Administrative Court in Warsaw, which repealed the Minister’s of Health decision to refuse the admission of the patients association to the proceeding as participant with the right of party to proceedings. In his judgment the SAC proposed a series of statements which lead to the conclusion that the participation of community organisations in the reimbursement proceeding as participants with rights of parties is possible. Such settlement should be deemed legitimate, although it may have far-reaching consequences for the reibursement proceeding. The confidentiality of data and consequently applicants' interest, might be particularly at risk. Therefore, an implementation of particular regulations concerning the participation of community organisations in the reimbursement proceeding is suggested.

Naczelny Sąd Administracyjny podtrzymał wyrok Wojewódzkiego Sądu Administracyjnego w Warszawie, który uchylał decyzję Ministra Zdrowia o odmowie dopuszczenia stowarzyszenia zrzeszającego pacjentów do postępowania o objęcie leku refundacją jako uczestnika na prawach strony. Naczelny Sąd Administracyjny w uzasadnieniu orzeczenia postawił szereg twierdzeń, które prowadzą do wniosku, iż udział organizacji społecznych w postępowaniu refundacyjnym jako uczestników na prawach strony jest możliwy. Rozstrzygnięcie takie należy uznać za prawidłowe, jednak może ono mieć daleko idące konsekwencje dla postępowania refundacyjnego. W szczególności zagrożona może być poufność danych, a co za tym idzie, interes wnioskodawców. Sugerowane jest zatem wprowadzenie szczególnych regulacji co do udziału organizacji społecznych w postępowaniu refundacyjnym.
Cel: oszczędności wynikające ze stosowania leków biopodobnych (biosymilarów) są istotnym zagadnieniem w zarządzaniu gospodarką lekową państwa. We wrześniu 2018 roku Rada Ministrów przyjęła dokument Polityka Lekowa Państwa (PLP) 2018–2022. W dokumencie przedstawionym przez Ministerstwo Zdrowia jednym z priorytetów jest zwiększenie użycia leków biopodobnych. Celem artykułu jest ocena zmian (i ich dynamiki) w wydatkach na infliksimab i udziałach biosymilarów w rynku infliksimabu przed i po ogłoszeniu PLP. Metodologia: w analizie wykorzystano przykład leku biologicznego infliksimab (lek oryginalny Remicade), szeroko stosowanego w dermatologii, gastrologii i reumatologii. Okres wybrany do analizy to rok przed wejściem w życie dokumentu Polityka Lekowa Państwa (rok I), czyli wrzesień 2017 – sierpień 2018 r. oraz rok po (rok II), czyli wrzesień 2018 – sierpień 2019 roku. Podstawą analizy porównawczej były dane statystyczne dotyczące miesięcznych wydatków oraz liczby opakowań zrefundowanych przez Narodowy Fundusz Zdrowia (NFZ). Pierwsze leki biopodobne do infliksimabu były refundowane już od początku 2014 roku. W związku z powyższym rynek infliksimabu jest silnie zdominowany przez biosymilary. W analizie wykorzystano jednopodstawowe i łańcuchowe indeksy dynamiki. Wyniki: wykazano, że liczba sprzedanych opakowań i wydatki na lek oryginalny były niższe w roku II, po wprowadzeniu PLP. Dla leków biopodobnych zauważono odwrotne zjawisko – wzrost wydatków i liczby sprzedanych opakowań biosymilarów w roku II. Ograniczenia/implikacje badawcze: należy jednak podkreślić, że artykuł dotyczy tylko jednego przykładu – rynek infliksimabu i że na sprzedaż leków biopodobnych może wpływać wiele innych ważnych czynników. Purpose: Savings resulting from the use of biosimilar medicines (biosimilars) are important to the management of national drug administration. In September 2018, the Council of Ministers adopted the National Drug Policy (NDP) for 2018–2022. One of the priorities of the document set forth by the Ministry of Health was to increase the proportional use of biosimilars. The purpose of this article is to assess the changes and the dynamics in infliximab (Remicade®) expenditures and the share of biosimilars within the infliximab market before and after the