W polskim prawie najważniejszym aktem prawnym w zakresie praw pacjenta jest ustawa z dnia 6 listopada 2008 r. o prawach pacjenta i Rzeczniku Praw Pacjenta. Cel badań: Ocena poziomu wiedzy lekarzy oraz studentów ostatnich lat medycyny na temat prawa do dostępu do dokumentacji medycznej oraz prawa do ochrony danych zawartych w dokumentacji medycznej. Materiał i metoda: Badania przeprowadzone zostały w okresie 12.03.2013–04.04.2013 r. na grupie 27 lekarzy różnych specjalności oraz 52 studentów ostatnich lat medycyny. Do przeprowadzenia badań wykorzystany został autorski anonimowy kwestionariusz ankiety. Wyniki: Lekarze posiadają większy zasób wiedzy teoretycznej na temat prawa pacjenta do poufności informacji niż studenci ostatnich lat medycyny. Wnioski: Choć lekarze i studenci ostatnich lat medycyny posiadają pewien zasób wiedzy, to wiedza ta wciąż wymaga pogłębienia.

In Polish law, the most important piece of legislation is the Act of 6 November 2008 on the rights of the patient and the patient’s Ombudsman. Aim: The evaluate the knowledge of doctors and final year student of medicine about the rights of patients of access to medical records and the right to the protection of the data contained in medical records. Material and methods: The survey was conducted in the period 12.03.2013-04.04.2013, at a group of 27 doctors of various specialties and 52 :nal year students of medicine. The research was used, an anonymous questionnaire. Results: Doctors have more theoretical knowledge about the patient’s right to con:dentiality of information than medical students. Conclusions: Although doctors and medical students have some knowledge about patients’ rights to condentiality of information is knowledge still requires deepening.
