CEL NAUKOWY: Celem artykułu jest analiza usytuowania prezydentury w polskim systemie konstytucyjnym oraz ocena adekwatności przepisów konstytucyjnych do rzeczywistej pozycji prezydenta w państwie. PROBLEM I METODY BADAWCZE: Zasadniczy problem to charakterystyka uprawnień prezydenta i relacji pomiędzy głową państwa a innymi organami władzy państwowej. W artykule odwołano się do metody prawno‑dogmatycznej, zakładającej krytyczną analizę przepisów Konstytucji RP, a także do metody instytucjonalnej, na podstawie której opisano reguły polskiego systemu politycznego. PROCES WYWODU: Usytuowanie prezydenta w systemie konstytucyjnym Polski zostało przedstawione poprzez charakterystykę trybu jego wyłaniania, przysługujących mu prerogatyw oraz możliwości wpływania na rząd, parlament i sądownictwo. WYNIKI ANALIZY NAUKOWEJ: Analiza wykazała niekonsekwencje, a nawet błędy przepisów konstytucyjnych odnoszących się do prezydenta. Powszechne i bezpośrednie wybory głowy państwa są niezgodne z zasadniczo parlamentarno‑gabinetowym systemem politycznym Polski. Uprawnienia prezydenta jako strażnika Konstytucji, gwaranta ciągłości władzy państwowej, najwyższego reprezentanta państwa w stosunkach zagranicznych oraz zwierzchnika sił zbrojnych są w dużej mierze pustymi deklaracjami, bowiem Konstytucja nie daje prezydentowi rzeczywistych możliwości działania na tych polach. WNIOSKI, INNOWACJE, REKOMENDACJE: Niezbędna wydaje się przebudowa polskiej prezydentury, a tym samym reforma konstytucyjna. System polityczny powinien być klarowny i spójny. Jeśli zatem utrzymany ma być system parlamentarno‑gabinetowy, to uprawnienia konstytucyjne prezydenta powinny zostać uszczuplone i wskazane jest odejście od powszechnych wyborów prezydenckich. Wybranie opcji semiprezydenckiej powinno natomiast skutkować wzmocnieniem pozycji prezydenta poprzez uczynienie zeń podmiotu wytyczającego politykę państwa i podporządkowanie mu rządu.
Problematyka celowości działania izby wyższej w państwach unitarnych niezmiennie budzi zainteresowanie polskiej nauki prawa konstytucyjnego. Kwestia ta jest w Polsce szczególnie interesująca również ze względu na pojawiające się stale, w programach rozmaitych partii politycznych, propozycje likwidacji w III Rzeczypospolitej Senatu. Z tej perspektywy niezwykle interesująco przedstawia się zagadnienie funkcjonowania izby wyższej parlamentu w Republice Chorwacji. Konstytucja Republiki Chorwacji została uchwalona 22 grudnia 1990 r. Zgodnie z jej pierwotnym brzmieniem struktura parlamentu była dwuizbowa. Składał się on z Izby Przedstawicielskiej oraz Izby Żupanii. Dnia 28 marca 2001r. miała miejsce kolejna nowelizacja Konstytucji Chorwacji, na mocy, której doszło m.in. do likwidacji izby wyższej parlamentu. W artykule przedstawiona została analiza powodów powołania izby wyższej w Chorwacji, jej struktury, kompetencji i zasad funkcjonowania oraz powodów jej likwidacji.

