Przedmiotem recenzji jest monografia Karola Dobrzenieckiego p. t. Prawo wobec sytuacji nadzwyczajnej. Między legalizmem a koniecznością (Toruń 2018). Zdaniem recenzenta, charakter pracy wyznacza rozróżnienie na sytuację wyjątkową, to jest stan faktyczny wymagający podjęcia działań nieprzewidzianych przez prawo oraz stan wyjątkowy, tj. instytucję prawną. Podstawowym celem pracy jest analiza relacji między ujmowaniem sytuacji wyjątkowej wyłącznie w kategoriach pozytywno-prawnych, a jej ujęciem jako zagadnienia politycznego i moralnego. Praca ma charakter interdyscyplinarny. Karol Dobrzeniecki, analizując literaturę filozoficzno-prawną, filozoficzno-polityczną, doktrynę prawa konstytucyjnego, a także uregulowania prawne o charakterze konstytucyjnym, międzynarodowym i ponadnarodowym, wskazuje na niebezpieczeństwo prawnej „normalizacji” stanu wyjątkowego, to jest przeniknięcia jego specyficznych rozwiązań do prawa przeznaczonego dla sytuacji zwyczajnych, a przez to zanik rozróżnienia na sytuację zwyczajną i wyjątkową. Autor recenzowanej monografii uważa, że sytuację wyjątkową należy oceniać przede wszystkim w kategoriach moralnych i politycznych, mając świadomość tragicznego charakteru dokonywanych wówczas wyborów.

The subject of the review is a monograph by Karol Dobrzeniecki “Law on emergency situations. Between legalism and necessity” (Toruń 2018). According to the reviewer, the nature of the work determines the distinction between an emergency situation, that is, a factual state requiring action not provided for by law and a state of emergency, i.e. a legal institution. The main purpose of the work is to analyze the relationship between the recognition of an exceptional situation only in legal terms, and its approach as a political and moral issue. The work has interdisciplinary character. Karol Dobrzeniecki, analyzing jurisprudence, political philosophical, doctrine of constitutional law, as well as constitutional, international and supranational legal regulations, points out the danger of legal “normalization” of a state of emergency, that is, the penetration of its specific solutions into the law intended for the ordinary situation, and hence blurring of the distinction between ordinary and exceptional situations. The author of the reviewed monograph believes that the exceptional situation should be assessed primarily in moral and political categories, being aware of the tragic nature of the choices made at the time.
The aim of this paper is to shed light on the experiences of non-infected pregnant women in Serbia during the COVID-19 pandemic and the state of emergency by applying a qualitative research method. The present analysis examines four aspects of being pregnant during the COVID-19 pandemic and the state of emergency: (a) pregnant women’s health and health care; (b) preparation for childbirth and the arrival of a new family member; (c) working while pregnant during the pandemic; and (d) the family atmosphere and family practices. The results show that the coronavirus pandemic affected pregnant women both psychologically and socially. The following conditions had a negative impact on pregnant women: (a) worrying about both their own health and the health of their baby; (b) a significant reduction in the level and quality of health-care support; (c) a decrease in ‘external’ parental support as a result of the need to socially isolate; (d) difficulties in managing their professional and family obligations; (e) missing their regular pre-pandemic activities; and (f) a decrease in total family income as a result of changes to employment conditions during the pandemic. Respondents who experienced pregnancy positively had high levels of marital adjustment and a stable family income and enjoyed spending more time with their husband and children during the pandemic.
During the Second Polish Republic the use of special regulations were justified by the current situation inside or outside the state. The duration was limited to the time necessary to resolve the particular danger of the measures taken and put constraints on the other hand can be as relevant to a particular situation.
The paper refers to providing information about the dangers connected with crisis management. Crisis management is the activity of public administration authorities, which constitutes an element of managing the national security management system and essentially consists of: preventing crisis situations, preparing to take control over them by way of planned activities, responding in case of emergencies, removing their effects and reconstructing resources and critical infrastructure. In the first part, the stages of public administration authorities’ proceedings in crisis management are presented. This part also discusses the regulations incorporating the ways to devolve information in emergencies contained in crisis management plans. The second part of the work applies to the evolution of factual activities as legal forms of public administration activities with reference to operations consisting in informing society in case of emergencies occurring.
