The article discusses the impact of European integration on social policy in Poland. Though social policy remains mainly the competence of the EU member states, EU impact on social policy has been clear, already since Poland’s preparation to the membership, thus for more than 20 years. Free movement of workers was the most difficult issue during the accession negotiations, due to fears of the old member states. During the integration, Polish law, especially in the area of labour law, was adjusted to the EU law. Poland entered the EU system of social security coordination An indirect impact of integration has been substantial, especially through contributing to catching up in the level of development.

15 lat po wprowadzeniu rozporządzeń UE w sprawie koordynacji zabezpieczenia społecznego – czy są one nadal odpowiednie i gotowe na nadchodzące dekady? Czy wytrzymają próbę czasu? Czy nie jest to może czas na wspólną refleksję na temat zmiany tych ważnych instrumentów integracji europejskiej? Celem tego artykułu jest nie tyle spojrzenie na ponad 60-letnią historię, ale raczej sformułowanie prognozy na przyszłość opartej na dotychczasowej ewolucji i zidentyfifi kowanie wyzwań, które mogą zmusić prawodawcę UE do dostosowania, modyfikacji i dalszej modernizacji rozporządzeń koordynacyjnych. Podczas gdy niektóre zmiany mogą prowadzić do technicznych, kosmetycznych modyfikacji, inne będą wymagać odważnych decyzji, ponieważ nie można wykluczyć, że niektóre napotkane wyzwania podważą również część z podstawowych zasad koordynacji systemów zabezpieczenia społecznego państw UE/EFTA.

15 years after the introduction of EU Regulations on social security coordination – are they still relevant and ready for the coming decades? Will they stand the test of time, and have the past few years not taught us that additional reflections are needed? Is it perhaps not the time for a joint reflection about amending these important instruments of European integration? The purpose of the article is not to look back on over 60 years of history, but rather to make future projections based on past evolutions and identify challenges that may force the EU legislature to adapt, modify and further modernise the coordination Regulations. While some developments might lead to technical, cosmetic modifications, others will require brave decisions, as it cannot be excluded that certain challenges faced will question even some of the fundamental principles behind the current system of the coordination Regulations.

The application of free movement of workers and social security coordination rules by national courts). Jest to pierwsza publikacja dotycząca tego, jakie zagadnienia z zakresu swobody przepływu pracowników i koordynacji systemów zabezpieczenia społecznego stają do orzekania przed sądami krajowymi na tle stosowania przepisów unijnych. Zagadnienia te pokazują wiele wspólnych problemów definicyjnych i pojęciowych, ale także uwzględniają różnorodność tych spraw w poszczególnych państwach członkowskich UE.

The article is based on the legal report on the application of free movement of workers and social security coordination rules by national courts, prepared by MoveS (network of legal experts) in 2019 for the European Commission. It is the first European publication on issues dealt with by national courts in the field of freedom of movement of workers and coordination of social security. The report highlights common definition and conceptual problems, but also takes into account the diversity of these issues in EU Member States.

The article analyses the coordination of social security systems as an instrument for realisation of the free movement of persons within the European Union. The coordination rules guarantee retaining full advantages offered by national social security schemes, regardless of the decision to move to another EU Member State. The coordination is functioning in a dynamic environment, and because of that the impact of any new regulations should be carefully monitored, especially in the field of applicable legislation.

Zasady koordynacji gwarantują zachowanie przez osoby, które zmieniają miejsce zamieszkania i pracy na obszarze Unii Europejskiej, korzyści oferowanych przez krajowe systemy zabezpieczenia społecznego. Koordynacja funkcjonuje w dynamicznym środowisku, co wymaga stałego monitorowania i oceny skutków oddziaływania proponowanych przepisów prawa unijnego, szczególnie w zakresie ustawodawstwa właściwego.

The article is dedicated to the status of the European Labour Authority and its competences in the field of application and enforcement of labour law. Established in 2019, the Authority shall contribute to ensuring fair labour mobility across the Union and assisting Member States and the Commission in the coordination of social security systems within the Union. Author outlines the problems connected to the freedom of movement of workers and posting of workers within the freedom to provide services. He introduces competences of the European Labour Authority on facilitating access to information on rights and obligations regarding labour mobility across the Union, facilitating and enhancing cooperation between Member States in the enforcement of relevant Union law, mediating and facilitating solution in cases of cross-border disputes between Member States, as well as supporting cooperation between Member States in tackling undeclared work.

Artykuł dotyczy statusu Europejskiego Urzędu ds. Pracy i jego kompetencji w zakresie stosowania i egzekwowania prawa pracy. Utworzony w 2019 r. Urząd ma przyczyniać się do zapewnienia sprawiedliwej mobilności pracowników w całej Unii oraz wspierać państwa członkowskie i Komisję w koordynowaniu systemów zabezpieczenia społecznego w Unii. Autor zarysowuje problemy związane ze swobodą przemieszczania się pracowników oraz delegowaniem pracowników w ramach swobody świadczenia usług. Przedstawia kompetencje Urzędu ds. Pracy dotyczące ułatwiania uzyskiwania informacji o prawach i obowiązkach w dziedzinie mobilności pracowników w całej Unii, ułatwiania i wspierania współpracy państw członkowskich w zakresie egzekwowania odpowiednich przepisów prawa Unii, prowadzenia mediacji i udzielania pomocy w rozstrzyganiu sporów transgranicznych między państwami członkowskimi, a także wspierania współpracy państw członkowskich w zakresie przeciwdziałania pracy nierejestrowanej.
