Autor przedstawił podstawowe prawne aspekty powołania i działalności Funduszu Kościelnego oraz ewolucję zasad ubezpieczeń duchownych, aktualnie finansowanych ze środków tego Funduszu. Rozważania w tym względzie konfrontuje następnie z treścią regulacji i ich uzasadnień, zawartych w poselskich projektach ustaw oraz w rządowych założeniach projektu ustawy o zniesieniu Funduszu Kościelnego. Powyższe prowadzi autora do końcowego wniosku, że te inicjatywy ustawodawcze mogą naruszać konstytucyjne zasady ochrony praw słusznie nabytych oraz prawa do milczenia w sprawach wyznaniowych.

The author presents basic legal aspects of the establishment and operation of the Church Fund and evolution of the clergy’s social insurance, presently financed by this Fund. Considerations on the subject are confronted with the laws proposed by the members of the parliament and the government’s draft of the law on abolishment of the Church Fund. The author’s final conclusion is that these legislative initiatives may breach constitutional principles of protection of vested rights and right to remain silent on religious matters.