announcement of the NDP. Design/methodology/approach: The analysis is based on the example of infliximab, a biological medicine widely used in dermatology, gastroenterology and rheumatology. The analysis period encompasses data for one year before the document was adopted, i.e. the period from September 2017 until August 2018 (year I) as well as one year after the document came into force, i.e. the period from September 2018 until August 2019 (year II). Comparative analyses were based on the statistical data of monthly expenditures and the number of packages reimbursed by the National Health Fund (NHF). Fixed base and chain dynamics indices were used in the analysis. Findings: An increase in the expenditure and the number of packages sold in year II was observed for biosimilars. Research limitations/implications: It should be stressed, however, that the article pertains to a single example – the infliximab market, and that numerous other important factors may affect the sales of biosimilars. Niniejszy artykuł jest próbą zaproponowania praktycznych możliwości wykorzystania art. 108 ust. 3 zd. 3 TFUE przez jednostkę w prawie polskim. Autor dokonuje analizy normy prawa unijnego i poszukuje dla niej proceduralnych możliwości jej wykorzystania w prawie polskim jako prawie krajowym państwa członkowskiego Unii Europejskiej, w celu weryfikacji tezy o tym, że prawo polskie nie dostarcza żadnych środków zapewnienia skuteczności art. 108 ust. 3 zd. 3 TFUE. Praca uwzględnia orzecznictwo TSUE i sądów polskich.

This paper constitutes an attempt at suggesting practical means of enforcement of Article 108(3) third sentence TFEU under Polish law. The author undertakes to analyse the norm of EU law and seeks a procedural basis of its enforcement under Polish law (as a law of an EU Member State). The goal is to verify whether there are any means to secure effectiveness for Article 108(3) third sentence TFEU under Polish law. The paper takes account of the jurisprudence of the CJEU as well as that of Polish courts.
Opracowanie poświęcone jest problematyce naruszenia drugiego medycznego zastosowania w świetle systemu refundacyjnego. Inspiracją do napisania artykułu były dwa niedawne rozbieżne orzeczenia sądów obcych. Sądy te rozważały czy sprzedaż leków odtwórczych z oficjalnymi (określonymi na ulotce) wskazaniami do zastosowania w zakresie nieobjętym patentem może zostać uznana za naruszenie patentu dotyczącego drugiego medycznego zastosowania w sytuacji, gdy z okoliczności sprawy wynikało, że leki te były faktyczne stosowane we wskazaniach objętych tym patentem (tj. off-label – poza wskazaniami zarejestrowanymi dla tego leku). Sądy oparły się na odmiennej argumentacji prawnej, co doprowadziło do wydania rozbieżnych rozstrzygnięć. W nawiązaniu do tych orzeczeń zamierzeniem autora opracowania jest udzielenie odpowiedzi na następujące pytanie – czy celowe jest ograniczenie zakresu patentu na drugie zastosowanie medyczne, w przypadku gdy leki oparte na danej substancji podlegają refundacji, w celu zapewnienia szerszego dostępu do tych leków pacjentom.

This paper relates to patent infringements on second medical use in the light of competition law and the reimbursement system. It is inspired by two recent rulings delivered by English and Dutch courts. They have considered whether the sale of generic drugs may be regarded as an infringement of a patent relating to a second medical use (not indicated on the labels) in situations where the facts of the case showed that these drugs have actually been used in a way covered by this patent (ie. off-label use). In the light of these rulings, the main purpose of this paper is to answer the question whether it is appropriate, in the light of competition law, to limit the scope of the patent on second medical use in situations where drugs based on the substance are subject to reimbursement, in order to provide wider access to these drugs to patients.