This article aims to answer the question about the legality of the selected measures implemented by the Polish government during the first wave of the coronavirus pandemic, which resulted in constitutional rights and freedom restrictions. The study focuses on examining selected restrictions implemented in the spring of 2020 in the light of the Polish Constitution, especially in the light of Article 31 (3), which defines the premises of limitation of citizens’ rights and freedoms. It indicates the lack of legal basis and incompatibility with constitutional premises of many restrictions. The study further examines the premises of the introduction of the state of emergency, indicating that the government's decision not to impose such a state was legal and why. The study considers legal status from March 13 to May 16, 2020.
The article examines martial law period from a decisionistic perspective. Thus, the analysis would show introducing martial law in the People’s Republic of Poland in 1981 as a legitimised legal action. Such an interpretation, as opposed to the prevailing understanding of law, focuses on the volitional aspect and the need to preserve political and legal system of the State. Therefore, it assumes that the main principle of law is the will of the State, rather than formal-legal aspect of law.
This article presents the essential issues in the provisions of the law relating to public security in force in the Republic of Poland which are used in conditions of extraordinary internal threats that cannot be dealt with using ordinary legal tools. The considerations are based on an analysis of the legally regulated obligations of the state as a political organisation to society for securing the conditions for its survival in a changing security environment. This serves to present the basic issues of public security and the rules for the use of the State instruments for states of emergency. The rest of this article presents the relationship between issues of public security and a state of emergency. In this part of the article it is essential to discuss the circumstances that must exist to be able to employ specific legal measures in the conditions of threats to the constitutional order of the State and threats affecting the security of the citizens or of public order (including those caused by terrorist activities). Consequently, it discusses the impact of the rigours of a state of emergency in relation to the potential for limiting the escalation of these threats. The final part of the article also presents other instruments, apart from the state of emergency which, in the Polish legal system, can be used in the fight against threats which endanger public security and that are related to prohibited activities in cyberspace.
As is the case with other international human rights treaties, the European Convention on Human Rights (ECHR) offers states parties to the convention possibilities to limit the exercise of human rights in times of crisis. The margin of appreciation doctrine employed by the European Court of Human Rights gives states a lot of leeway in applying the Convention domestically. The question is whether the Convention also allows states to restrict rights guaranteed under the Convention to a degree which would be inconsistent with the spirit of the Convention. To answer the question whether human rights are sufficiently guaranteed under the Convention even in times of emergencies we will first look at general rules concerning the restriction of rights under the Convention. We will then move our investigation to Art. 15 ECHR and look at the conditions set by the norm, its limits as well as at some special cases of emergencies.
The article deals with the concept of the state of exception in judicial reasoning. Two cases from the European Court of Human Rights together with some case law of the Lithuanian Constitutional Court are examined. The author presents three examples of a possible state of exception from particular case law: i) state of emergency, ii) the concept of transitional democracy and iii) economic crisis. The primary goal of the article is to try to define the boundaries of judicial competence in dealing with the phenomenon of state of exception, which traditionally falls within the competence of executive power. The article argues that the attitude towards this problem in case law has changed a lot during the past couple of decades. Although the court usually does not question the need of Government's announcement of particular state of exception (e.g. state of emergency or economic crisis), the judiciary has attributed to itself rather large discretion to examine whether a particular "exceptional" measure is proportional. According to the examined case law, so-called "primary" human rights (e.g. one's right to life, dignity etc.) as opposed to "secondary" rights (eligibility or economic rights) are usually treated as "absolute" rights and may not be infringed upon even during a state of exception. The Ždanoka judgment is here presented, because the vulnerability of the Latvian political system was treated as a certain exception, justifying some deviation from the common standard of safeguard of one's eligibility rights. The paper also examines recent cases of the Lithuanian Constitutional Court concerning diminished social-economic rights during economic crisis.
The author presents a constitutional regulation of the Polish model of presidential election and states of emergency and relates them to the specific situation of the COVID-19 pandemic in 2020. Then, he analyses in detail the content of the recommendations of the European Commission for Democracy through Law (Venice Commission) of 26 May 2020 (Respect for Democracy, Human Rights and the Rule of Law during States of Emergency – Reflections), regarding the elections in states of emergency and its significance for the presidential election in Poland in 2020. The opinion positively evaluates all the Commission’s recommendations and considers that the existing and new exceptional Polish electoral law regulations respecting the principles of democracy and rule of law are fully complaint with them.
