The opening of Circuit Court in Wadowice took place in May 1882 and it constituted collective first tier tribunal for criminal and civil cases and appeal instance for decisions of District Courts. This compilation completes current state of research of the court. The creation of the tribunal in Wadowice was preempted by long-term efforts of numerous institutions and individuals. Apart municipal representation of Wadowice, the creation of circuit court was the subject of work in National Sejm in Lviv, with commitment of court and district authorities and representatives of neighboring communes. Consequently, the emperor Franz Josef granted the creation of circuit court in Wadowice. In the following years, the sources for financing court premises were searched for and the talks with Ministry of Justice and authorities of Kraków’s Appeal Court were held. Upon its completion in 1879 by the ordinance of the Minister of Justice Wadowice was granted with new first tier tribunal. The grand opening, following ongoing construction period, took place three years later. With establishing of Circuit Court in Wadowice, the formerly filled court personnel followed. Foremost it consisted of justiciary and office workers. The compilation presents brief biographical notes of the Court Presidents and ruling Counselors at Law since the creation of the tribunal in 1899. In addition, The Law Society of Wadowice was mentioned, without doubt the creation of which followed the establishing of the Tribunal. It was the first professional association of lawyers.
Status prawny sędziów, oparty na zapewnieniu im niezawisłości oraz niezależnego funk-cjonowaniu sądów stanowi podstawowy atrybut wymiaru sprawiedliwości, przesłankę i gwarancję zarazem urzeczywistnienia zasady demokratycznego państwa prawnego. Nie inaczej jest na gruncie systemu konstytucyjnego Finlandii. Cel niniejszego opracowa-nia stanowi poddanie analizie statusu prawnego sędziów w Finlandii. Przedmiot anali-zy obejmuje zbadanie kwalifikacji wymaganych dla kandydatów na stanowiska sędziów, procedury ich powoływania i odwoływania oraz atrybuty realizacji ich niezależnego i niezawisłego statusu. Analiza prawna została przeprowadzona w oparciu o postanowie-nia Ustawy Zasadniczej z 1999 r. w zakresie statusu sędziów oraz przepisy stosownych ustaw o sądach i powoływaniu sędziów. Badanie to pozwoliło na stwierdzenie, że po-wyższe gwarancje umożliwiają obiektywne i bezstronne funkcjonowanie sądownictwa w Finlandii w zgodzie z zasadą demokratycznego państwa prawnego, gdyż w zakresie orzekania sądy są w pełni niezależne i niezawisłe oraz nie podlegają kontroli państwa, a orzeczenia sądowe są ostatecznym środkiem gwarantującym stronom poszanowanie ich praw w stosunkach z państwem.

The legal status of judges, based on ensuring their autonomic and independent func-tioning, is a fundamental attribute of the system of justice, a prerequisite and a guaran-tee of the implementation of the principle of a democratic legal state. It is not different in the Finnish constitutional system. The aim of this study is to analyze the legal status of judges in Finland. The subject of the analysis covers the examination of the qualifica-tions required from candidates for the post of a judge, the procedures for their appoint-ment and dismissal, and the attributes of the realization of their autonomic and inde-pendent status. The legal analysis has been conducted on the grounds of the provisions of the Basic Law of 1999 regarding the status of judges and the provisions of the rele-vant laws on courts and the appointment of judges. This study allowed to conclude that the above guarantees enable the objective and impartial functioning of the judiciary in Finland in accordance with the principle of a democratic state ruled by law, as in terms of adjudication courts are fully autonomic and independent and are not subject to state control, while court judgments are the last resort guaranteeing parties respect for their rights in relations with the state.
Celem artykułu jest analiza czynników, które mają wpływ na efektywność sędziego mierzoną liczbą załatwionych spraw, oraz związku pomiędzy efektywnością sędziego a otrzymywanym przez niego wynagrodzeniem. W tym celu przeprowadzono badania wśród sędziów sądów rejonowych i sądu okręgowego (jednego z największych okręgów w Polsce). Analiza wyników badań wskazuje, że wysokość wynagrodzenia i stabilizacja stosunku pracy są głównymi czynnikami wyboru drogi zawodowej. Osiągnięcie tego celu powoduje, że wynagrodzenie nie jest czynnikiem istotnym przy określeniu efektywności sędziego rozumianej jako liczba załatwionych spraw. Sędzia monitoruje swoją załatwialność i zależy mu na wynikach ilościowych, ale czyni to z innych pobudek niż wynagrodzenie. Jak się wydaje, takimi podstawowymi pobudkami są poczucie wypełnianej misji oraz należycie wypełnianego obowiązku.

