The text is about the constitutional foundations of the State’s policy towards the Church in Poland after 1989. It analyses the political and social determinants of the currently binding legal regulations indicating the State-Church relationship, their content and the way constitutional regulations referring to the issue of religion are applied. All the reflections are presented in the context of the question about the secularity of the relationship between the State and the Church.

Stosunki wyznaniowe, obejmujące w sumie bardzo wiele, bardzo rozmaitych elementów, m.in. indywidualną wolność sumienia i wyznania, instytucjonalne relacje między państwem a związkami konfesyjnymi czy wreszcie znacznie szerszy i pojemniejszy projekt światopoglądowego zaangażowania się państwa podług wzorca państwa wyznaniowego, neutralnego albo ideokratycznego to z pewnością stały punkt w refleksji nad państwem i polityką tout court. Od zawsze przecież państwo zajmowało jakieś stanowisko względem kwestii wyznaniowych, przy czym zawsze, a w każdym razie prawie zawsze, stanowisko to wywoływało polityczne reperkusje. Przyjęcie albo modelu państwa wyznaniowego, w którym sacrum i profanum stykają się ze sobą zgodnie ze starą ideą sojuszu tronu z ołtarzem, albo alternatywnego modelu państwa świeckiego, w którym istnieje wyraźna linia demarkacyjna między państwem a kościołem wywołuje – ze zrozumiałych powodów – spory i polemiki.