Author deals in this article with the issue of hydraulic rescue equipments used during rescuing persons during technical interventions and systematic procedure in case of traffic accidents in the Slovak Republic. Furthermore, he characterizes material and technical equipments of involved corps, pointing at systematic approach to each state of emergency in case of rescue of trapped persons using hydraulic extrication equipment.
The objective of the article is to: identify all kinds of regulations related to extraordinary measures (that is legal acts that affect the validity and content of particular extraordinary measures); to reconstruct the elements of their content and define their legal nature, along with the means of supervising their lawfulness. In the article four types of such regulations will be distinguished: regulations introducing extraordinary measures, regulations which extend and terminate them, as well as regulations that amend the regulation introducing extraordinary measures. Their content and legal character are varied. The most complex is the regulation introducing extraordinary measures, since it is both an individual and normative act. The author concludes that the analysed regulations are subject to the review of the Constitutional Tribunal. In the remaining scope, the possibility of their supervision by the judiciary is limited; however, it is possible to question them incidentally before the courts and the State Tribunal. The reflections lead to the formulation of a positive assessment of the constitutional provisions related to the issue under analysis.

Celem artykułu jest zidentyfikowanie wszystkich rodzajów rozporządzeń dotyczących stanów nadzwyczajnych (tj. aktów prawnych wpływających na obowiązywanie konkretnego stanu nadzwyczajnego oraz jego treść), zrekonstruowanie ich elementów treściowych oraz określenie ich charakteru prawnego wraz z wynikającymi z tego skutkami dla możliwości kontroli ich legalności. W artykule wyróżniono cztery rodzaje takich rozporządzeń: wprowadzające stan nadzwyczajny; przedłużające go oraz znoszące go, a także nowelizujące akt wprowadzający stan nadzwyczajny. Ich treść, jak i charakter prawny są zróżnicowane. Najbardziej złożone jest rozporządzenie wprowadzające stan nadzwyczajny, gdyż posiada ono zarówno cechy aktu indywidualnego, jak i normatywnego. Autor stwierdza, że analizowane rozporządzenia, w zakresie, w jakim są aktami normatywnymi, podlegają kontroli Trybunału Konstytucyjnego. W pozostałym zakresie możliwość ich kontroli przez władzę sądowniczą jest ograniczona, aczkolwiek jest możliwe ich incydentalne kwestionowanie przed sądami i Trybunałem Stanu. Poczynione refleksje prowadzą także do sformułowania pozytywnej oceny regulacji konstytucyjnych odnoszących się do badanego zagadnienia.
Despite the fact that emergency governance, extraordinary measures, and state of exception are popular subjects of current legal, political and philosophical discussions, there is often a terminological confusion about the object of such investigation. In the present article, the state of emergency is defined as a legal institute consisting of a set of measures that the state authority uses to overcome the situation of a serious existential crisis threatening the existence of the state or its constitutional order. The state of exception needs to be distinguished from other states of emergency which respond to crisis situations that do not threaten the existence of the state. At the same time, it must be distinguished also from legal regimes that are designed as a response to those crises endangering the existence of the state that can be anticipated. Unlike these “limited“ legal regimes, the state of exception is based on a general clause. Although such a broad legal regime can be considered as an integral part of any constitutional order, I argue that it is de lege ferenda more appropriate.

Ačkoliv je téma nouzového vládnutí, mimořádných pravomocí a výjimečného stavu oblíbeným předmětem právních, politologických a filosofických diskusí, doprovází je častá terminologická zmatení ohledně zkoumaného objektu. V předkládaném článku je výjimečný stav definován jako právní institut označující soubor opatření, jichž státní orgán užívá k překonání situace vážné, existenciální krize ohrožující existenci státu a ústavního řádu, jejíž podobu nelze předem předvídat. Takto pojatý výjimečný stav je třeba odlišit od nouzových stavů, jež reagují na krizové situace, které neohrožují existenci státu. Zároveň je třeba jej odlišit od institutů, které reagují na taková ohrožení státu, jejichž podobu a průběh je možné předvídat. Výjimečný stav se na rozdíl od nich opírá o generální zmocnění, které lze pokládat za implicitní součást každého ústavního řádu. Zároveň však platí, že de lege ferenda je vhodnější explicitní zakotvení této normy v psané ústavě, a to v dostatečně obecné podobě. V případě, že by takové zakotvení bylo příliš svazující, ať procesně, či materiálně, mohl by se stát ocitnout před dilematem, zda se uchýlit k nepsanému výjimečnému stavu (a zpochybnit právní stát), nebo akceptovat vlastní destrukci (a tím i zničení právního státu). V článku zároveň polemizujeme se snahou jednání v krizové situaci vyjmout z práva a pojímat jej jako mimoprávní či protiprávní jednání ospravedlnitelné pouze eticky nebo ex post.