The goal of this paper is the analysis of the factors influencing the efficiency of a judge measured against the number of cases heard and the relation between the efficiency of a judge and their remuneration. To do so, a study has been conducted among judges of district courts and a regional court in one of the largest regions in Poland. The analysis of this research shows that the level of remuneration and work stabilization are the most important when choosing the profession. Achieving this goal makes the remuneration unimportant when defining the efficiency of a judge understood as a number of cases heard. The judge monitors the number of cases heard and focuses on quantitative results due to other reasons than the remuneration. The fundamental reasons are: the sense of the mission completed and the duty done.
The purpose of this paper is to explain legal problems concerning the judicial retirement benefit and judicial survivors benefit. The paper contains a few critical arguments against retaining the latter benefit in the current form.

The article presents the powers of the National Council of the Judiciary of Poland in terms of their potential impact on the implementation of the principle of the independence of judges and independence of courts. During the initial analysis of legal regulations of individual competences of the Council the author attempts to assess their potential impact or lack thereof on the implementation of art.186 of the Constitution. This may be a contribution to the evaluation of the National Council of the Judiciary of Poland and its relations with other state authorities.

W trakcie wstępnej analizy regulacji prawnych poszczególnych kompetencji Rady starano się ocenić ich potencjalny wpływ bądź jego brak na realizację art. 186 Konstytucji RP. Może to być przyczynkiem do oceny działalności Krajowej Rady Sądownictwa i jej relacji z pozostałymi władzami państwowymi.
L’auteur du présent article se pose pour but d’apporer la résponse à une question qui continue d’être l’objet de controverse: des mots tels que ʽădat-ʼel, ělōhîm ou benê eliōn doivent-ils être interprétés littéralement, dans lequel cas ils signifieraient les dieux des paiens, ou parlent-ils, de façon métaphorique, des juges injustes? Ayant examiné, de façon critique, l’interprétation littérale et se basant sur des textes tels que Ex. 21, 6 et 22, 7, Ex. 18, 13-27, Deut. 1, 9-18 et sur le Psaume 45, 7, l’auteur penche pour Interprétation métaphorique. L’analyse du contenu du Psaume 82 semble confirmer une telle opinion. Cependant, dans la représentation du jugement de Jahw e sur les juges injustes, l’auteur du Psaume 82 se servit de quantité d’images de mythologie autre qu’israélienne pour évoquer l’apparition future de Jahwe jugeant l’lsraël.
The following study is dedicated to individuals, who held the positions of presidents and ruling legal counsels of the District Court for Rzeszów at the time period of 1855–1891. At the beginning, to provide a better understanding of the topic, a general overview of the judiciary system of Galicia introduced in 1855 was presented,with expanded structure of positions and ranks of court officials. The study focuses only on the judges – legal counsels who were professionally bound with Rzeszów. Based on the available information, the study not only introduces the professional career paths of the sequentially presented judges, but also their engagement in local communities’ matters considering autonomous institutions, social organizations, charities and political parties.

Opracowanie poświęcone jest osobom, które w zakreślonej cezurze lat 1855– 1891 pełniły urząd prezydentów oraz radców orzekających w Sądzie Obwodowym w Rzeszowie. Na wstępie, dla lepszego zrozumienia tematu, przedstawiono w zarysie organizację sądownictwa w Galicji, jaka wprowadzona została w 1855 r. oraz rozbudowaną strukturę stanowisk i rang urzędników sędziowskich. Praca obejmuje jedynie tych sędziów – radców, którzy zawodowo związani byli z Rzeszowem. Na podstawie dostępnych informacji przedstawiona została nie tylko ścieżka kariery zawodowej omawianych kolejno sędziów, ale również ich zaangażowanie w sprawy lokalnych społeczności na gruncie instytucji autonomicznych, organizacji społecznych, charytatywnych i stronnictw politycznych.
