Problematyka prawna beneficjenta tajemnicy ubezpieczeniowej, z uwzględnieniem zagadnień praktycznych, nie była dotychczas przedmiotem publikacji naukowej. Wydaje się jednak, że ten stan rzeczy nie wynika z marginalnego znaczenia tej instytucji, a raczej z dotychczasowego upraszczania analizy tego zagadnienia . Celem niniejszego artykułu jest zaprezentowanie wykładni pojęcia „tajemnica ubezpieczeniowa” oraz w konsekwencji określenie zakresu podmiotowego beneficjenta tajemnicy ubezpieczeniowej. Wynikiem analizy jest natomiast wskazanie skutków prawnych przyjęcia zaprezentowanego rozumienia de lege lata beneficjenta tajemnicy ubezpieczeniowej i wnioski de lege ferenda.

Legal issues related to an insurance secrecy beneficiary, taking into consideration practical aspects have not been a subject of scientific publications so far. However, this situation does not seem to result from the marginal importance of this institution, but rather from the simplified analysis of the topic. The aim of this article is to present the interpretation of the "insurance secrecy" notion and consequently the subjective scope of the "insurance secrecy beneficiary." Furthermore, the outcome of the study indicates legal effects of the adoption of the presented de lege lata understanding of the insurance secrecy beneficiary and de lege ferenda conclusions.