The new draft Act on Water Law provides for significant changes to the system for collecting environmental charges for water use. Their aim is, on the one hand, to eliminate the existing exemptions from the charges and, on the other hand, to increase their rates for those entities that already incur them. The changes to be introduced are justified by the need to ensure that the principle of recovery of the costs of water services, provided for in Article 9 of Directive 2000/60/EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy, is fully taken into account. Since the principle has not been extensively analysed in the Polish legal literature, the article addresses closely the directions of its interpretations presented in German science. Most of them refer to the dispute between two authors: Herwig Unnerstall and Süleyman Kolcu. In its conclusion, the provisions of the draft Act concerning this principle are assessed on a preliminary basis and the discerned legislative deficiencies are indicated.
The use of donor gametes has become an essential part of assisted reproduction. However, the ethical and legal issues associated with this method of involving third parties in the reproductive process are still debated. One is the tendency to commercialise the whole process, whereby large sums of money are provided to donors of gametes on a reward basis, in addition to other benefits. My intention will be to show that the same situation also prevails in the Czech Republic, where the legal rules for the provision of reimbursement of expenses related to the donation of eggs and sperm are set up in a completely vague manner, which leads to their arbitrary shaping through the practice of reproductive clinics, both in contradiction to human dignity and the universally recognized and legally enshrined requirement of solidarity and altruism.

Využívání pohlavních buněk od dárců se již stalo neodmyslitelnou součástí asistované reprodukce. Stále jsou však diskutovány eticko-právní problémy, které jsou s tímto způsobem zapojování třetích osob do procesu reprodukce spojovány. Jedním z nich jsou tendence ke komercializaci celého procesu, když jsou dárcům pohlavních buněk vedle dalších benefitů poskytovány vysoké finanční částky na principu odměny. Mým záměrem bude ukázat, že stejná situace panuje také v České republice, kde jsou právní pravidla pro poskytování náhrad výdajů spojených s darováním vajíček a spermií nastavena zcela vágním způsobem, což vede k jejich samovolnému dotváření prostřednictvím praxe reprodukčních klinik, a to jak v rozporu s lidskou důstojností, tak všeobecně uznávaným a legislativně zakotveným požadavkem solidarity a altruismu.
Summary The Supreme Administrative Court judgement which is glossed in this article concerns reimbursement due to a patient for medications not normally available in Poland on a reimbursed prescription but admitted in special cases as an individual (targeted) import on the grounds of a central permit. In this judgement the Court ruled that contrary to the literal interpretation of Art. 39 of the Reimbursement for Medications, Special-Purpose Foodstuffs, and Medical Products of 12 May 2011 (Ustawa z dnia 12 maja 2011 r. o refundacji leków, środków spożywczych specjalnego przeznaczenia żywieniowego oraz wyrobów medycznych; Dziennik Ustaw 2016, Item 1536), patients who have a central permit admitting a medication they are taking for individual (targeted) import can claim a reimbursement for their expenses incurred due to the import of the medication. I fully agree with this ruling, especially as it takes a pro-constitutional approach to the interpretation of the provisions on reimbursed medications.

Streszczenie Glosowany wyrok Naczelnego Sądu Administracyjnego dotyczy refundacji leków posiadających tzw. centralne pozwolenie na dopuszczenie sprowadzanych w trybie importu docelowego. W przedmiotowym orzeczeniu, Sąd stwierdził, że wbrew literalnej wykładni art. 39 ustawy z dnia 12 maja 2011 r. o refundacji leków, środków spożywczych specjalnego przeznaczenia żywieniowego oraz wyrobów medycznych (Dz.U. z 2016 r. poz. 1536) możliwa jest refundacja leków posiadających centralne pozwolenie na dopuszczenie do obrotu. Autor w pełni zgadza się z glosowanym wyrokiem, w szczególności wskazując na zasadność stosowania prokonstytucyjnej wykładni przepisów związanych z refundacją leków.
