Sprawa Romana Gawronskiego przed Sądem Specjalnym w Katowicach jako przykład zmiany prawomocnego wyroku

The article analyses a criminal case before a German Special Court in Katowice in 1943. The valid and binding decision was successfully appealed by a prosecutor resorting to a an extraordinary legal remedy, complaint caused by the invalidity of such a sentence. In the first trial, Roman Gawronski was convicted of illicit trading and theft, and sentenced to a total of 12 years hard labour. After a complaint lodged by the prosecutor, the Special Court in Katowice issued the correct sentence, being the death penalty. The article examines the legal foundations of both rulings and arguments of the prosecutor supporting the invalidation of a final judgment. It also provides an overview on the structure and procedure in the special courts.

Artykuł analizuje sprawę karną zawisłą przed niemieckim Sądem Specjalnym w Katowicach w 1943 r. Jej cechą charakterystyczną jest fakt, że zapadłe orzeczenie zostało skutecznie zaskarżone przez prokuratora nadzwyczajnym środkiem prawnym – skargą z powodu nieważności. W ramach pierwszej rozprawy Roman Gawronski został skazany za pokątny handel i kradzież na karę łączną 12 lat ciężkiego więzienia. Po wniesieniu skargi przez prokuratora Sąd Specjalny w Katowicach wydał właściwy wyrok: karę śmierci. W artykule przeanalizowano rozważania prawne obu wyroków oraz argumentację prokuratora przemawiającą za uchyleniem prawomocnego wyroku. W zarysie przedstawiono także ustrój oraz postępowanie przed sądami specjalnymi.

The article concerns the activity of the Special Court in Częstochowa (Sondergericht Tschenstochau) between 1939 and 1945, i.e. one of the German special courts operating in the territory of the General Government. Tackling this topic is justified by a lack of even fragmentary findings in this area. Accordingly, the aim of the research was to make basic findings: what types of cases were dealt with by the Sondergericht; what was the nationality of the majority of the defendants; what sentences were handed out to them; was the death penalty pronounced, and if so, when; who led the work of the Sondergericht, what judges were its members and what prosecutors participated in the hearings at the Sondergericht, where did the lawyers involved in the work of the Sondergericht come from, were its judicial decisions challenged by extraordinary legal measures. Archival materials, literature, and media articles constitute the sources which served as the basis for the deliberations. On this basis, original and hitherto unknown findings concerning the Special Court in Częstochowa were made.

Artykuł dotyczy działalności Sądu Specjalnego w Częstochowie (Sondergericht Tschenstochau) w latach 1939–1945, tj. jednego z niemieckich sądów specjalnych funkcjonujących na obszarze Generalnego Gubernatorstwa. Podjęcie tego tematu jest uzasadnione brakiem nawet fragmentarycznych ustaleń w tym obszarze. W związku z tym celem badań było poczynienie podstawowych ustaleń: jakiego rodzaju sprawy były rozpatrywane przez Sondergericht, oskarżeni jakiej narodowości przeważali, na jakie kary byli skazywani, czy i w jakich sprawach orzekano karę śmierci, kto kierował pracami Sondergerichtu, jacy sędziowie byli jego członkami i jacy prokuratorzy brali udział w rozprawach przed Sondergerichtem, skąd pochodzili prawnicy zaangażowani w prace Sondergerichtu, czy jego orzeczenia były wzruszane na drodze nadzwyczajnych środków prawnych. Podstawę źródłową rozważań stanowią archiwalia, literatura oraz prasa. Na tej podstawie poczyniono oryginalne, nieznane dotychczas ustalenia dotyczące Sądu Specjalnego w Częstochowie.

The article presents the state of research on the activity of the Special Court in Piotrków and the source basis. It discusses when the special court was established - originally in Wieluń - and its transfer to Piotrków. Also, the article depicts the organization and changes in its formal location as well as the staffing of the court, thus updating the data presented in the literature by J. Góral and M. Uzdowski. In a similar way, based on a new source basis, the statistics of defendants and those convicted by the Special Court in Piotrków are presented. Based on data from the literature, previously unknown criminal case files from the Federal Archives in Berlin and the GG press, the minimum number of people sentenced to death has been calculated. Some of the most interesting cases of judicial practice are described, including, above all, cases of helping Jews.

W artykule zaprezentowano stan badań nad działalnością Sądu Specjalnego w Piotrkowie oraz podstawę źródłową. Omówiono moment utworzenia sądu specjalnego – pierwotnie w Wieluniu – oraz przeniesienie siedziby do Piotrkowa. Przedstawiono jego organizację i zmiany w formalnym usytuowaniu. Przedstawiono obsadę kadrową sądu, aktualizując dane prezentowane w literaturze przez J. Górala i M. Uzdowskiego. W podobny sposób, w oparciu o nową podstawę źródłową, zaprezentowano statystykę oskarżonych i skazanych przez Sąd Specjalny w Piotrkowie. Na podstawie danych z literatury, nieznanych wcześniej akt spraw karnych z Archiwum Federalnego w Berlinie oraz prasy GG obliczono minimalną liczbę osób skazanych na karę śmierci. Opisano kilka najciekawszych przypadków praktyki sądowej, w tym przede wszystkim sprawy o udzielanie pomocy Żydom.

