Przedmiotem artykułu jest analiza środków zaradczych zastosowanych przez Komisję Europejską w procesie konsolidacji operatorów telefonii ruchomej. Celem opracowania jest ocena ich skuteczności na przykładzie decyzji warunkowych wydanych w sprawie H3G-Orange, H3G-o2 i Telefónica-E-Plus. W artykule ukazano również relacje między regulacjami sektorowymi a przepisami dotyczącymi kontroli koncentracji oraz problem nakładana się kompetencji regulatorów sektorowych i organów antymonopolowych

The aim of the paper is to analyze merger remedies applied by European Commission during consolidation of H3G-Orange, H3G-o2 i Telefónica-E-Plus. The article deals with efficiency of this tools used in mobile communications sector and relations between sector specific regulations and merger law. The paper also reveals problem of overlapping competences of national telecommunications regulators and competition authorities.

W artykule podjęto próbę ukazania dualnej struktury normatywnej, w której osadzone są sektory infrastrukturalne. Opracowanie koncentruje się na rynku telekomunikacyjnym. Głównym obsza-rem analizy jest istota prawa konkurencji w kontekście obowiązków regulacyjnych nakładanych na operatorów telekomunikacyjnych, zarządzania częstotliwościami radiowymi i podziału sieci. Celem artykułu nie jest wyczerpujące omówienie powyższych unormowań, a jedynie zarysowanie istoty prawa konkurencji w zakresie regulacji tytułowego sektora.

The article concerns the dual normative structure characteristic for infrastructural sectors. The analysis is limited to the Telecommunication sector. The paper focuses on the problem of the role of competition law in the context of regulatory obligations, radio spectrum management and network sharing agreements. The aim of the article is to show the complexity of the normative structure of the Telecommunications sector, including sector specific regulations and competition rules, rather than exhaustively analyse the chosen regulatory aspects.
