Kwestie dotyczące subsydiów na towary przemysłowe uregulowane zostały w Porozumieniu w sprawie subsydiów i środków wyrównawczych (ang. Agreement on Subsidies and Countervailing Measures – SCM). Porozumienie to stanowi załącznik do podpisanego w wyniku mającej miejsce w latach 1986-1994 rundy Urugwajskiej GATT Porozumienia Ustanawiającego Światową Organizację Handlu (WTO). Poza zakresem Porozumienia SCM pozostają kwestie dotyczące subsydiowania towarów rolnych, które uregulowane zostały w Agreement on Agriculture (AoA), również stanowiącym załącznik do Porozumienia Ustanawiającego Światową Organizację Handlu. Problematyka subsydiowania usług doczekała się jedynie lakonicznego uregulowana w Porozumieniu dotyczącym usług (ang. General Agreement on Trade in Services – GATS). Celem niniejszego artykułu jest omówienie najważniejszych kwestii związanych z subsydiowaniem towarów przemysłowych i usług, przedstawienie uregulowania subsydiów dotyczących towarów przemysłowych oraz subsydiowania usług, jak również ewentualne wskazanie rozwiązań na przyszłość.

Issues regarding subsidies for industrial goods are regulated in the Agreement on Subsidies and Countervailing Measures (SCM). This agreement is an attachment to the Agreement Establishing the World Trade Organization (WTO), signed as a result of the GATT Uruguay Round that took place in 1986-1994. Issues regarding the subsidization of the agricultural goods remain outside of the scope of the SCM Agreement, as they have been regulated in the Agreement on Agriculture (AoA), also being an annex to the Agreement Establishing the World Trade Organization. The issue of subsidizing services has only been briefly regulated in the General Agreement on Trade in Services (GATS). The purpose of this article is to discuss the most important issues related to the subsidization of industrial goods and services, to present subsidy regulations for industrial goods and services in the light of the law of the World Trade Organization, as well as possible indication of solutions for the future.