The aim of article is analysis of judges salary situation in Poland in 2002–2012 y. The basis on analysis is average salary in economy, in other professions and in other countries in EU. As a result of analysis is verification two hypothesis, based on judges opinion: salary of judges are too low and don’t adequate to status of judges office, and that judges in Poland belong to worst paying judges in EU. As a result of changes in salary rules in 2008 y. judges salary increase above 20%. As a result this changes, currently judges salary is higher than salary in other professions from higher education. Judges salary in Poland with relation to average salary in economy is similar to relation in other countries in EU. Analysis don’t confirm pessimistic judges opinion about too low salary.

Celem artykułu jest analiza sytuacji płaowej sędziów w Polsce w latach 2002–2012. Podstawą analizy jest płaca przeciętna w gospodarce, płaca innych zawodów oraz płaca sędziów w innych krajach UE. W wyniku analizy dokonano weryfikacji dwóch hipotez opartych na opinii sędziów: że wynagrodzenia sędziów są zbyt niskie i nie odpowiednie do godności urzędu oraz że sędziowie w Polsce należą do najgorzej wynagradzanych w krajach UE. W wyniku zmiany zasad wynagradzania sędziów w 2008 r. ich wynagrodzenia wzrosły o ponad 20%. Dzięki tym zmianom obecnie wynagrodzenia sędziów są wyższe od pozostałych zawodów wymagających wykształcenia wyższego. Relacje wynagrodzeń sędziów w Polsce do przeciętnego wynagrodzenia w gospodarce są zbliżone do relacji w innych krajach UE. Analiza nie potwierdziła więc pesymistycznych opinii sędziów o zbyt niskich płacach.
The research issues which Marta Paszek is interested in are an extremely important aspect in the history of the system and law of the People's Republic of Poland. The historiography to date relating to the military judiciary at that time is definitely dominated by publications discussing trials that bore all the rules of lawful procedure. The viewpoint of these works is (quite rightly so) to present the martyrdom of the defendants, to quote draconian sentences and the fate of the convicted. Marta Paszek's monograph of course takes these issues into account, but the author has significantly expanded the scope of her research, which should be considered the right direction. The review article is an attempt to discuss the structure of the monograph, to evaluate the sources used, to analyse the value and appropriateness of the content of individual chapters, as well as changes to the doctoral dissertation defended in May 2018. It also assesses the legitimacy of undertaking the subject of analysis of the activities of the Military District Court in Katowice and the need to publish the same monograph in terms of the needs of historical and legal sciences and the proper exhaustion of the subject by the author. The evaluations of other entities, such as other reviewers, the Council of the Faculty of Law and Administration of the University of Silesia in Katowice and the Institute of Justice were also noted.

Problematyka badawcza, którą zainteresowała się Marta Paszek to niezwykle ważny aspekt w historii ustroju i prawa Polski Ludowej. W dotychczasowej historiografii odnoszącej się do ówczesnego sądownictwa wojskowego zdecydowanie dominują publikacje omawiające procesy urągające wszelkim zasadom praworządnej procedury. Optyką tych prac (zupełnie słuszną) jest przedstawianie martyrologii podsądnych, przytaczanie drakońskich wyroków, losów osób skazanych. W monografii Marty Paszek uwzględnione zostały oczywiście te kwestie, ale Autorka znacznie rozszerzyła zakres swoich badań, co należy uznać za właściwy kierunek. Artykuł recenzyjny stanowi próbę omówienia struktury monografii, oceny wykorzystanych źródeł, analizy wartości i adekwatności treści poszczególnych rozdziałów, a także zmian w stosunku do bronionej w maju 2018 r. rozprawy doktorskiej. Ocenie poddano również zasadność podjęcia tematyki analizy działalności Wojskowego Sądu Rejonowego w Katowicach oraz potrzebę publikacji tejże monografii pod kątem potrzeb nauk historyczno prawnych oraz należytego wyczerpania tematu przez Autorkę. Zauważono również oceny innych podmiotów, takich jak pozostali recenzenci, Radę Wydziału Prawa i Administracji Uniwersytetu Śląskiego w Katowicach czy Instytut Wymiaru Sprawiedliwości.
