W odmęcie walki prawa z bezprawiem* – rola adwokata w postępowaniu sądowym

Celem niniejszego artykułu jest przedstawienie zawodu adwokata w kontekście idei towarzyszących ustanowieniu tej profesji oraz jej praktycznego zastosowania. Zarysowując dzieje adwokatury, autor stara się przybliżyć zadania i obowiązki jakim musi sprostać adwokat reprezentując klienta w postępowaniu sądowym. Duży nacisk położony zostaje na wymogi etyczno- -moralne towarzyszące kontaktom z klientem. Autor stanowczo sprzeciwia się pojawiającym się w świadomości społecznej negatywnym wyobrażeniom o członkach palestry.

The aim of this article is to present the profession of advocate in relation to the underlying rationale of this profession and its actual performance. Outlining the history of the legal profession, author discusses the tasks and responsibilities which the advocate has to face while representing his client in court. Strong emphasis has been placed on the professional ethics requirements connected with the relationship between the advocate and his client. In conclusion author does not accept with negative image of advocates in society.

The main polarized contemporary views on cognitive access are discussed in the paper. Symbolic realism, rooted in some respects in Ernst Cassirer’s philosophy of symbolic forms, is proposed as a rivalry to those views. The presented symbolic realism cannot be fitted into the dichotomy realism–antirealism, since it has features of both opposing concepts. It postulates a non-mirroring, constructive character of knowledge, not preserving any ontic elements of reality, and is loaded with epistemic elements, usually attributed only to antirealistic positions.

W pracy dyskutowane są główne współczesne, spolaryzowane stanowiska w kwestii poznawczego dostępu. Proponowany jest konkurencyjny wobec zastanych stanowisk realizm symboliczny, inspirowany filozofią form symbolicznych Ernsta Cassirera. Realizm ten jest granicznie słaby, nie odzwierciedlający, angażujący czynniki epistemiczne. Opowiedzenie się za nim czyni dostęp poznawczy problematycznym, gdyż ambiwalentnym; według niego poznanie odsłania rzeczywistość, ale paradoksalnie, w sposób zakryty, a mianowicie poprzez kreowane symboliczne obrazy poznawcze.