The text deals with the position of emergency legislation, in other words the possibility of creating legal provisions to replace laws. The article contains a brief history of regulations with the power of law issued by the government. The subject of the article is also the measures of the government and the Ministry of Health in connection with the coronavirus crisis. The article concludes that emergency legislation in exceptional times is a necessity for the state, but it can only be applied if the constitutional order allows it. Under the current legislation, the imposition of duties by the executive is possible only in accordance with the Constitutional Security Act. The conditions for such an impostion of duties are: a declared state of emergency and the government is responsible for the decision. Measures of the Ministry of Health setting out obligations that are not explicitly mentioned in the law have no constitutional support. The article criticizes the fact that the government’s crisis measures, which impose obligations on citizens, do not take the form of a legal regulation, even though they are materially assessed as a legal regulation by the Constitutional Court.

Text se zabývá postavením nouzového zákonodárství, tedy možnosti tvorby právních předpisů nahrazujících zákony. Článek obsahuje krátkou historii předpisů s mocí zákona vydávaných vládou. Předmětem článku jsou i opatření vlády a Ministerstva zdravotnictví v souvislosti s koronavirovou krizí. Článek dochází k závěru, že nouzové zákonodárství v době výjimečné je pro stát nutností, ale může být uplatněno jen, když tak připouští ústavní řád. Za současné právní úpravy je stanovení povinností výkonnou mocí možné jen podle ústavního zákona o bezpečnosti. Podmínkou je vyhlášený nouzový stav a příslušná k rozhodnutí je vláda. Opatření Ministerstva zdravotnictví stanovící povinnosti, které zákon výslovně nezmiňuje, nemají ústavní oporu. Článek kritizuje skutečnost, že krizová opatření vlády, která stanoví povinnosti občanům, nemají formu právního předpisu, byť jsou jako právní předpis Ústavním soudem materiálně posuzována.
The article analyses the declaration the State of Emergency according to the Constitutional Act on the Security of the Czech Republic in the context of the current Covid-19 pandemic. The decision to declare the State of Emergency is characterized as a normative, constitutive act of the government without direct and immediate effect on the legal sphere of persons, which can be classified in the hierarchy of legal norms as law. Thus, the paper rejects the conclusion that such an act could be an administrative act or a non-legal (purely political) act. The article further analyses the possible defects of this act and divides them into three groups depending on their intensity and consequences. The most intense defects should make the act void. Defects that are less intense, but as a result of which the essentials of a democratic state governed by the rule of law are affected, should lead to the reviewability and possible revocability of the act by the Constitutional Court. Finally, defects of the lowest intensity should be covered by the so-called Fehlerkalkül theory, and therefore unreviewable. In conclusion, the article also deals with the control of the declaration of the State of Emergency by the Chamber of Deputies and the judicial review of this act. Regarding control by the Chamber of Deputies, a space is devoted particularly to the issue of the possibility of the State of Emergency “re-declaration” contrary to the will of the Chamber of Deputies. Concerning judicial review, the article excludes review by administrative courts and only allows for limited review by the Constitutional Court.