Pierwszy lek biopodobny został zarejestrowany już w 2006 r. Od tego czasu, EMA zdobyła znaczne doświadczenie w ich wykorzystaniu oraz tworzeniu odpowiednich standardów bezpieczeństwa. W maju 2019 r., wyszukiwarka znajdująca się na oficjalnej stronie EMA, pokazała 54 unikatowe leki biopodobne zarejestrowane przez tę instytucję. Substancje biopodobne efektywnie zmniejszają wydatki publiczne, jednak dyskusja na temat ich potencjalnych wad wciąż trwa. Ponieważ EMA nie reguluje tego zagadnienia, każdy kraj w Europie może przyjmować inne przepisy dotyczące zastępowalności, zamiany i zamienności leku referencyjnego przez odpowiadający mu biosymilar. Ponadto każdy kraj ma unikalny system refundacji, który powoduje znaczne różnice w dostępie pacjentów do leków biopodobnych. Potrzeba i korzyści związane ze zwiększeniem dostępności biosymilarów są dobrze rozpoznane przez decydentów i promowane przez wiele europejskich państw. Im lepszy dostęp do tych leków, tym niższe całkowite wydatki na leki i mniejsza potrzeba ich reglamentacji, a zatem lepsze wyniki leczenia. Celem niniejszej publikacji jest porównanie wybranych aspektów refundacji i dostępu leków biopodobnych zatwierdzonych przez EMA w dwóch krajach – Francji i Polsce. W obu omawianych krajach, decydenci postawili sobie jako cel zintensyfikowanie wykorzystania biosymilarów w kolejnych latach. Francja została wybrana jako komparator do polskich standardów jako przykład bogatszego i bardziej rozwiniętego kraju europejskiego. Przeprowadzone badania opierały się na analizie czterech głównych źródeł: bazy danych EMA, polskiej listy refundacyjnej opublikowanej przez polskie Ministerstwo Zdrowia oraz dwóch francuskich baz danych refundacyjnych opublikowanych przez francuskie Ministerstwo Zdrowia. Dodatkowo przeprowadzono przegląd literatury. Otrzymane wyniki koncentrują się na różnicach w liczbie refundowanych leków biopodobnych, średnim czasie między rejestracją EMA a datą rozpoczęcia refundacji oraz dostępności leków biopodobnych zarejestrowanych poza procedurą scentralizowaną (EMA). Wyniki mogą pomóc w identyfikacji potencjalnych obszarów do poprawy, a także wesprzeć dyskusję na temat optymalizacji dostępu do leków biopodobnych. Jest to również dodatkowy krok w stronę francusko-polskiej współpracy w zakresie biosymilarów.

The EU approved the first biosimilar drug in 2006. By 2017, the EU had authorized the highest number of biosimilars worldwide, acquiring considerable experience in their use and safety. In May 2019, the European Medicines Agency (EMA) search engine showed 54 authorized biosimilars. Biosimilars reduce public expenditure; however, the discussion about their potential disadvantages is still ongoing. Each country adopts different regulations on the interchangeability, switching, and substitution of a reference medicine by its biosimilar, since the EMA does not regulate this issue. Additionally, each nation has a unique reimbursement system, which results in significant differences in patients’ access to biosimilars. The importance of securing a higher availability of these cheaper versions of biological drugs is well-recognized. The better the access to these biosimilars is, the lower the overall drug expenditure and need for rationing would be, and therefore the better treatment results. The aim of this paper is to compare selected aspects of reimbursement and access to the EMA authorized biosimilar medicines in two countries – France and Poland. The stated drug policy goal of both countries is to significantly improve biosimilar implementation in the coming years. The research is based on an analysis of four main sources: the EMA biosimilars database, the Polish reimbursement list published by the Polish Ministry of Health, and two French reimbursement databases published by the French Ministry of Health. An additional literature review was conducted. The expected results concentrate on differences in the number of reimbursed biosimilars, the average time between EMA authorization and country reimbursement decision date, and the availability of biosimilars registered outside of the centralized (EMA) procedure. These findings could identify areas of improvement and help with discussions on how to optimize the reach of biosimilars, as well as improve French-Polish collaboration on this matter.