The Polish science of the constitutional law is extensively interested in the problem of the purpose of the exitence of the upper house of the parliament in unitary countries. The issue is especially interesting in Poland, where different political parties, in their programs, propose to abolish the Upper House of the Parliament, the Senate. The functioning of the upper chamber of the parliament in the Republic of Croatia seems to be extraordinarily interesting as far as this issue is concerned. Croatia adopted its first constitution on 22 December 1990. According to its first version the House of Parliament was to have two chambers. It consisted of the House of Representatives and the House of Zupanii (the House of Counties). On 28 March 2001 the constitution was mended, as a result the House of Counties was abolished. The article presents the analysis of the reasons for which the House of the Zupanii was created, its structure, references, the functioning and the reasons why it was abolished. The parliamentary traditions in Croatia date back to 13 th century, but in the past Sabor (the Parliament) was never bicameral. The decision to appoint the House of Zupanii, although an important part of the political system, were made in at least curious circumstances. Franjo Tudjman’s opinion had the biggest influence on the creation of the House of Zupanii, it was made, although main experts from the constitutional commission opposed, as they thought it’s against the Croatian tradition. While designing the references and the position of the House in the system, the commission took for example the solutions used in Italy and Spain. The House of Zupanii was supposed to represent the regional interests, which was stressed by the elective system to this chamber. The item literature pointed out that Croatia is considerably different to the countries from which it took the example. The House of Zupanii had limited references, which were mainly to serve as a deliberative body for the lower house of the parliament. It also had a suspensory veto, for the bills passed by the House of Representatives, which it really didn’t use. The decision to abolish the House of Zupanii was made following certain political interest. Despite that it seems that nine years after the liquidation there is no intention to bring the upper house of the parliament in Croatia back to life. We come to a conclusion that the science of the constitutional law and the Croatian political scientists considered the experiment with the upper house of the parliament as a failed one.
The theme it is extremely important and relevant issue since financing of benefits in the majority of pension schemes is based on the solidarity between generations. Of special significance is the fact, that the current pension benefits are financed from the current pension fund. According to the current Constitution of the Republic of Poland (adopted on 2 April 1997) the Article 2 states that “The Republic of Poland shall be a democratic state ruled by law and implementing the principles of social justice”. The Article 67 declares that every citizen shall have the right to social security whenever having attained retirement age. The pension systems play a significant role in life of an every person. First of all, they not only provide and guarantee the Financial sources to someone who is retired but also protect the dignity of a man of an advanced age. For the majority of senior citizens the pension funds ensure the only means of living because just few retired people are able to support themselves by renting apartments or selling antiques. The immutability and stability of the social security law is very important. Przedmiotem artykułu jest instytucja maltańskiego Lidera Opozycji, który w odróżnieniu od swojego brytyjskiego odpowiednika nie spotkał się z szerszym zainteresowaniem badaczy systemów politycznych. W tekście podjęto się analizy rozwiązań konstytucyjnych z wykorzystaniem metody instytucjonalno-prawnej (i w ograniczonym zakresie ich ewolucji od 1921 r.), przeanalizowano praktyczny wymiar przepisów z odwołaniem do kryzysu politycznego z 2020 r. oraz sformułowano rekomendacje w zakresie zmiany przepisów konstytucyjnych, które umożliwiłyby upodmiotowienie Lidera Opozycji oraz odpartyjnienie nominacji do najważniejszych organów państwa maltańskiego. W ramach podsumowania zwrócono uwagę na: (1) stosunkowo dużą szczegółowość rozwiązań dotyczących wyznaczania Lidera Opozycji przez Prezydenta, co jednak nie uchroniło systemu maltańskiego przed kryzysem z 2020 r. (2) bardzo nieefektywny mechanizm powoływania określonych w konstytucji osób z udziałem Lidera Opozycji (3) bardzo ograniczony katalog spraw, w których Lider Opozycji współuczestniczy w mechanizmach decyzyjnych ważnych dla interesu państwa.

The subject of the article is the institution of the Maltese Leader of the Opposition. Using the institutional and legal method, the Author analyzes constitutional solutions (and, to a limited extent, their evolution since 1921), the practical use of provisions with reference to the political crisis of 2020 and recommendations for changing provisions that would enable the empowerment of the Opposition Leader and making the nominations to the most important organs of the Maltese state less partisan. As part of the summary, the Author points out: the relatively high level of detail in the solutions regarding the appointment of the Opposition Leader by the President, which, however, did not protect the Maltese system from the 2020 crisis; a very ineffective mechanism for appointing persons specified in the constitution with the participation of the Opposition Leader; a very limited catalog of matters in which the Opposition Leader participates in decision-making mechanisms.