One of the established standards of modern democratic countries is the apoliticality of judges. This standard is also referred to by the Constitution, which has been in force in Poland since 1997, which prohibits judges from belonging to political parties and trade unions, as well as from conducting public activities incompatible with the principles of the independence of courts and judges. However, in political practice the issue of apoliticality of Polish judges raises disputes regarding detailed matters, which in connection with statutory changes concerning the judiciary, in particular in recent years, have been gaining momentum. These disputes partly result from the not completely clear nature of the constitutional provisions, which refer to the principle of apoliticality of judges, but partly also from the wrong perception of this constitutional principle by some. The purpose of this article is to attempt to present the basic issues related to these problems in the context of applicable constitutional norms.
The story about Jephthah is placed in the middle of the Book of Judges (Judges 10:6-12:7). Therefore we recognise in this figure an important link in the quest for the model of a ruler in the period of pre-monarchic Israel. In order to reconstruct the image of Jephthah as a leader the method of narration has been applied. The narrative programme has confirmed that Jephthah, while seeking to find a solution for the crisis of power, became the paradigm of a ruler. In the light of narrative techniques used by the narrator, Jephthah fails as a paradigm, for he loses his daughter and he is seen by the generation of Ephraim as an unfulfilled ruler. There are three reasons at the source of his unfulfilled power: treating power as a means to satisfy one’s ambition; rejecting power as a service on behalf of the good of his subjects; eventually, no roots in the tradition, history, and religion of the fellowship in which is he to govern.
This draft position of the Sejm concerns the constitutional complaint of 13th August 2015. In the proposed draft position the author claims that the Article 107 paragraph 1 of the Act of 27th July 2001 – the Law on the System of Common Courts is in compliance with the Article 42 para. 1 sentence no. 1 in conjunction with the Article 2 of the Constitution. The author states that the challenged provision does not infringe the principle of specificity of law, and that the nullum crimen sine lege principle is applicable to the disciplinary proceedings only in a suitable way. Moreover, he claims that in the remaining scope of the complaint the proceedings should be discontinued pursuant to Article 40 para. 1 subpara. 1 of the Act on the Constitutional Tribunal due to the inadmissibility of the judgment.
W artykule podjęto próbę analizy pojęć niezawisłości sędziów, niezależności sądów oraz bezstronności sądu. Przedstawiono uregulowania prawne oraz wykładnię sądów i trybunałów na poziomie krajowym i europejskim posiłkując się przy tym poglądami doktryny. Celem opracowania jest zaproponowanie uporządkowania narracji w przedmiocie rozumienia wskazanych terminów – na podstawie dotychczasowej judykatury. Terminy „niezawisłość”, „niezależność” i „bezstronność” są nie tylko doniosłe teoretycznie i praktycznie, ale obecnie żywo dyskutowane i nic nie wskazuje na to, aby w najbliższym czasie uległo to zmianie. Rozważenie znaczenia terminów i zaproponowanie ich rozgraniczenia niesie za sobą konsekwencje dla funkcjonowania całego systemu prawa.

The article deals with an issue of understanding of the concepts indicated in the title which are subject of interpretation of courts and tribunals at a national and European level. The aim of the analysis is to find out how the above phrases are understood and to propose a way to organize them. The proper meaning of the terms: “independence”, and “impartiality” is not only theoretically and practically significant, but is also currently under discussion. The consideration of these terms is therefore of fundamental importance for the functioning of the entire legal system.
