Jednym z podstawowych obowiązków dziennikarskich jest ochrona dóbr osobistych osób trzecich. Pozaustawową okolicznością wyłączającą naruszenie dóbr osobistych przez prasę jest uzasadniony interes publikacji. Dziennikarze chętnie powołują się na tę okoliczność, niestety, nader często interpretując ją jako zainteresowanie opinii społecznej daną sprawą, co w świetle obowiązującego orzecznictwa i stanowiska doktryny nie stanowi wystarczającej przesłanki wyłączającej bezprawność.

The journalists have an obligation to protect personal right of third parties. The legitimate importance is non-statuory circumstances excluding illegality of personal rights violation by the press. The journalists rely on it very often in their publications, unfortunately understanding it as a social interest in the matter. There is a clear need of defi ne the meaning this vague legal concept, upon the existing case law of the Polish Supreme Court and representatives of legal doctrine.
