W niniejszym artykule dokonana została analiza logiczno-semantycznej struktury zdań sformułowanych w języku prawnym z językoznawczego punktu widzenia. Po pierwsze, zbadano jakie elementy służą wyrażaniu znaczenia w tekstach ustawowych. Omówiono następujące elementy normotwórcze: modalność prawnicza, podmiot normy, czyn, warunki stosowania, czas i miejsce, władza normotwórcza i negacja. W drugiej części artykułu dokonano analizy relacji logiczno-semantycznych zachodzących pomiędzy tymi elementami. Zgodnie z teorią Browersa (1989) te relacje logiczno-semantyczne są reprezentowane przez strukturę predykatywno-argumentatywną na różnych poziomach.

This article analyses the logical-semantic structure of legislative sentences from a linguistic point-of-view. First, it is examined which elements constitute the meaning of legislative sentences. The following norm elements will be discussed: legal modality, norm subject, act, conditions of application, time and space, norm authority and negation. In the second part of the article, the logical-semantic relations between these elements are analysed. Following Bowers (1989), these logical-semantic relations are represented in a predicate-argument structure on different levels.

Vom sprachtheoretischen, der generativen Linguistik verpflichteten Konzept der Kontrolle (engl. control) ausgehend, wo Infinitiven die tiefenstrukturelle semantische Rolle des Subjekts zugewiesen wird, ohne dass sie syntaktisch besetzbar ist, wird in dem Aufsatz postuliert, auch eine Tempuskontrolle (tense control) anzusetzen, die für eine Korreferenz zwischen den jeweiligen grammatischen Tempusformen und dem realen Zeitbezug verantwortlich ist. An Korpusbelegen wurde gezeigt, dass von der so angesetzten hypothetischen Tempuskontrolle vorzugsweise das Polnische Gebrauch macht, was insofern einleuchtet, als das Deutsche dank des Reichtums an Tempusformen ohne diesen Zusatzmechanismus auskommen kann. Auf die Tempuskontrolle kann im Deutschen lediglich dort geschlossen werden, wo Indikativ und Konjunktiv aufeinander treffen, also in erster Linie in der indirekten Rede und in den hypothetischen Komparativsatzgefügen.

Starting from the concept of generative control, allowing for the allocation of semantic role of the subject in related infinitive groups without the possibility of syntactic realization of the role, the author postulates the introduction of the concept of hypothetical tense control responsible for the coreference of time forms with the real time. Based on examples from the body of research one points to the need or legitimacy of such a category of research - especially in relation to the Polish language. It is very reasonable because the directory forms of time in both languages are significantly different - with a clear numerical superiority in German. This fact causes that the Polish language needs therefore support in the implementation of the mentioned coreference on syntactic level, while German realizes it on the morphology plane. In German, the need to postulate tense control can be seen only where the indicative and the subjunctive come together, i.e. mainly in the indirect speech and the hypothetical comparative sentences.

Wychodząc od generatywnej koncepcji kontroli (control), pozwalającej na przydział semantycznej roli podmiotu w powiązanych dependencyjnie grupach bezokolicznikowych bez możliwości składniowej realizacji tej roli, postuluje się wprowadzenie pojęcia hipotetycznej tense control odpowiedzialnej za koreferencję form czasowych z czasem realnym. W oparciu o przykłady z korpusu badawczego wskazuje się na potrzebę czy też zasadność takiej kategorii badawczej – szczególnie w odniesieniu do języka polskiego. Jest to o tyle uzasadnione, że katalog form czasowych w obydwu językach znacznie się różni – z wyraźną przewagą liczebną w języku niemieckim. Ten fakt sprawia zatem, że język polski potrzebuje wsparcia w realizacji wspomnianej koreferenci na płaszczyźnie składniowej, podczas gdy język niemiecki realizuje to już na płaszczyźnie morfologicznej. W języku niemieckim potrzebę postulowania tense control widać jedynie w miejscach spotykania się trybu oznajmującego i przypuszczającego, tj. głównie w mowie zależnej i w hipotetycznych zdaniach porównawczych.

Conceptual metaphors in linguistic metalanguage – Polish case names

Polish linguistic metalanguage comprises some terms of figurative character, apparently determined by metaphorical thinking, i.e. by construing one, abstract notion in terms of another, more concrete, accessible to sensory perception. Some of these terms are calques from Latin and preserve the mappings involved therein, but otherwise more refined and independent inspirations behind the names of linguistic categories can be recognized, especially in regard to the terms for the seven Polish cases.

Dans le dictionnaire de la terminologie linguistique utilisée en polonais, on peut remarquer des mots à caractère figuratif dont la signification semble s’appuyer sur le procédé métaphorique, c’est-à-dire sur la construction de la conception d’un phénomène abstrait avec une conception d’un phénomène plus concret, perceptible par les sens. Certains de ces termes ont été calqués du latin avec leurs valeurs métaphoriques de départ, d’autres ont été créés, paraît-il, à partir des associations métaphoriques originales qui n’avaient pas été copiées ou qui avaient été développées de manière novatrice. Cela concerne surtout les noms des sept cas polonais.

W słowniku terminologii lingwistycznej używanej w języku polskim rozpoznać można wyrazy o charakterze figuratywnym, których znaczenie wydaje się być oparte na myśleniu metaforycznym, tj. na budowaniu koncepcji zjawiska abstrakcyjnego w oparciu o inną koncepcję, zainspirowaną zjawiskiem bardziej konkretnym, poznawalnym za pośrednictwem zmysłów. Niektóre z takich terminów zostały przekalkowane z łaciny z zachowaniem oryginalnych odwzorowań metaforycznych, jednak są też takie, które, jak się wydaje, zostały utworzone na podstawie oryginalnych, nieskopiowanych lub nowatorsko rozwiniętych skojarzeń metaforycznych. Dotyczy to szczególnie nazw większości z siedmiu polskich przypadków.