Professor Ernest Till, the founder of the Lwów Private Law School and a longtime publisher and editor of the ‘Law and Administration Review’ [PPiA], was not only an outstanding legal scholar, an author of the only system of private law (seven-volume) at that time, but also a highly respected legal practitioner – a barrister running a large law firm. His opinion counted among scholars, practitioners, and codifiers as well. It is not without reason that in 1919 he became one of the most important and active members of the Codification Commission of the Republic of Poland, to whom we owe the Code of Obligations of 1933. Ernest Till repeatedly spoke on issues relating to the education of lawyers, including the curriculum of legal studies, the system of the Bar and the judiciary. In Professor Till’s vast printed scientific output of several hundred works, two statements concerning the training of judicial candidates are available. The first, entitled ‘The Reform of the Judge’s Education’, was published in the PPiA in 1891, and the second – the result of a paper and discussions held at the Legal Society in Lviv – in 1905. We reprint this statement the spelling has been slightly updated.

Twórca lwowskiej szkoły prawa prywatnego i wieloletni wydawca i redaktor „Przeglądu Prawa i Administracji” (PPiA) prof. Ernest Till, był nie tylko wybitnym uczonym jurystą, autorem jedynego w tamtym czasie systemu prawa prywatnego (siedmiotomowego), ale także bardzo cenionym praktykiem prawa – adwokatem prowadzącym rozległą kancelarię. Jego głos liczył się wśród uczonych, praktyków, ale także kodyfikatorów. Nie bez powodu w 1919 r. został jednym z najważniejszych i najaktywniejszych członków Komisji Kodyfikacyjnej RP, któremu zawdzięczamy Kodeks zobowiązań z 1933 r. Ernest Till wielokrotnie wypowiadał się w kwestiach dotyczących kształcenia prawników, w tym programu studiów prawniczych, ustroju adwokatury i sądownictwa. W ogromnym, liczącym kilkaset pozycji, drukowanym dorobku naukowym prof. Tilla zachowały się wypowiedzi w przedmiocie kształcenia kandydatów na sędziów. Pierwsza pt. Reforma wykształcenia sędziego, ukazała się w PPiA w 1891 r., druga będąca pokłosiem referatu i dyskusji przeprowadzonych w Towarzystwie Prawniczym we Lwowie – w roku 1905. Przedrukowujemy tę wypowiedź, w której uczony podejmuje nie tylko kwestie dotyczące kształcenia sędziego, ale też istoty władzy sądowniczej w przeszłości, w teraźniejszości oraz w przyszłości. Dokonano jedynie minimalnej ingerencji w ortografię.
W artykule przybliżono i poddano analizie poglądy papieża Franciszka na temat świeckiego wymiaru sprawiedliwości. Przedstawiono wskazania, postulaty czy oczekiwania papieża odnośnie do sędziów i procesu orzeczniczego. Wskazano również te zjawiska i praktyki, które w nauczaniu papieskim zostały uznane za sprzeniewierzające się etosowi sędziego i roli judykatywy. Omówiono podnoszone przez Franciszka wyzwania, przed jakimi stoją współcześnie sądy, w szczególności problem aktywizmu sędziowskiego oraz zagrożeń dla niezależności trzeciej władzy i jej reprezentantów. Ponadto porównawczo nawiązano do zapatrywań poprzedników Franciszka na kwestię sądownictwa. W ocenie autora papieskie nauczanie stanowi źródło wartościowych uwag w przedmiocie sądów i sędziów, zasługując na szerszy rezonans w środowisku prawniczym w ramach tzw. zewnętrznej integracji prawoznawstwa.
Terapeutyczna Jurysprudencja (TJ) miała wpływ na sądownictwo oraz praktykę prawniczą, ponieważ można w ostatnich latach zaobserwować powstawanie sądów specjalnych (problem-solving courts). TJ w rozumieniu Davida B. Wexlera, to podejście łączące doświadczenia z wielu dziedzin naukowych, stanowiące interdyscyplinarny obszar badań, który koncentruje się na terapeutycznych i antyterapeutycznych skutkach prawa, procedur prawnych oraz ról jakie odgrywają legal actors – między innymi sędziowie, prokuratorzy czy pracownicy wymiaru sprawiedliwości. Rola, jaką odgrywają oni w trakcie procesu, jest w tej teorii szczególnie podkreślana w kontekście wywoływania zarówno pozytywnych, jak i negatywnych konsekwencji dla uczestników procesu. Celem tego artykułu jest rekonstrukcja rozumienia empatii i jej roli w TJ oraz pokazanie, jak pojęcie empatii jest rozumiane w kontekście pracy sędziego, szczególnie w odniesieniu do głównych autorów TJ, Davida B. Wexlera i Bruce J. Winicka.