Článek se zabývá problematikou rozhodnutí o vyhlášení nouzového stavu dle ústavního zákona o bezpečnosti České republiky v kontextu současné pandemie covid-19. Rozhodnutí o vyhlášení nouzového stavu charakterizuje jako normativní, konstitutivní akt vlády bez přímého a bezprostředního účinku do právní sféry osob, který je zařaditelný v hierarchii právních norem na úroveň zákona. Zcela je tedy odmítnut závěr, že by se mohlo jednat o akt správní či akt neprávní (čistě politický). Článek dále analyzuje možné vady tohoto aktu a rozděluje je do tří skupin v závislosti na jejich intenzitě a důsledcích. Nejintenzivnější vady by měly způsobovat nicotnost aktu. Vady méně intenzivní, v jejichž důsledku je však zasaženo do podstatných náležitostí demokratického právního státu, by měly vést k přezkoumatelnosti a případné zrušitelnosti aktu Ústavním soudem. Konečně vady nejnižší intenzity by měly být kryty tzv. kalkulem vad, a proto jsou soudně nepřezkoumatelné. Článek se konečně zabývá také kontrolou vyhlašování nouzového stavu Poslaneckou sněmovnou a přezkumem tohoto aktu soudní mocí. V případě kontroly Poslaneckou sněmovnou je prostor věnován zejména otázce možnosti „znovuvyhlášení“ mimořádného stavu v rozporu s vůlí Poslanecké sněmovny. V případě soudního přezkumu článek vylučuje přezkum ve správním soudnictví a jen omezeně připouští přezkum Ústavním soudem.
Koncepcja stanu wyjątkowego jest jednym z najczęściej przywoływanych elementów myśli niemieckiego filozofa prawa i teoretyka polityki Carla Schmitta. W jej omówieniach pokutuje jednak łączenie tej konceptualizacji owej instytucji, jaką Schmitt zaproponował w 1924 r. w swoim jurydycznym komentarzy do artykułu 48 konstytucji Republiki Weimarskiej, z teorią Ausnahmezustand z „Teologii politycznej” z 1922 roku. Łączenie takiego rodzaju jest zaś, jak sądzę, błędem, ponieważ Schmitt nie był ze względów politycznych myślicielem konsekwentnym i poszczególne jego teksty mogą samym sobie przeczyć – jak jest to w wypadku tych dwóch. Proponuję toteż, by poddać stan wyjątkowy i Ausnahmezustand – tłumaczony w tekście z niemieckiego literalnie, jako stan bez nazwy – radykalnemu rozdzieleniu i opisać jako osobne teorie. W ich osobności za najistotniejszy element uznaję różne rodzaje legitymizacji. O ile stan wyjątkowy z art. 48 konstytucji Republiki Weimarskiej znajduje swoją w tym właśnie dokumencie z 1919 r., odczytanym jednakowoż przez Schmitta w sposób, który nazwał on w swej „Nauce o konstytucji” z 1928 r. relatywizacją konstytucji, o tyle stan bez nazwy, jako niedający się wpisać w porządek prawny odpowiednik cudu w teologii politycznej, takiej legitymizacji jest już pozbawiony. By ją odnaleźć, należy się toteż odnieść do innych dzieł Schmitta, niż te stricte prawne. Sądzę, że stan bez nazwy może być prawomocny – jednym słowem: nie być zamachem stanu – jeżeli uznamy, że teologia polityczna Schmitta nie jest tylko metodologicznym projektem poddającym na zasadzie analogii tłumaczeniu pojęcia teologiczne na polityczne i prawne, lecz szerszą propozycją, która znajduje swoje zakorzenienie w wierze w Objawienie. Dlatego też tą figurą z dzieła niemieckiego myśliciela, w której stan wyjątkowy znajduje swoją legitymizacją, jest zaczerpnięta z Listów św. Pawła figura katechona: tego, który przychodzi i powstrzymuje rozpad świata. Użycie takiej legitymizacji uwypukla niechęć do nowoczesności, która była udziałem Schmitta, i prezentuje go jako myśliciela dziedziczącego średniowieczny sposób myślenia – zupełnie niekompatybilny ze stricte nowoczesną koncepcją stanu wyjątkowego.