The two-part study concerns the so-called “September crimes” (i.e. the actions of Poles on grounds of nationality against Germans after the outbreak of World War II) in the jurisprudence of the Special Court in Katowice (Sondergericht Kattowitz).The second part of the study concerns “September crimes” directed against health and freedom. The criminal proceedings in these matters were discussed in detail. Particular attention was paid to the arrangements described in the indictment and the findings of the evidentiary proceedings before the court. The circumstances taken into account by the court in assessing particular evidence and legal qualification were presented. In the summary, the results of the Sondergericht Kattowitz case studies in cases related to September accidents were compared to the case law of the Special Court in Bydgoszcz. This comparison showed that both the size of the sentence, as well as the manner and quality of the proceedings by the Sondergericht Kattowitz significantly differed from the Bydgoszcz court. As a consequence, none of the analyzed cases was classified as a judicial crime.

Dwuczęściowe opracowanie dotyczy „przestępstw wrześniowych”, tj. wystąpień Polaków na tle narodowościowym przeciwko Niemcom po wybuchu II wojny światowej, w orzecznictwie Sądu Specjalnego w Katowicach (Sondergericht Kattowitz). W drugiej części opisano przestępstwa przeciwko zdrowiu oraz wolności. W sposób szczegółowy omówiono postępowania karne w tych sprawach. Szczególną uwagę zwrócono na ustalenia opisane w aktach oskarżenia oraz ustalenia postępowania dowodowego prowadzonego przed sądem. Przedstawiono okoliczności brane pod uwagę przez sąd przy ocenie poszczególnych dowodów oraz kwalifikację prawną czynów. W podsumowaniu odniesiono uzyskane wyniki badań orzecznictwa Sondergericht Kattowitz w sprawach o wypadki wrześniowe do orzecznictwa Sądu Specjalnego w Bydgoszczy. Porównanie to wykazało, że zarówno wymiar kary, jak i sposób oraz jakość procedowania przez katowicki sąd specjalny znacząco różniły się od sądu bydgoskiego. W konsekwencji żadnej z analizowanych spraw nie zakwalifikowano jako zbrodni sądowej.

The two-part study concerns the so-called “September crimes” (i.e. the actions of Poles on grounds of nationality against Germans after the outbreak of World War II) in the jurisprudence of the Special Court in Katowice (Sondergericht Kattowitz). The general statistics of “September crimes” judged by Sondergericht were divided into three categories: crimes against life, crime against health and crimes against freedom. In the first part of the study an analysis of proceedings in cases concerning “September crimes” against life was conducted. Particular attention was paid to the quality of the evidentiary proceedings conducted by the court, the legal and factual presumptions used, the consideration of the credibility of particular evidence and the legal classifi cation of crimes. The first part of the study also discusses the jurisprudence of other special courts operating in Poland in these matters, first of all the Special Court in Bydgoszcz (Sondergericht Bromberg). In outline, war activities in Upper Silesia at the beginning of September 1939 were also presented, with particular reference to places where “September crimes” took place, which then came under the judgment of the Sondergericht Kattowitz.

Dwuczęściowe opracowanie dotyczy tzw. przestępstw wrześniowych, tj. wystąpień Polaków na tle narodowościowym przeciwko Niemcom po wybuchu II wojny światowej, w orzecznictwie Sądu Specjalnego w Katowicach (Sondergericht Kattowitz). W pierwszej części zaprezentowano ogólną statystykę przestępstw wrześniowych osądzonych przez Sondergericht Kattowitz z podziałem na trzy kategorie: przestępstw skierowanych przeciwko życiu, przeciwko zdrowiu oraz przeciwko wolności – i przeprowadzono analizę postępowań w sprawach o przestępstwa przeciwko życiu. Szczególną uwagę zwracano na jakość postępowania dowodowego prowadzonego przez sąd, stosowane domniemania prawne i faktyczne, rozważania nad wiarygodnością poszczególnych dowodów oraz kwalifi kację prawną czynów. W zarysie przedstawiono również orzecznictwo innych sądów specjalnych działających na ziemiach polskich w tych sprawach, przede wszystkim Sądu Specjalnego w Bydgoszczy (Sondergericht Bromberg), oraz omówiono działania wojenne na Górnym Śląsku na początku września 1939 r. – ze szczególnym uwzględnieniem tych miejsc, w których doszło do przestępstw wrześniowych, które następnie trafiły do katowickiego sądu specjalnego.