Therapeutic jurisprudence (TJ) has had a influence on the judiciary and legal practice given the emergence of special courts, the so-called problem-solving courts. As understood by David B. Wexler, TJ is an approach that combines experience from many scientific fields, constituting an interdisciplinary field of research that focuses on the therapeutic and antitherapeutic consequences of laws, legal procedures, and the roles and behaviours of legal actors such as lawyers and judges. The role that they play during a trial is particularly emphasized in this theory in the context of causing both positive and negative consequences for those participating in the trial. The first purpose of this paper is to reconstruct the understanding of empathy and its role in the therapeutic jurisprudence, and to show how the concept of empathy is understood in the context of a judge’s work, particularly in relation to main TJ authors, David B. Wexler and Bruce J. Winick.
Sąd Biskupi w Lublinie funkcjonował nieprzerwanie nawet podczas okupacji niemieckiej, zapewniając tym samym wiernym prawo i możliwość uregulowania swojego życia sakramentalnego. Wśród pracowników Sądu w omawianym okresie (1939-1944) aż jedenastu było absolwentami lub pracownikami Wydziału Prawa Kanoniczego Katolickiego Uniwersytetu Lubelskiego. Wszyscy uzyskali stopień licencjata, a sześciu z nich tytuł doktora prawa kanonicznego. Dobrze wykształceni, posiadający odpowiednie kwalifikacje moralne, zajmowali różne urzędy – od notariuszy do wiceoficjałów. Okres II wojny światowej był szczególnie trudnym czasem dla pracowników Kurii i Sądu. Już pod koniec 1939 r. rozpoczęły się aresztowania. Część z pracowników Trybunału poniosła śmierć w obozach koncentracyjnych. Ci, którym udało się przeżyć wojnę, kontynuowali pracę w Sądzie, a także pracę dydaktyczną na KUL-u. Byli nie tylko gorliwymi kapłanami, ale także oddanymi pracy naukowej wychowawcami młodych pokoleń.

Bishop Court in Lublin operate continuosly even during the German occupation, thus ensuring the faithul right and ability to regulate their sacrament life. Among the ministers of the Tribunal during the period (1939-1944) 11 were graduates or employees in Faculty of Canon Law at the Catholic Univesity of Lublin. All they received the licenciate of canon law, six of them received juris doctor degrees. They were well educated, had appropriate moral qualifications, and they performed a varius function – notary to vice – officiales. The World War II was particularly difficult time for ministers of the Curia and Tribunal. At the end of 1939 began the arrests. Part of the ministers of the Court died in concetration camp. Those who managed to survive the war, continued the work of the Tribunal, as well as teaching job on the Catholic University of Lublin. They were not only zealous priests, but also the educators of young generations and putting scientific work.
Dnia 4 listopada 2021 r. do Marszałka Sejmu wpłynęły przedstawione przez Prezydenta RP projekty ustaw: projekt ustawy o sądach pokoju oraz projekt ustawy – Przepisy wprowadzające ustawę o sądach pokoju. Proponowane w projektach zmiany zakładają utworzenie sądów pokoju, w których zadania z zakresu wymiaru sprawiedliwości wykonywać będą sędziowie pokoju. Sądy pokoju mają mieć – obok sądów rejonowych, okręgowych i apelacyjnych – status sądów powszechnych. W myśl projektu, sędziowie pokoju mają być wybierani w wyborach powszechnych, a następnie powoływani przez Prezydenta na wniosek Krajowej Rady Sądownictwa. Autorka opracowania próbuje odpowiedzieć na pytanie o status sędziów pokoju przede wszystkim w aspekcie projektowanego dojścia do urzędu sędziego pokoju ze szczególnym uwzględnieniem warunków i procedury wyboru.