The concept of a state of emergency is one of the most frequently cited elements of the thought of the German philosopher of the law and political theorist Carl Schmitt. In its discussions, however, the conceptualization of the state of emergency, which Schmitt proposed in 1924 in his juridical comments on Article 48 of the Weimar Republic’s constitution, is often linked with the theory of Ausnahmezustand from Political Theology (1922). Such a juxtaposition is a mistake, because Schmitt was not a consistent thinker and his texts can be mutually contradictory. I propose, therefore, to separate the state of emergency from Ausnahmezustand – translated from German literally as a state without a name. The main difference between them consists in the different types of legitimacy. The state of emergency from the Constitution of the Weimar Republic finds its legitimacy in this document from 1919, however, read by Schmitt in a way that in his Constitutional Theory (1928) he referred to as relativization of the constitution. For the state without a name, as not being included in the legal order and the equivalent of a miracle in theology, such legitimacy is impossible. In order to find it, one must refer to other Schmitt’s works than the strictly judicial ones. I believe that the state without a name may be legally valid – in a word: not a coup d’état – if we acknowledge that Schmitt’s political theology is not just a methodological project that translates theological notions into political and legal ones, but a wider proposal rooted in the faith in Revelation. Therefore, this figure from the work of the German thinker in which the state of emergency finds its legitimacy is taken from St. Paul’s letters; it is the figure of a katechon: the one who comes and stops the world from disintegration. The use of such legitimacy emphasizes the reluctance to accept modernity, which Schmitt did exhibit, and presents him as a thinker who continued the medieval way of thinking, which is completely incompatible with the strictly modern concept of a state of emergency.
W niniejszym opracowaniu zostanie przybliżona senatus consultum ultimum, tj. ostateczna uchwała senatu podejmowana w momentach nadzwyczajnego zagrożenia rzymskiej republiki. Postaram odpowiedzieć na pytanie, jaka była legalność ustrojowa takich uchwał, ponadto wskazać ich przesłanki oraz skutki wydania. Senatus consultum ultimum było bowiem najpotężniejszą bronią rzymskiego senatu w walce przeciwko wewnętrznym wrogom politycznym w późnej republice, dlatego wyjaśnienia wymaga, czy SCU było zgodnym z prawem środkiem służącym ochronie państwa czy dbało tylko o polityczne samostanowienie senatu i optymatów.

This paper presents the senatus consultum ultimum, i.e., the final resolution of the senate passed in moments of extraordinary danger to the Roman Republic. We answer the question what was the legitimacy of such resolutions and indicate their rationale and the effects of their issuance. Senatus consultum ultimum was the most powerful weapon of the Roman senate in the fight against internal political enemies in the late republic, so it needs to be clarified whether the SCU was a legitimate measure to protect the state or it cared only for the political self-determination of the senate and the optimates.
Reakcją polskiego rządu na pandemię COVID-19 było podjęcie licznych działań, które spowodowały ograniczenia w prowadzeniu działalności gospodarczej. Podjęte decyzje budziły szereg kontrowersji ze względu na skalę obostrzeń pomimo niewprowadzenia żadnego z konstytucyjnych stanów nadzwyczajnych. W artykule poddano analizie skalę ograniczeń ustanowionych w trakcie pierwszej fali pandemii oraz podjęto próbę porównania ich zakresu z rozwiązaniami przewidzianymi dla stanu klęski żywiołowej.

The reaction of the Polish government to the COVID-19 pandemic was the undertaking of numerous actions, which resulted in restrictions in running a business activity. The made decisions gave rise to controversies due to the scale of restrictions despite failure to implement any of the constitutional states of emergency. The article presents an analysis of the scale of restrictions set during the first wave of the pandemic, and an attempt was made to compare their scope with solutions envisioned for the state of emergency.
At the beginning 2020, the vast majority of countries worldwide were forced to confront and face the SARS-CoV-2 pandemic. The rapid spread of this new disease resulted in radical changes in the basic principles of the functioning and organization of states and entire societies. The novel circumstances which both nation states and the international community are facing induce reflection on the need of redefining the right to privacy. This paper aims to answer, whether the current situation will lead to lasting changes in the way privacy is now perceived in Europe and what threats may be associated with the possible changes.

Początek 2020 r. zmusił zdecydowaną większość państw świata do skonfrontowania się z pandemią wirusa SARS-CoV-2. Tempo rozprzestrzeniania się nowej choroby wymusiło szybkie i radykalne zmiany w zasadach funkcjonowania i organizacji państw oraz całych społeczeństw. Nowe okoliczności skłaniają ku refleksji nad redefinicją prawa do prywatności zarówno na gruncie rozwiązań krajowych, jak i w ramach prawa międzynarodowego.
