Der Artikel schildert Fragestellungen in Bezug auf Sexualverbrechen, die an oder von Minderjährigen begangen werden. Es werden das Recht und die außerrechtlichen Faktoren der Analyse unterzogen: die Zugänglichkeit und die Qualität der sexuellen Aufklärung in der Schule und in der Familie, soziale Entwicklung der Minderjährigen. Besondere Beachtung wird dem Einfluss der IT-Technologien (Internet, Mobiltelefone, Tablet-PCs) auf kriminelle Sexualverhaltensweisen der Jugendlichen (Sexting, Stalking, Cyberbullying, Pornografie) geschenkt. Eine grundsätzliche Frage ist dabei, ob es möglich ist, Sexualverhalten der Jugendlichen gesetzlich so zu regeln, damit sie zugleich vor dem Missbrauch geschützt werden. Es ist auch interessant, welche Faktoren die Schlüssigkeit des Strafrechts (und im Falle der Minderjährigen auch Gesetze über Vorgehensweisen in der Jugendkriminalität) und der Wirklichkeit beeinflussen. In diesem Zusammenhang verweise ich auf die Einflüsse der Kultur und der sozialen Werte.

The aim of this article is to present issues related to sexual offences committed by or against minors. In addition to that, non-legal factors will be analyzed, such as access to and quality of sexual education at home and at school or social development of minors. Special attention is paid to the impact of information technologies (the Internet, mobile phones, tablets) on the intensity of juvenile delinquency, e.g. pornography, sexting, stalking, cyberbullying. The main question is whether it is possible to legally regulate and codify the behaviour of teenagers in terms of their sexual activity in a way which protects them sufficiently from harm. It is also of interest what factors determine the consistency of criminal law – and, in the case of minors, the law of juvenile justice – and observable reality. The paper concludes that the joint impact of culture and social norms constitutes the crux of the matter.

Celem artykułu jest przedstawienie zagadnień związanych z przestępstwami seksualnymi popełnianymi przez lub wobec osób małoletnich. Analizowane jest prawo, a także czynniki pozaprawne: dostępność i jakość edukacji seksualnej w szkole i w domu, rozwój społeczny osób małoletnich. Szczególną uwagę zwracam na wpływ technologii teleinformacyjnych (Internet, telefony komórkowe, (tablety) na przestępcze zachowania seksualne osób młodych (sexting, stalking, cyberbullying, pornografia). Podstawowym pytaniem jest to, czy możliwe jest prawne regulowanie zachowań seksualnych młodzieży w taki sposób, by jednocześnie chroniły ich one przed okrzywdzeniem. Interesujące jest również, jakie czynniki wpływają na spójność prawa karnego (a w przypadku osób nieletnich również ustawy o postępowaniu w sprawach nieletnich) i rzeczywistości. W tym aspekcie wskazuję na wpływy kultury i wartości społecznych.