On November 4, 2021, the Marshal of the Sejm received draft laws presented by the President of the Republic of Poland: the draft law on the courts of the peace and the draft law – provisions introducing the law on the courts of the peace. The changes proposed in the drafts assume the creation of justices of the peace. The courts of the peace are going to have the status of common courts. Pursuant to the draft, justices of the peace are to be elected in general elections and then appointed by the President at the request of the National Council of the Judiciary. The author of the study tries to answer the question about the status of justices of the peace, primarily in the aspect of the planned access to the office of justice of the peace, with particular emphasis on the conditions and procedure of selection.
The article titled “Navy Court in Gdynia – profiles of selected judges who committed court crimes” is about a history of this court and changes that were being made in the court’s characteristic and the reasons behind these adjustments. Next, the article presents the role of the Navy Court in repressions across the Eastern and West Pomerania. The study also shows the important issue of case law, especially of political trials and death sentences passed. The article discusses a problem of cooperation between the Navy Court, secret political police, the Navy Prosecutor’s Office and the Navy Bar. The range of these institutions’ activities is presented in the study as well as the mechanisms of putting pressure on the Navy Court by secret political police and the Navy’s information office. The article shows the meaning of the Navy Prosecutor’s Office in preliminary proceedings and presents the profiles of some of the most important prosecutors who worked in the Navy Prosecutor’s Office. The main part of the article is devoted to the profiles of judges and associated judges who worked in the Navy Court during the years 1945–1955. Profiles of people that were in charge of the Court have been described in detail. The article shows their influence on ruling and the way they controlled the Navy Court. Furthermore, the study presents the education of twenty judges and associated judges, their ruling activity and further professional life. The career of judges who played the most important role in creating the case law of the Navy Court is presented in a more detailed way. Moreover, an issue of appraising the judges’ activity during their work in the Navy Court is also mentioned in the article.

W początkowej części artykułu przedstawiono historię powstania Sądu Marynarki Wojennej w Gdyni (SMW) w tym zmiany, jakie zachodziły w jego właściwości oraz to, czym były one podyktowane; zaprezentowano rolę, jaką ten Sąd odgrywał w aparacie represji na terenie Pomorza Gdańskiego i Pomorza Szczecińskiego oraz poruszono zagadnienie orzecznictwa, szczególnie procesów politycznych i wydawanych kar śmierci. W dalszej części artykułu omówiono zagadnienie współpracy SMW w Gdyni a Urzędem Bezpieczeństwa (UB), Informacją Marynarki Wojennej (MW), Prokuraturą Marynarki Wojennej (MW) oraz adwokaturą; zaprezentowano zakres działań tych instytucji oraz mechanizmy wywierania nacisku ze strony UB i Informacji MW na SMW w Gdyni; zaprezentowano znaczenie Prokuratury MW w postępowaniu przygotowawczym oraz sylwetki kilku najważniejszych prokuratorów pracujących w Prokuraturze MW. Zasadniczą część artykułu stanowi prezentacja sylwetek sędziów i asesorów pracujących w SMW w Gdyni w latach 1945–1955. Szczegółowo przedstawiono osoby szefów tej instytucji oraz to, jaki wpływ wywierali na orzecznictwo i w jaki sposób zarządzali powierzonym im Sądem; zaprezentowano sylwetki 20 sędziów i asesorów, uwzględniając wykształcenie, działalność orzeczniczą, dalszą karierę zawodową oraz kwestię rozliczenia ich z działań podjętych w latach pracy w SMW w Gdyni. Artykuł w znacznej części oparty jest na materiałach źródłowych znajdujących się w licznych archiwach. Niewątpliwie najistotniejsze w pracy badawczej okazały się teczki personalne sędziów, akta spraw prowadzonych w sądzie oraz dokumentacja administracyjna wytworzona w toku pracy kancelarii tego Sądu. Dokumenty, które nie zostały zniszczone, początkowo były archiwizowane na miejscu, a następnie po 1955 r. przekazywane do Centralnego Archiwum Wojskowego. Obecnie materiały źródłowe rozproszone są po licznych archiwach. Znaczna część znajduje się w Archiwum Instytutu Pamięci Narodowej (IPN) w Warszawie i IPN Oddział w Gdańsku. W pracy wykorzystano również literaturę współczesną dotyczącą stalinowskiego sądownictwa wojskowego. W ostatnich latach ta tematyka znalazła się w kręgu zainteresowań badaczy. Działalność aparatu represji oraz sądownictwo wojskowe na Pomorzu Gdańskim i Pomorzu Szczecińskim doczekały się licznych dobrze przygotowanych merytorycznie monografii i artykułów, dużo wnoszących do tej tematyki. Znaczenie badawcze mają również artykuły ukazujące się w okresie PRL-u. Ze względu na okres powstania wymagały one jednak krytycznego podejścia, chociaż mają niewątpliwie znaczną wartość badawczą. W artykule poruszono także dalsze losy sędziów, już po odejściu z pracy w sądownictwie. Obecne badania warto poświęcić opracowaniu tego zagadnienia, gdyż jest ono mało znane.
