The fast pace of technological developments is bringing forth, to an ever-greater degree, dangerous and potentially damaging systems and products. The intensity of regulation in law concerning technical security cannot sufficiently keep up with this development. On the one hand, legislators often lack the necessary detailed scientific and technical expertise, while on the other, adequate verbal description of complicated technical matters in legal norms is almost impossible. Therefore advancing technological changes are only imperfectly accounted for in abstract regulations.

Szybkie tempo rozwoju technologicznego prowadzi do powstawania coraz bardziej niebezpiecznych i potencjalnie szkodliwych systemów i produktów. Prawodawstwo odnoszące się do papierów wartościowych nie jest wprowadzane w dostatecznie szybkim tempie, pozwalającym uwzględnić ten rozwój. Z jednej strony legislatorom brakuje niezbędnej, szczegółowej, specjalistycznej wiedzy naukowej i technicznej, a z drugiej – właściwe opisani za pomocą słów skomplikowanych zagadnień technicznych w kategoriach norm prawnych jest praktycznie niemożliwe. Z tego powodu postępujące zmiany technologiczne są równoważone jedynie przez wprowadzanie abstrakcyjnych regulacji prawnych, którym daleko jest to ideału.