This article presents selected results of a legal and sociological research project entitled“Penal cultures. Cultural context of criminal policy and criminal law reforms. Legal,penological, historical, sociological, and cultural (anthropological) analysis of criminallaw reforms in Poland against the background of European and world trends”, conductedin 2012-2014 on a sample of 160 Polish judges. The research was carried out usingthe questionnaire method supplemented with in-depth interviews with 12 judges.The questionnaire was sent by email to all the presidents of district, regional, andappellate courts in Poland with a request to pass it to their judges. The questionnaire wasaccompanied by a recommendation letter from the Vice-Rector for Scientific Researchat the University of Warsaw with the information about the research unit, that is aboutthe Professor G. Rejman Division of Culturally Integrated Legal and Social Studiesand the European Centre for Penological Studies at the University of Warsaw. Thequestionnaire was either sent back in bulk from individual courts, or the respondentssent it back individually by post or email to the university address provided.The punishment phenomenon was examined in a processual approach. Theresearchers adopted the hypothesis that criminal judges were the first link in thisprocess and knew more about punishment and punishing as social and legal phenomena than the general public. The presented research refers thematically to the studiescarried out by Bronisław Wróblewski and Witold Świda before World War II, reportedin their book Sędziowski wymiar kary w Rzeczypospolitej Polskiej. Ankieta [The judiciarysentencing of punishment in the Republic of Poland. A Questionnaire], publishedin Vilnius in 1939. Similarly to those studies, the present research asks questions aboutthe determinants of the judiciary dimension of punishment, but it emphasises morestrongly the cultural, philosophical and moral dimensions of punishment attitudesdisplayed in sentencing.The statements of the respondents show a varied l evel of the judges’ knowledge aboutmatters concerning the socio-cultural and psychological aspects of punishment. Theyalso reveal a strong legal orientation of views and remain within the set of notions andtheories focused on law. Similarly to the Vilnius pre-war studies, the judges’ statementsshow a strong formative influence of lawyers’ education curricula implemented at alllevels of education.The results of the research carried out in 2012-2014 illuminate the judges’ viewson the goals and functions of punishment and punishing. They show the declaredhierarchy of the most important variables defining professional decisions regardingthe sentences imposed by the judges. They show the influence of systemic and culturalvariables on the professional attitudes and motives of the judges’ decisions in this matter.The judges’ statements on the effectiveness of penalties in individual and generalprevention are generally subdued. Although these factors are taken into account inthe process of sentencing, there is no deep conviction about their high impact. It issignificant that the research shows a clear distancing of the judges from the assumptionthat they may be subservient to influences from their superiors, scholarly authorities,public opinion or the decisions of colleagues in similar matters. Independence isdeclared by judges to be an important feature of their professional ethos and appliesto all sources of influence. On the other hand, what the judges indicate as variablesrelevant to their decisions on sentencing are the personal and family conditions ofthe perpetrator and their potential for rehabilitation, which may occur as a resultof criminal sentencing and end the state of impunity. The respondents also indicatethat the fairness of a sentence and the doing of justice to the offender is a significantaspect of the court’s action.Although the research procedure in this case was strongly grounded in empiricism,this was not its main distinguishing feature – it was the conducting of research inthe culture of methodological and theoretical integration of the empirical material.It makes it possible to deduce a complex structure of the researched process andto undertake an analysis explaining many more variables than would appear in thedisciplinary mono analysis.
